LMW Kates, $3,200 in the Lowmax drain, 2:37 $55,632.82 in the flood. Make a motion we pay this claim. 2:49 It's been moved and second we pay this claim. All in favor say I. I. Abstain. 2:58 Old minutes need to set the public hearing dates for the car creek. Can he ask you a question? 3:06 You got a question? 3:08 Yeah. What's what's what's the blow match for mowing? Mowing mowing behind between Arbor Homes and uh Meer 3:15 by the pond on the pond ponds. Say char. Good. Thank you. 3:26 public hearing dates for part three. 3:29 Okay. I have available um October 27th or November 10th at the earliest dates. 3:39 It's all ready. I do believe yes. 3:47 Yes. We have the assessment role in a map. 3:52 Um how much discussion you want to discuss it now as far as we got I presume. 4:01 Yeah. Yeah. 4:03 We have to set the rate in the motion for you. 4:11 What rate you got, Raymond? Well, I I've looked at it and there's brushing locations and the 4:20 digging that needs done on it is not extensive. It mostly has a rock bottom with shelves on the side and the bottom that 4:28 need removed to increase the capacity back to what it was. 4:33 Um, if the whole thing were to be there's 13,300 ft roughly in distance. 4:40 If it was all to be brushed and dug, it'd be around $ 109,000 $110,000. 4:46 But I don't see an urgency to attack the whole thing at one time. If we had 4:53 15 $20,000 a year and start whittling at it, or we could go with more to go after it quicker. 5:02 There's 2,700 acres roughly. 5:06 If we had $5 an acre, you're looking at 13 and a half 13,500 a year. Or you 5:14 could go higher if you go 10. I home sites on it. 5:18 There's two individual home sites on this portion. The other home sites are absorbed into the smaller wheds, the 5:26 Carp Creek tile, the Shupe drain, and the Robertson drains. Rimar, 5:34 Robert Reimar, excuse me, have home sites on them. So, they don't have a home site on the open part. 5:43 So, $5 an acre would be sufficient or would get it done quicker. I want to have the 5:51 fund sitting and not get used, but we charge a home site. 5:58 Yeah, we would. The others are paying home sites on their other tributaries. So, they should have a home site also. 6:05 $5 an acre and $50 a home site. 6:11 And we don't want to bring $13,000, right? Yeah. 6:15 That is not enough to hardly get started on. But that's a point. I I don't know 6:21 if Nolan I Nolan is here to put his input into it or if Window has any input into Windowsiz ground going into it. 6:32 Not quite a bit. 6:35 Well, how far does that is that a regular drain? 6:38 Just north of 400 north and uh to the east or to the west of 6:52 seven. 7:00 30 300 I do believe the road the road numbers. Oh, there we go. 7:11 400 west of 400 west and north of 400 north. 7:18 Not quite to where brown ditch comes in. 7:20 If you want to hand these down and keep one. If you and Gordon could share one for now and pass to the others on now. 7:28 American keep one at the end. 7:38 Like Gordon was saying, $5 to put a whole lot in there to do a whole lot. 7:43 It's depends how fast we want to get it taken care of, you know? I Or do we set it at 10, get it done, and then lower it later? 7:53 And then we can lower it if they complain at the And if they complain too much, we'll go back. 7:59 You might say $10 an acre for 3 years back to five or something. 8:05 We did come down to Yeah. Can't can't go up with the can always come down. 8:12 Advertise it at 10 and 100. Yeah. See if anybody complains. Yeah. 8:19 I would think a $20 mill If somebody's paying a dig out should be at least $20, 8:31 I would think to keep the open part open. 8:36 Looks like a lot of the a lot of it has been maintained, but the trees are starting to come back, so they may not want to maintain it themselves anymore. 8:50 Okay. Okay. So, what dates do you have again? 8:52 Okay. Um, November 27th. I mean, October 27th or November 10th at the earliest, but I mean we can do a little partial later as long as 10:27 or when was November 10th. 9:03 I don't know. 9:04 As long as we have it by the end of the year. 9:06 If we're going to do more, I'd rather do it sooner than later. If we're going to do more public hearings and we have opportunity to do more. 9:16 Um, if it's ready, let me sooner. 9:19 We have Jefferson ditch. That's ready to go. How big is the Jefferson bit? 9:27 Uh, you have an idea, Cindy? I know. Okay. You want to do it October 13th? I can. That's probably the earliest I can do. 9:35 27th is okay. I mean, that still gives us two months to squeeze in more, doesn't it? Yeah. 9:46 So, you need a motion? Yep. 9:48 have the hearing on October 27th. Cart Creek. October. Cart Creek. Yes. 9:56 27th. $10 minimum. Right. $10 acre. $10 an acre. $10 an acre. 10:05 Home site. 10:05 On a home site and 20 minimum. 20. Four years. Four years. And a partial rate. 10:13 Partial rate. $10. I would be okay with me. Okay. 10:20 Be the same as an acre if they just have a parcel somewhere. I'm not I'm not sure if there's any parcels alone in this or not. 10:32 One have one parcel in it. Okay. 10:38 100 home site $10 par 20. Got it. 10:47 Then move to have public hearing for the Cart Creek on October 27th. 10:52 Parcel $10 an acre or $10 $10 an acre $100 home site $20 minimum. 11:01 Do I have a second? Second. 11:06 Been moved and seconded. All in favor say I. I post same sign. 11:14 Okay. I just need um I can have this map. I just need a surveyor report when you get a chance. Okay. 11:21 Now that we got the right. Okay. Move on to new business. Middleport. 11:30 David D'Vor and Steve Comr. Maintenance request. 11:36 No. Go ahead. Steve more than I do. 11:45 You come up Steve there. 11:50 Several acres going into Middle Fork. I guess they've started collect started collecting maintenance. The the question is approach presented to me. Do we need to start on it? I I think we should. 12:02 What are we going to start? 12:03 Well, okay. I think uh I think surveyor decide does he need to go out and take a look and see if it 12:10 makes sense to you know what we need to do to get a start on this. So we put it off. Do we quit collecting money then 12:18 you know you haven't done nothing yet. 12:21 I know you haven't done anything yet but it needs to be done. So I guess we need to go out and make an assessment to see where we need to start at. My my biggest 12:29 concern would be if any tile that are held up with water submerged or restricted would be my first all the way 12:38 to the east side. I said there probably is that where I would do what? 12:43 That is what I would like to approach first would be open up any tile that are held back. 12:48 But to do that, do you need to go to the west side and start on it and then come back east? 12:54 I don't know the answer to that. Whether it's a log jam that we can remove and open up a tile, I would say remove the log jam if we got to dig. 13:02 Right. Right. It's have to analyze. 13:04 I would I would say it probably eventually needs to be dredged and I would say get started on that process would be Mike rather. So 13:13 down at the the junction or down at the where water ditch or well I'd say all the way to the west end where it starts. 13:22 Okay. Cuz the Middlefork fund covers Middlefork upper down to where water ditch comes in. Right. 13:30 We've never assessed from that point to the county line as far as approaching that part, but that's pretty well open. 13:39 I do believe right that stretch. 13:42 I think there's quite a bit of brush on the middle fork right where the junction of waters is. I think both of those 13:50 could be used right attention. We also have the beaver dam by Rigdon that we still need to get removed. 13:58 Right. 13:58 Right. Whenever get ready to do that, right? 14:02 Do you want to do is that could require an esavator work or do you want to do that or what? 14:06 We tal we talked about doing that just the way the year has been. We haven't been there and I don't really get excited with across the crop to get it at this point. 14:15 Yeah. And I don't think it's damaging anything as far as water itself back. Right. Right. 14:20 So So are you going to do it after harvest or do you want the board to find somebody to No, I can I can try to get on that after harvest. 14:27 So this this stems from the conversation that Dave and I had earlier in the year and then and then continued on with Steve when they were up here. And so 14:34 this thing's got $19,000 in it. It'll bring in another 30 that you get this year for a total of 48,000. 14:41 um and you know whether just sit let that money just sit in there and keep collecting interest whether they wanted to get something started as this thing 14:51 brings in money. So that's that's where this stems from. So what permission do you need to go come back could do a look at it and and come back and say hey 14:59 there's more we're going to do turn me loose I got to I got other ones to look at in the process the list. Yeah. And so we need Dave or 15:07 Steve to come up here and just initiate the process since they're on it. And that's what they're doing today is just initiate the process and Okay. 15:13 Get started going analyze and if you got a spot that you want me more important than other What do you think to do? 15:21 Steve, I'm going to defer to you on that. Whatever you think. 15:25 I would like to get the brush out of the way and then we can incorporate the spray program as we get the brush removed. 15:32 He'll have regrowth, right? Um, and and my thoughts on that too, if you're going to do the brushing, 15:40 if the dredging needs done, that's the time to do it cuz the weeds are already knocked down. You can see it quicker. We 15:47 can approach it that way. Brush it and dredge a section. Then while we analyze and decide what needs addressed first, right? Right. 15:57 You got it started. I'll get you on my Okay. 16:00 I'll put you in the car and I'll take you there eventually. 16:03 Okay. All right. I'm sure Steve Green pond window. 16:17 Yeah. Um I was want to get permission to hire a camera and a jet to go through crane pond from Virginia to New York. 16:28 Uh, I stopped there on the way up here and the V at Virginia we got about 3 in of water and at New York we got about 21 in of water. 16:41 Don't smile, Gordon. 16:43 New York is already in the red, but I guess we got to do it. But we got to keep water moving. Huh? Yeah, we got to keep water moving. How much in between? 16:51 She said 3 in. When you get the guy, you're going to get the guy from Marcelo. The guy's always did it. 17:00 Yeah. I got a job for it. He did it the last three times. When he comes down, I got a job for it. He get it opened up when he does it. 17:08 Yeah. But he gets it opened up, but the roots are still in there. In there. 17:16 And he was here a year ago. Two years ago. 05. 25. 17:21 25. I'm going to say it was March05 or April05. 05 or 25. 25. 25. I'm sorry. Yeah. 17:30 Say 05. That That's a long time. 17:32 Yeah. Yeah. Um Yeah. Been 03 and 17 and 25. 17:44 You you saw it also. 17:46 Yeah, it was definitely backed up. if I could if they would pay or 17:53 do the best they can as far as cameraing it so that we can chronicle the junctions on those joints as far as what 18:02 they are now and then what they're going to be in the future and how much growth we have in them just for for reference. 18:12 I mean they did it before I looked at the video you could see somewhat but not real good. I don't know if there's a chance of getting better pictures or 18:20 not. And I don't know if that would cost extra to get better pictures or not. 18:26 Probably kind of hard when it's full of water. Pardon? 18:29 Probably kind of hard when it's full of water. 18:31 Yeah. But you know, I'm sure they're wet backed up. So it could be another month or two before they get here. 18:41 So we just need a motion. 18:43 Where we going to get the money? It's already in the red. I know. I mean, I know it needs to be done. 18:49 No, just I think it's got to come out in general fund. It's, you know, you got to keep water moving. Water's got to move. Yeah. 18:55 You know, by time you go out there and drive around and there's yards still with water in them and and cross bases. 19:01 It's on maintenance, right? So, we can just Can I pay it? And then pay it back. They pay me back. 19:07 We can't reimburse anymore. 19:11 We like that. We like doing it that way, but they put us out. So, how much maintenance fund we got? 19:20 What's in general? What's in general? 19:21 Yeah, like 200. Uh, what's in the general? Last time I think we cost us 6,500. 19:29 What's in the general? 267,000 is in the general. 19:34 Well, we get we'll get reimbured, but it need to be small. 19:38 Oh, does the crane pond pull in each year? 19:40 Crane pond. So, next year the assessment goes up, crane pond's going to bring in uh $29,17. 19:49 Just it's going to be a year after what do we need? 19:57 Motion make a motion let window hire the uh crane pond camera and see what's going on there. 20:08 Any second move that we 20:14 camera and jet this crane pond moved and seconded. All in favor say I. 20:22 I same time. Thank you. Peter arranged. You're welcome. 20:30 You're next again. You're next again. You got to do it. Lowmax. 20:38 Um I didn't when we've dredged the LMAX on the north end, we have always stopped 20:46 at 26th Street and then Raymond said that that goes for another,000 ft north. 20:55 Wonder if um we could take bids and get that north part dredged. 21:03 From what I remember, the legal goes all the way up to where the shields comes in. Yeah. Okay. 21:09 You want to go all the way to the shields ditch. All the way to that joint. Yeah. 21:14 Junction and then Yeah. upstream. 21:16 Our main problem is right there in the tree farm. Okay. 21:22 In your package, you have a picture of the Lowmax and what they're talking about. Uh where the main trees are on Miller Avenue and 26th Street. 21:33 I think it's your third picture of the beacon. Go out there, knock on the door and talk to them. 21:39 Pardon? I'll go out there and knock on the door and talk to them. 21:42 Yeah. Regulated drain and we got to go through. Yeah, I can get you a number. Okay. 21:50 So, how many? I like them in person. Pardon? 21:53 I like to meet them in person instead of on the phone. They're hard to catch. Okay. 21:58 Yeah. But I mean, they don't mind meeting yet. Okay. Yeah. They've been easy to work with. 22:07 How How much would you estimate of you? 22:09 They haven't seen it yet, so I don't know what they're not real big trees, are they? No. 22:16 Yeah. I don't It's not going to be that much. No. Okay. You get a price. 22:24 Brush and dredge. Pardon? 22:26 Want to brush and dredge it? Yes, please. 22:32 Yeah, I just I always thought it stopped there at 26th Street. I didn't realize it went that far. 22:38 No, in the book it goes all the way down to where Shields comes in. Okay. 22:48 We need a motion for that or not? 22:50 That be like what? I think you just you just give us We just got to get programm. Okay, add it to the list. 22:59 Yeah, we have to go and look at the letter talk to the people. 23:06 Move on. Grassy fork. Josh car. 23:10 Uh when Josh is coming up in your packet, you have the grassy fork off a beacon and some notes on it. Uh it's got yellow writing on it. 23:21 That just two, right? 23:29 Uh I'm just proposing that we brush from uh State Road 26 bridge on the south side of that to 800 South. 23:42 And in that area, uh, we have in the center between the two yellow lines on that map, there's two I I call them gravel pits. 23:54 They're ponds now, but we we'll personally pay for that. Um, we own those and that'll be 24:04 difficult to dredge and brush and do all that at some point in time, but it's got to be brushed. But that area there we 24:10 would pay out of our pocket. But I was I assume the fund I don't know what the fund's at right now on the hook. 24:18 Uh the fund on60. 24:20 Yeah. 160 is shut off. It's been shut off since 2022 and then it brings in 33,000 a year. 24:29 So the fund is for this type of work, right? Yep. Yep. Raymond shook his head. Yes. 24:37 And there's there's parts of this in that stretch that, you know, one half of it is brushed, but I just I'd like all the trees down myself. 24:49 Do you own all the stretch or we control the we own or control the all the west the west half of that in that stretch? 25:00 Is there someone there that's going to be opposed to cutting the trees? I don't think so. I would not think so. 25:06 uh Irving's own um name on the parcel that uh it says 25:14 red in it or somebody wrote red on it right there. Your yellow line. Yeah. Yeah. 25:20 Yeah. Just Yeah. Just just north of that yellow line. 25:25 But I I think every other landowner would be fine with it. 25:30 Brushed dredged or brushed it. So, uh, I I Gordon, you would know when was that d was it in 16? Was it dredged? 25:40 Um, roughly I don't know. Is it? 25:43 And we dredged it to State Road 13 bridge is where it started, right? Started. Yeah. So, do you remember who did that? 25:51 Uh, Van Van Horn, I think. 25:53 Van Horn. Yeah, I think it was Van Horn did it. No, Redmond, was it? 25:57 I think it was Van Horn. Steve, do you I think it's Van Horn. Uh, December 20th, 2016. 26:03 Redmond was paid 19,000 out of the account. 26:07 Must have been must have been Redmond then. 26:11 No, the whole grassy fork was dread. I think it's by Van Horn. It was a lot more money than that. And it was before maintenance d cuz we had to do it. Remember that Gordon? We had to do it. 26:20 Yeah. That was just a stretch. Collect a bunch of money. 26:23 Collect our money. Yeah, that's when that was stuff like that. You guys all land owners contributed. 26:28 I remember that. happen directly after the the dredging then we put it on maintenance. Yeah. Yeah. 26:38 We need Raymond added to your list. Another one put on the list. Call me Call me Raymond and all. 26:45 If you haven't seen me, call me and remind me. You will not offend me. 26:53 My list is growing. Yeah. Taylor Creek. Oh, go ahead. 26:59 I was going to say 13 inches of rain brought everybody out. Yeah. Good. 27:06 Good. Taylor Creek desert desire and Edmond Edward Arasue. 27:32 Hi, I'm Selena. Um, I live in Sway, uh, 115 South Fourth Street. Um, our my 27:40 house, uh, ended up getting flooded out, um, because of rain that had happened. 27:46 There's a tile over there. I think it may I'm not sure. It's been cleaned out before. Um, but we have a flooding 27:54 issue. I don't know if you these are the pictures. Um and it had came through the culbert that is underneath the railroad 28:03 cuz there's a railroad, our road and then our house. Um and it had totally gotten flooded out um because the drain 28:10 was not uh draining properly and the keys have been um keeping an eye 28:18 on it and helping us and stuff so they do know about it. 28:25 But I figured it would be a good thing to be brought to attention. 28:34 I'm going to send you guys pictures of Phil Jennis gave south of railroad that she's talking about around the back too. 28:46 Chris, you want to speak on anything? 28:51 You want to speak on any what you know about Taylor's tile? 28:57 Chris, the um that tile 29:04 is a 20 in on the north side of 300 and goes to Taylor Creek to 29:12 300. And from 300 uh fix or yeah, Braggs put a new 24 in 29:21 almost to the railroad, right? Not quite to the railroad, just shy of the railroad. And then uh we don't know what 29:27 size pipes underneath the railroad, but um we're not getting any movement 29:34 from the railroad to 300, which is about 4 or 500 ft. And um so is it broke out there someplace? 29:44 Pardon? Is it broke out there someplace? 29:47 No, cuz see Braggs put uh let's say Braggs put in 300 ft of 24 29:54 uh from 300 uh Taylor Creek is a 20. That's in pretty 30:01 bad shape. But the uh there's not enough trees pushed back on 30:09 where Brag put the 24 in and the 24 doesn't go quite to the railroad. There just need to be a lot of tree removal. 30:19 Thank you. 30:21 So, how hard is that going to be to get the trees removed from there? need to love tree ribbon on the list. 30:32 Look at it. And that's where we're gohead. 30:35 And that's where that's where we're going to send the camera in, right? And check it out, too. 30:40 Well, there I got I remember 30:48 years ago. Well, I don't know how time goes back, but I made notes 30:55 and I was in that 20 in or 22 that goes back to Taylor Creek. 31:04 Byron Cook come from the creek through that lot through the gate was a 24. 31:16 Well, Donovich is still alive. Okay. 31:22 Because Donovich, I hope now the field west of the household that ditch quit working. 31:35 So, we fixed it back there. And then 10, 12, 15 years ago or so. And I still 31:44 got it wrote down right here. 21 ft from the east fence. That was where 31:53 Hypo's house is. 31:58 And the tile I couldn't reach it with a probe. I had I had to dig it with a 32:04 backhoe and then probe it. And it's 5 and 1/2 or 5' 3 in to the top of the tile. 32:15 And I want to take and put a Chris back here. 32:23 Get up here. 32:25 Where where did you find Where did you find you guys run dye through? Where did you put dye in it? 32:33 We put it in the T. That's probably 100 ft north of the railroad tracks and it goes straight back through what that 22-in tile is to the creek. 32:47 That tile goes over along the road. 32:49 Correct. It runs part of it runs underneath that lane back there. Right. 32:56 Hypo's got a over blow off his house back there that runs into that ditch. 33:07 That's the one that John dropped the loader in. 33:11 But this tile and I I've asked the town of Sees this 33:17 morning and I asked the town guy and they're not doing doing very good job keep track of maps. That's Raymond. 33:26 Raymond, what did you come up with? 33:28 I found it on a plat, but that tile is there and goes down to 350. It shows it on the plat. And I would I would I would 33:38 like to go down the driveway somewhere and get into the tile and jet it. That's not right. That's not right. 33:43 Well, hang on, Chris. I want you to talk a little bit about you. you about it. 33:46 I'm going to tell I'm going to tell him all this about raising hell 33:54 people. Everybody in this thing has done all they could. We sent down a trash buff. I had three trash buffs down there hooked to this dish. 34:05 Going over to another thing with fire hose and done everything I could. 34:13 What's got to be done? As Wendle said, Nes, 34:22 that old lady Nester, I liked her. Don't you Gordon Gordon's wife. 34:31 I was nice to her. And she was she wouldn't let us take any trees out. When Nick Brandt come in, put the 24 in. 34:39 He went out around the trees because they were classmates. That's what it gets down to. 34:49 The drainage board, if that is a county tile, which it is, goes over 34:58 has a rideway 75 ft on each side. 35:06 Unfortunately, I'm probably the oldest one here, but I remember King used to farm that. 35:16 We never had a dig and Roy living could come in, put all those trees back there, sold that lot up there, the nesters to build that house. 35:28 That's when the pro when the trees went back there. That's when we started having problems. Now, I don't know what's underneath the railroad track. 35:35 Maybe one of them knows more. 35:37 No, when the water gets down, we're going to find out. Uh-huh. 35:42 When the water gets down, we'll try to find out. 35:44 There you go. So, but under the railroad track, my understanding is the railroad will 35:54 participate in working, but that's not the problem. The problem 36:02 is Nester's trees is bothering you guys back here. 36:07 That's bothering Phil and all those guys. Don't let it go over the keys. 36:13 That's okay. If you get it straightened out and like you say the drainage board, we 36:20 got the state state law says we got a 75 ft easement. If you get into the 75, we can make him take part of his house. 36:33 Okay. I want to talk about um a couple things here. Chris, you've done quue digging on the north side of 300 to the 36:40 water plant. Correct. So like talk about that tile and condition that tile. 36:44 So from the from Sway Road north back to the sewer plant, it's a 22 or whatever it is and it's in bad shape. It's been 36:53 we were into I think eight different places last summer. There's a stretch in there of probably 30 ft that's actually a 15-in galvanized culvert and then goes 37:01 back to a 20 and then a 22. It's been replaced with a 24 and it's just I propose I'm guess I'm proposing that we 37:09 go from Seway Road to the sewer plant with a new 24 cuz when it dumps out at the ditch it's actually dumping out as 37:16 an 18. So, we start at the railroad track with a new 24 and we end up at the ditch coming out as an 18. Doesn't make 37:23 a lot of sense to me, but I tell you what I would rather do than the 24. 37:31 I'd rather do a 30 from the from the creek to the railroad track 37:38 because you got that West End town going into this. There's a ditch on the 37:48 north side of the railroad track that goes towards the elevator. 37:54 And that's another thing full of water. 37:58 That's another thing. We don't know how much water the city has dumping into that tile. So 24 38:07 be nice, but that's going to take care of things today, right? If you get any develop or anything 38:15 on the south end, I think personally think it's a little more money. 38:24 You're only going to that was put in 100 years ago. 38:30 So when you put one in, put a 30 in and then whatever you want up into it, you can. 38:39 Still, I'm going to have one minute. 38:40 But I'm going to tell you, I want I want him or whatever. 38:47 You can't reach it with a probe 5 foot 3 in to the top of that tile. I 38:55 remember because I was in it and I run a tile from along the road over and went 39:02 into that. I took a half inch tile, put it down on top of that tile, marked 39:09 around it, and I drilled it, but I don't remember how well. 39:17 So, Chris, do you farm on the south side of river? Uh, I do. How big is that tile back there? 39:21 Uh, it's a 12 in that goes from the catch basin that dumps into this 24 that heads north, but it's a 12 in that goes through Phil. And we we were this spring and it is full mud. 39:32 Phil. Yeah. Very full of mud. 39:35 It's full. We replaced that sewer plant. This is going south to 350. No. 39:43 Down that road is the sewer goes to the sewer line. This 39:51 I don't know what year we put that in, but I hold the gravel out of faults for that. And I can tell you where it comes 39:58 comes down behind Oh, what's your name? What's up? 40:06 So, here here's where we're at on this deal. Now, the there's been talk about putting a new tile in there from the sewer plant to 350. And you and 40:15 your in your packet again, you have the tailor a picture of the tailored tile and where it Beacon says it goes to 40:24 start over. And so, um, there's been a call made to the railroad, 40:31 uh, to see what help they would give if the interest got high enough to cross the railroad. Um, they were, that was a 40:40 positive conversation. Right now, we're waiting on Raymond for the legal description of where that tile is. if we 40:48 get interested in replacing that tile from the from the sewer plant to the south to 350. So that's where that is 40:57 now. Um like Chris said, it's shot going north, it's shot going south. 41:06 So once we get that legal description and get that to the railroad, then we can, 41:14 if the board pleases, proceed with attempting to replace this tile. 41:20 A little bit of input. The state or the county highway replaced the pipe underneath Swayazy Road. I think it was 41:28 a 24 that they put in there. And then they have that new 24in tile that is in Nester's yard. 41:37 I like Keny's idea of increasing the size to 30, but or whichever, but those were just installed new. If we put the new 30, we going to take out the old 24. 41:49 Well, I think that's a discussion we've had before. 41:50 Well, that that old tile that's in there is 6t deep. 41:58 Yeah, I think that's a discussion we had before. What grade will we be on the south side? Does it need to be lowered on the south side of the road if it's possible? 42:05 Yes. 42:07 And so, you know, do you if you if you're going to lower it and the railroad is going to work with us, then you know, your first init my first 42:14 initiation is the old 24 is not going to be worth much if we're going to be below grade and lower the railroad and and uh are we going to pursue the county 42:22 highway to replace the new 24 with a new 30? We're going to have to if we go deeper. 42:29 Well, I'm just I think it's a step at a time. Right now, it's a it's, you know, we're waiting on a legal description in the railroad and seeing what our options are there. 42:37 I'll tell you what, the problem's going to be getting the railroad to work with you. 42:44 If they'll work with you, you got half the battle. I agree. 3/4 of the battle over. 42:50 We're going to work at it. So, there's 332,000 in the fund. Obviously last meeting we talked about dredging Taylor Creek north and you looking into that 42:58 since ends it's rained and rained rain so we don't know much about that. So right now the hold up is a legal description. 43:05 Okay legal description for a later date of contractors to put it in. 43:14 Say that again. 43:18 I'm kind of running out of time by using the money from Taylor Creek open toy road eventually. 43:25 I find a go from the railroad. You got to have an outlet first. Mhm. So, we need that legal description. 43:32 Go from the railroad to Taylor Creek. Okay. 43:39 We need that legal description. That's what we need. We need to start description. Now, when if Wendle gets the jeter, are we going to try to jet this out to help them guys? 43:49 The guy that I had him down here. Wendle can back me up on this. 43:56 The guy I got pictures down there on my computer 44:03 of this tile. The guy told me that if you don't put copper sulfate in that 44:11 thing there at the railroad track every year 44:20 I'll be back here in 11 months and I'll tell you what, we've done a a 44:28 heck of a job and and I don't know if we've some of us been charged to drain board 44:34 from Taylor Creek, but we found out we could get copper sulfate in those jubs 44:44 at Royal King for slide pools and we dumped that in there. Right, Jennis? 44:51 Yeah. He said yes. I think he dumped it work. 44:57 I dumped it in there for long department out there, then kind of turned it over to him. I don't know whether they quit it or not. 45:05 So, do we need a motion? I think we need a motion to to uh let the 45:13 camera and guy clean us out when they're here. We can spend some money. I want to know where that old 45:23 20 or 22 concrete or not concrete 45:31 clay tile is 6t deep. I mean I've been in it. I think it's all man. 45:40 Is there not? when we was out there fishing. 45:47 What What did we hook into? 45:51 I I'm pretty sure we hooked into this tile. This tile's pretty deep in some spots. 45:58 When When Chris had it dug up before, we shall grade and we can get a 2/10 grade from the creek to 300. 46:10 And that and that's 8 1/2 9 ft deep. How far off the bottom of the ditch at the sewer plant? 46:18 I think um I don't remember that. The creek has been clean. Yeah, but we don't know. 46:26 But it should have been sprayed every two years. But maybe it has. I don't know. I 46:33 mean, desiraably it's not to put a tile on the bottom of a ditch, but if if the grade is required, then the grade is required and you just have to keep the open ditch. 46:42 I don't think you have to. 46:43 Okay. I mean, it'd be wonderful if there was a foot and a half fall off of the outall of the pipe down into the open 46:51 ditch, but sometimes Well, I'm sure that north 100 ft is going to have to um 47:00 I mean, we can bring it up to 10th grade and get plenty cuz if you got all the rest of it at 210, you're going Yeah. You're going to have the force to keep it going. 47:08 Yeah. 47:09 Yeah. You can definitely flatten out the lower portion or the the northern part but the downstream part of the tile. 47:18 Okay. So, you're going to find the legal description and and you guys are well board. 47:25 Yeah. Board's got a vote on approved jet. Yep. 47:29 So, I'll make a motion that uh uh when we'll let the window of hot tire uh the company on a Monday to come and 47:38 jet this one when they do crank pond also. Second. 47:44 Been moved and seconded that we jet Taylor Creek when the jeter is here. All in favor say I. I. 47:52 Those signs carried unanimous. Pipe Creek, Don Matthews. 48:14 Don, hang on. Good morning to you all. 48:15 Don, hang on a minute. Uh, Mary said that you can't vote. You got Kenny. Mary said we got to revote on that cuz you got to abstain since you're on Taylor Creek. 48:24 Well, I'll abain. Okay. Yeah. Go. 48:30 Uh I say good morning. Uh this is my first rodeo and doing anything like this. Uh getting older. 48:41 Uh my kids are going to get this property that I own here for too long. 48:46 And I decided to get my ducks in a row and uh make sure everything was up to snuff for them. 48:56 and finding out that uh when my dad bought that property, it 49:02 was 20.01 acres in that property and um we just had this survey done and 49:11 the survey shows 15.53 acres. 49:16 The reason for that is I stand here and I listen to all these guys talking about poor drainage. I think my problem is too much drainage. H uh back when I was a 49:26 kid, seven or eight years old, we lived down at Jalap Trails In. My dad had a uh bait house down there and we shed 49:34 crawls. So I was real acquainted with the river down there. So I' I've been around water all my life. Uh the 49:42 reservoir was going in up there and so we had to move out of Jalapa because that become flood plane. 49:52 We moved out to Mirtown uh across from the administration building there. 49:58 And uh when I was a kid, there was a node that run off of the 50:06 creek back west like in a deep off of the off of the creek. We played in it all the time. Well, when the reservoir 50:15 got finished, that disappeared. Some at some time they come through and they drain the creek or dredge the creek out. 50:22 That little node disappeared, you know. 50:27 So here 8 years ago, the property sold across the street. They 50:35 got a new survey done and their survey shows the middle of Pipe Creek is the boundary line. 50:44 That's not correct. But correct was the little node. There's five acres that run on the other side of the creek that run around there. 50:54 But uh over the years has just disappeared because it dried up the main creek. When 51:00 I was a kid, uh they had dredged that earlier before we bought the property, before we moved there, because that 51:09 woods was so thick, you could not get through it. But I could go down that dirt mound where they had dredged the creek to get from one end to the other. 51:17 And it stops at at one end of our property. Uh north and south. 51:24 Yes. North and south. Uh so that made that little node disappear. So that's what they're saying that that uh Pipe 51:32 Creek is the And it's not. That's not I played in that creek when I was a kid all the time. And uh well that's where 51:41 the girls like to play back there in the deep because the main creek was too deep 51:45 for them. So um what I am asking is 51:55 uh which one of you would like to take a look at those? uh 52:04 they can't find the boundary line or they're saying the boundary line is the middle of the creek of Pipe Creek. On my 52:11 deed and abstract, it doesn't say a word about Pipe Creek being the boundary line 52:18 to the west. It says the creek is what it says. And what they're what they're referring to is that little node that 52:27 run around that dried up after the reservoir got all done, the waterways all. 52:34 And so that's where I'm at today. 52:39 I uh I say I had to start somewhere. So this is where I'm at. 52:49 That's just dust go the old 52:58 really demented. 53:08 Okay. That's from 60 years old. Um, we had I had 53:16 matter of fact might remember we had Gary Drew go over there and do something down there on that creek. 53:24 Yeah, this is some I don't know what 53:31 you don't know. Gordon or Rich or Frank, do you understand what he wants? Is this I need a copy? I'm lost. Tell me where he wants. 53:39 Okay. Uh, do you want his property lowered or No, he want he's wondering boundaries. He's wondering where his 10 acres went. 53:48 He wants the boundaries. 53:51 So, Dan said, why did it move? 53:55 His deed says over to the middle of the creek. No, but they moved the creek. 54:03 The creek move. 54:06 Did they straighten the creek out is what they did? 54:09 Apparently they did because that's what that dirt mound is. The dirt mound is all on my side on the east side of the creek. I don't know when that happened. 54:16 My dad always swore that the Army Corpse engineer done that when they was put the reservoir in. I have no idea. But that's what he what he swore. 54:26 So that's my creep. What can be done about it? The very first one. 54:33 I know. I'm just saying we don't deal with property lines. Yeah. Well, we're going to have to. 54:39 So, we're deal. Are you saying you lost? 54:46 Excuse me. You still own 251. That's what you pay tax. 54:53 Yes. That's what I have for 60 years. New survey. Where was 15? 54:59 I don't think we had Right. 55:01 I got I got the new survey and it says 15. Right here. Okay. 55:08 When was the survey done? When was the survey done? 55:13 Each one of you can have one. I had When was the survey done? Don, when was the survey done? 55:20 Just last week. A couple weeks ago. 55:26 So he don't need to come drain me. The drain board don't have nothing to do with private life. No. Which office you want to go to? 55:33 Kenny has an avenue that may if the old old ditch that he refers to the 55:41 the the side ditch to Pipe Creek used to be the original Pipe Creek in the legal 55:48 description in the old books. It may it may have that described in the old 55:54 description cuz when I did talk to the some people from Miami County when I was over there on a log jam on Pipe Creek, 56:04 they referred to the Pipe Creek getting dredged. They were old enough that their parents remembered it getting dredged. I 56:11 don't know what year that was, but the Miami County surveyor drainage maybe 56:19 will put more light on what year that was because it was a lot more extensive in Miami County than it was in Grant 56:27 County. I would presume it be about the same time that they did the blasting and boring or the blasting by Rosenberg and 56:35 pipe green when they were knocking that uh limestone out to get more depth may 56:42 have been the same time frame but that's it's a stretch as far as I the drainage 56:49 board and service for soon property lines but we might be able find a legal 56:56 description from the old ditch And if his description for his land goes to the middle of the creek, that would be the old creek, not the current creek. 57:08 Is there is is there a discrepancy on the gentleman's property on the west side of Pipe Creek? Has he gained 5 57:16 acres? when he when he came and introduced himself to me, he went to plural my man left and but he introduced 57:25 himself and he I asked him I said do you know where the boundary lines are? Did they show you where the boundary lines are? He said well yeah I said where is 57:34 it to the east of your property? He said the middle of the creek. I said you're exactly right. That is exactly right. I 57:41 said which creek? And he looked at me real funny. I said it's not a loaded question. Trust me. 57:49 Did his acreage go up when he purchased? 57:52 Yes. Certainly they in fact on Don Lemer's uh survey that she has got it said that he had to adjust the acreage 58:01 and he could not find a locating point on 18. So he put his own locating point in the center of the bridge 58:11 because because it was in chains and rods. Yes. And he said it wasn't clear. 58:19 Well, I I understand that mine's in chains and but they're not off 25%. 58:26 Fro from from your memory of the old ditch that was the property line. 58:32 Yes, sir. Does that hit 18 at a different location than it currently does? Oh, yeah. 58:37 The same place on the north and the south both. 58:42 The Pipe Creek Old and Pipe Creek New where they go through 18 and the other road to the this property to the south. 58:50 Are those the same locations? Yes. 58:55 Okay. I just So, the bridges didn't move on it. 58:59 No, no, no, no. Nothing has been moved in between. 59:02 My dad said that that was put in like 2 years or 3 years before we moved there and that's when all the reservoir was going in up there. 59:13 U I would like to show you a map that I've got from 1938. 59:19 Uh it shows Jones's property to the north of my property which is our boundary line. 59:28 and it in yellow and it shows his property on the other side of the creek. 59:33 It extends on the other side of the creek. Well, if you look at that, the wood line is all together and that was 59:41 all bottom lane that was always wet down there. When we moved there, there was water halfway up the field behind the house before, you know, then they got 59:49 the reservoir done. Well, that took care of the water. And uh but this map shows 59:57 where they surveyed I don't know when or why property and it goes and it all matches together with mine and that was all one big piece of property in there 1:00:06 at one time and I've got all the records of when it was sold off at auction how it was measured. 1:00:15 I I think you'd have a legal pursuit if you were to the property across the creek. 1:00:23 Thank you. 1:00:24 The property across the creek that gained acorage. If you can prove that that acreage was that same acreage lower 1:00:33 for for a long period of time and then magically they gain 5 acres worth of ground and you lose 5 acres of 1:00:41 ground. I would think you would have a pretty good footing right there. 1:00:46 If uh if you look at this, there is nothing that can be that has been moved since we bought that property. State 1:00:53 Road 18, County Road 800 West. Ken and I know where our line is. There's only one place that property could be missing and that's on the other side of the creek. 1:01:06 I don't know. Don Le, like I say, in his explanation, he said he couldn't find barkers. So we put the markers, you know, where he thought they should be. 1:01:19 The the extent that I would have to look into the books to find a legal description for where the old Pipe Creek went through and then possibly not find 1:01:28 it, I think you have a better footing legal wise to go with the amount of acreage that has changed hands for no reason. 1:01:39 That would be my suggestion. All right. Who's the ground on the other side? What? Who's the ground on the other side? 1:01:47 Where's the 5 acres go? Oh, the other side of the creek. Who who is that? 1:01:53 Uh guy named Smith. Whoever some guy named um Jason Susan, you know. 1:02:02 Yeah. Not really anything we can do about it. Yes, sir. 1:02:09 We can we can know where the old creek was. I'll tell you something, but we got to find record of where the 1:02:18 old creek was. People buy farms today years ago had fences through them. That was the boundary line. 1:02:30 Whenever you buy a farm today, you ought to have the thing surveyed. 1:02:34 Y legal distribution. that and that see that was my point. It's Pipe Creek has 1:02:41 been Pipe Creek for ever. Okay. Why would they have not put on this deed and 1:02:48 abstract a legal document used a legal term as Pike Creek as the boundary line and it doesn't say that. 1:02:57 It says the creek. It may not have had a name at that time. Oh, 60 years ago. 1:03:03 This been pipe cre 60 years ago. I try. 1:03:08 Well, it's been pipe cream for a long time. 1:03:13 60 years ago. It had name cuz it went through. 1:03:17 Well, yeah. On her plat there in the 40s. So, where you going to send him to? 1:03:25 Uh, you got to get a leg description. 1:03:30 That's not a priority. And you guys gave me at least three more things to do today before you want something. 1:03:37 I I would pursue. Do you already have them here? 1:03:42 I do not. They told me to come talk to you guys first. So you need to see the law. 1:03:48 I know him to find his 5 acres. He lost 5 acres. 25% of what what's supposed to be there. 1:03:57 How we could do anything about it. I don't know. We we we can't we could find Pipe Creek, but that's not going to solve the far as acreage went. 1:04:09 Yeah, necessarily. And we don't know if we can find Pipe Creek. 1:04:16 I I would go with the total acreage argument that they gained 5 acres on the other side. For what reason? What? How 1:04:24 did they especially if it sold whatever acreage it was? If it has 1:04:31 changed hands and stayed that same acreage until this guy comes along five transactions later and boom, we gained 5 acres. 1:04:42 Just that last transition to go 5 acres more should be a legal. 1:04:47 And this was there's only one transaction that's ever happened and it's this this one. Now, it sounds like you're going to have to get a lawyer involved and take it to 1:04:55 court. Now, nothing that we're going to decide is going to change that guy's mind on the other side of the creek from you. 1:05:05 Can you can you tell me who you would have to notify on the if you was going to go in there 1:05:12 and take the logs out the other side that need to come out now? Who would you who would you have to notify? Would you have to notify me or would you have to 1:05:20 notify them? Because on that one that I just that she run copies off on, I have seen that before where the line the 1:05:28 creek all belongs to me. The line is just on the other side of the creek. 1:05:33 I've seen that several times. Now what all that is about, I don't have no idea. 1:05:40 Still says 20.01 acres and I've got 15.23 is what they're saying. 1:05:47 We need to find out where my creek changed 1:05:54 from the old creek old channel to the new channel. 1:05:57 I tried to go back there the other day when it when we got all the rain to show you exactly how the water run around there, but I was too late. I I had to 1:06:06 wait through some Army Army Corps may have records. The Army Corps may have been who changed the creek. And where are they located? Where? 1:06:15 Louisville, Kentucky. How terrific. 1:06:20 I think you could probably Google it and get a phone number to call and talk to somebody. Okay. 1:06:25 But they would been the ones that would have changed move the ditch more likely. Okay. 1:06:32 Um the the description may be in the books. 1:06:39 We got 43 books that go back. But finding that definitely that's a 1:06:46 you like I say it it, you know, amazes me that nothing could change. I mean with State Road 18 and 800 West and then it 1:06:56 used to be Leo Presser was our next door neighbor and now it's Ken Jones. Ly Jook owned it. But even Mitch Cook when he 1:07:03 come down and dipped the creek out for me, I helped him out for a couple days down there. He said, "Donn". He said, "It shows your property line over on the 1:07:11 other side of the creek." I said, "Show me." Well, he never did produce it, but that's what he told me. 1:07:18 Yeah. I I I've looked for for this and I was not able to find anything definite 1:07:25 to prove where Fight Creek was. I we have section cards that I've looked in for this. 1:07:32 Like I say, I'm not like I say, it wasn't I don't think it was called Pipe Creek. That little node back there, it was just a Neither one can support all 1:07:40 the water. Took both of them and then when they dredge the creek out, that little one disappeared. 1:07:49 So, uh, Army Corps Engineer Louisville, 1:07:56 Kentucky. Yeah, if you Google it, you'll get a phone number. 1:08:02 There very well might be a branch in India. 1:08:06 But good luck. 1:08:12 You need the rest of those. 1:08:31 property. 1:08:31 Yeah, I can't find anything. Yeah, I know. The name of you. Maybe that's why I put two T's. 1:08:40 She got it. 1:08:45 There's only one T. 1:08:51 two different You guys ready to go on? 1:09:00 Any comments from the public? 1:09:20 My name is Max Millsworth. Thank you for letting us present our wershed for the Lumbbo wershed. A little background on 1:09:27 our group and the land owners. Uh Harold Harvey and his sons. Uh they stalled pipe at Indianapolis had moved dirt all 1:09:34 around Indianapolis. Ron New House, Ron Kates, and Dave Bettney all have ditch machines and excavators along with 1:09:41 Middlesouth Farms with excavators. And we we know how to put in tile. We know how to move dirt. Uh this group has a 1:09:48 lot of experience in tiling and between them uh we probably have around 8,000 acres of pattern tile ditching. So we're 1:09:57 familiar with the pattern tiles and the system ditching and so that you understand the depth of experience of this group which made it easier for our 1:10:04 group when we start meeting. Uh this group only had two meetings with all the farm land owners and uh Doug and Kenny 1:10:13 also attended the meetings too. we had them come and uh we had 100% commitment and pledges of all farm ground owners. 1:10:22 So that that's Kenny always said that's the hardest battle is getting the money or moving the trees out of the way. We got both them have taken care of. Don't 1:10:30 have a lot of trees to move but uh we will have some we stick it in there. um uh with Doug's help and we designed the 1:10:38 ditch and then uh talked about submains and stone that's all covered. Uh some of the grade is at 1.25, some grade is at 1:10:47 1.5, some grades at at 110th. Uh with enough cover to make everything go. Uh Steve Miller has met and talked to the 1:10:56 land owners. Uh dug holes and shot grade with the lasers, not with just LAR, but with the laser itself, and find found a 1:11:04 lot of tiles. Um I think he even worked with Gordon on your ditch, didn't he? Steve Miller. Yeah. 1:11:11 So he's he's a trusted uh one I paid in, you know. 1:11:17 Yeah. Yeah. Uh the ditch has a coefficient uh of uh 1/2 in west of 13 1:11:24 and east of 13. On the north it's got a coefficient of 3/8 and on the east side of 13. Uh the south the south drain has 1:11:33 a coefficient of of/ in. So 3/4 of this wershed has a coefficient of of a/ in. 1:11:40 Uh here's the problem. When we get to the um east of 13 on the south hole, um 1:11:47 the highway's got a 24 in uh tile going under it and that that puts us back to 1:11:53 3/8 coefficient. Um so that that is a problem to get to 1/2 1:12:02 in coefficient, which we would all like to get there. Like to get even more than a/in coefficient. Um, 1:12:10 right now, uh, we have 137 year old tile, bad shape. Uh, I would imagine I 1:12:18 could run about the same amount of water through an 8 in tile as we're running right now. And we're draining 580 acres 1:12:26 or so in it. We don't have much. uh we'll run uh estimated 100 times more 1:12:33 water. Even if we have to give up a little coefficient at the highway, we would run 100 times more water we're 1:12:40 running now. And if you think about the coefficient um of a 16th of an inch of water that it 1:12:47 would drain in 24 hours, you know, plus what we could get now. Um 1:12:55 you know, that that that to me is is worth pursuing. Um what we'd like to do is 1:13:03 get this pass. We we've got the top company. 1:13:08 um they've been holding out with our price and they're not going to hold out a lot longer and we talked about 1:13:15 privatizing this ditch and if we if we go with the whole project right now 1:13:23 in two to 3 years I can get all 22 houses with pretty new tile, get all the farm ground with new tile and reach 1:13:32 everybody that's put money in this this thing. And we haven't talked to the houses yet, but I will talk to the 1:13:39 houses. But, uh, if we keep worrying about getting this thing to 13 and get it 1:13:48 under 13 at a half inch coefficient, then it might be three or four years before um, we get we get all the houses hooked up. 1:13:58 I got a question right there. 1:14:00 Have you talked to anybody at the highway department to see if they're going to do anything to that road in the future? 1:14:07 That works. That is in the works. Okay. 1:14:10 Okay. So, so say in four or five years if they replace that road, you could get your 1/2 in coefficient then, right? Maybe. 1:14:19 Yes. Okay. 1:14:21 Kind of brings up a problem. We're coming to highway with a 36 and we go under the highway and we drop into a 24. 1:14:29 Now, if you think about it, the 24 that's draining won't have any pressure on it at that point. So, it might even run more water than what we've even figured. 1:14:39 It might I don't know. I've not been inside a tile very often, but I think it'll run more water. And but if we run 1:14:47 a 30 up to the east side and then we run a 30 on the other or 36 on the other side, then 1:14:56 we would be putting it through a 24in hole of the highway. So I don't know if we but there's other options, too. Um we 1:15:03 got two tiles crossing the highway and we could actually take some of the water off one side and put on the other side. 1:15:12 And we've also got a kind of a unique thing, too. The 24's got a manhole uh on on the east side of the highway. And if 1:15:21 it would come a big range like it did last week, uh it will spew out, go through a viuct of the highway and run 1:15:29 into the 36 and not even be on top of the ground then, which is not ideal, but it it it would be on all concrete all the way. just would be inside of a tile. 1:15:41 And so it's not ideal by any means, but what I'm thinking is that we need to get going or otherwise we're going to lose 1:15:48 our price on our tile and Steve Miller bid this for a summer job and we've only got about another month left before he'll be he'll be busy. Now we got a lot 1:15:58 of other guys that can do this, but we haven't had any business. He's not late work. So, what I'm wanting you to do is to privatize this tile so I know you're 1:16:06 on my side and then we can change this as we go. What I'm thinking is we start digging and we start heading towards the 1:16:14 highway and Doug calls me and says, "Hey, the highway is going to meet us over here. I don't mind stopping the project and give it some of my money to 1:16:23 put a bigger hole under the highway, but I don't want to wait two or three or four years on the highway to decide what 1:16:31 they're doing and we lose lots of money and and these 22 houses don't have the drainage. So, I want the project to 1:16:39 start and then we'll work with you and work with Raymond and work with Pam Macho. Um, we we'll work with everybody. 1:16:47 This this is not etched in stone, but I need you to privatize this tile. I can't collect any money. I can't call somebody 1:16:55 and collect money. I got it all promised, but I can't call them unless it's privatized. 1:17:01 So, I I got to have this thing privatized so I could get my job done. 1:17:05 We can tell Springfield we're on board and then we'll tell Springfield. The only thing we'll do different is we may buy bigger tile instead of what we've 1:17:14 ordered. And I don't think they'd have a problem with that either. 1:17:19 So that's that's what I'm here to ask you to privatize this tile so we can get this going. If if you don't privatize 1:17:28 it, I can't do anything. Price goes up 30 40,000. And then if you think about it, even with my age or the age of the 1:17:36 people that's given the money, once once somebody is uh passes, then we're in an 1:17:43 estate and can't grab the money. Uh we could build this thing tomorrow if we get it privatized. 1:17:51 that that's what I'm asking you to privatize this ditch today so we can make this thing go and everything's coaster and then we'll still work with 1:18:00 everybody to get what we need and I'm and I'm willing to give up but right now Mark and I have all the ground on the 1:18:09 3/8 coefficient that's 100 times better than what we got now 1:18:16 so I'm just asking you to give a little bit on that and we will get it to 1/2 in coefficient if at all possible and the highway will 1:18:24 work with this and the money to me is not the problem. Time is the problem. 1:18:30 Have you talked to 408 or Yeah, Doug's got some calls in and and won't you speak to that? I I talked with 1:18:38 the county highway yesterday and they got in contact with the state highway department and the gentleman that's in charge of doing this. From the way I 1:18:47 understood it, he's already put it in the works to start analyzing and engineering what needs to be done to go across that with the bigger tile. 1:18:54 Yeah. And that's good. And we we will get that. I just need we need to start digging and it and I think what'll happen is uh Steve will get partway 1:19:02 across and then he's got other commitments and this project may stop for 3 months until he gets other commitment done. So as long as we got 1:19:11 the grade right going to the highway and we can we'll get the grade right. Uh we'll come in a little bit under so we can do a 36 out of the highway and we 1:19:19 want a 36 out of the highway. I just don't want to be waiting on time. 1:19:26 If you privatize this, then when the project's all done, what do you do? Turn it back over to the range board or what? 1:19:34 Oh, yeah. Yeah. Like you did one of the other tiles you talked about. Uh the thing about keeping this thing going and 1:19:43 the way the money's coming in, we we don't have a a a brand new ditch to every one of these farm owners. That was my goal to get one to everybody's farm. 1:19:51 Uh Glenn Tinkle, we're a little bit of ways. Charlie Weaver, we're a little bit of ways. But there's another tributary 1:19:59 of this ditch that in one year from now, if if we don't stop if we stop the 1:20:06 project and make it bigger, it may take three or four years. But if let's just say we go with the with the the 24 in 1:20:13 all the way to uh to where we're going um next year we'll come back and do the 1:20:20 Pennington streak and pick up the 10 houses on NOS and get them all in good shape. So I could get I can get all 22 1:20:28 houses. Uh if we stop at 13 right now we're only picking up one house. 1:20:34 If we go on down to uh Kathy Thompson's, we're probably picking up another 10 houses. And then next year we do the 1:20:42 Pennington stretch and I pick up another 10 houses. 1:20:46 And so the whole project could be completed in two to 3 years the way it's designed, but we we can make it go 1:20:54 longer and we're willing to. Uh Mark and I, we're the ones giving up a little bit of time on this, but if we know we're 1:21:01 going to get a bigger ditch out of the highway, it can be worth it in the long run. I'm just worried about the age of 1:21:08 all my land owners and even my age. Uh and I can't start collecting money until you privatize it. So, if we wait another 1:21:16 week and they raise the price of tile $30,000, then we're talking a lot of money for this tile, 30-in tile. They 1:21:23 don't give that stuff away. And uh I got a question. We can get this going. I got a question. Okay. 1:21:31 You're talking about going taking splitting this thing and going through two tiles. 1:21:37 Are you talking about the circle circle tile down there that goes across Lori? 1:21:48 That's no. No. Is this Ninth Street? Yeah. 1:21:51 There's another one that comes across North place. That's the one he's talking about. Taylor. And I think I think it may have a name. 1:21:59 We think on the map the Pennington tiles at the wrong spot. Taylor Creek, right? Yeah. It goes Taylor Creek. Yeah. 1:22:08 But my hands are tied until it's privatized cuz I can't collect any money. And all the land owners, we've 1:22:15 we've raised the price one time and most of them have said if if we raise again, they're done. It's it's it's a done 1:22:22 deal. Uh, we want this project to go. We We could move water together and we're not etched in stone on this 3/8 1:22:30 coefficient on our side, but I'm not going to have the highway department wait 4 years or something to dig under there. I know how slow some of them 1:22:38 things can be. I mean, we'll all be dead the time that thing gets under there. In some cases, they may Once I get a date, 1:22:46 the money to me is not the problem. It's the date. It's a time. Time is an essence for me right now. 1:22:53 I appreciate you guys doing this as a private deal, you know, and having your meetings and so if that's the best way the drainage 1:23:01 board participate in this thing, right? 1:23:05 You know, and and we're not we won't catch you out. We're going to work with you. But I just 1:23:13 think that you guys need Raymond or whatever county highway. 1:23:21 I just think that you get more action out of the state highway. I know they've changed politics 1:23:28 and we we will we want we want a 36 under the highway. You know, I think I think getting 1:23:35 but with but with some of my land owners, I'm thinking if we don't get something now and I I 1:23:43 could live with a 24 under the highway and get something versus one or two of them pass away and I understand then we got zero. 1:23:53 They've been that way for years. 1:23:55 But I got 22 houses that I can help out too. So, we're talking about helping out a lot of people here. 1:24:02 And that 24 under there that you're talking currently goes into a tile that's not 100% open. So, I mean, that's true. 1:24:11 Just by putting an open tile downstream from that crossing, you're relieving that crossing. Yeah. Except for extreme rain events. 1:24:19 Right now, we've got probably a 19in tile. They had different figures back in 1889. 1:24:27 You got a bunch of trees over right there. 13 and those are all nice trees. Oh, you're nice tree. 1:24:36 Huh? Got it. 1:24:37 So, we've got a 19 in or tile that we fix on our farm. Every year we fix two or three places and it's half full of 1:24:45 dirt, water running slow. It's probably running about the same as a brand new 8 in tile and it's draining 500 and some 1:24:52 acres. So, we got we got basically nothing. Now, are you talking about coefficient? That rain we just got will probably take 45 days to get down to the creek. 1:25:02 Well, I I drove around the the whed the other day and Yeah, it's pretty wet, wasn't it? 1:25:07 Well, I I was surprised at how how small amount of water was actually standing. 1:25:12 Well, if you think about you're draining it through bad tile right now, and it basically took it away. You're you're wanting to put in a 1:25:20 brand new open tile is going to do a better job than what you got sitting there. Even if even if you ran a new 12, it would be more than what you have with your eight capacity. 1:25:29 I'm not even sure the eight's even a screw wall I'm talking about. I mean, it's it's a single wall. 1:25:35 I expected to see water standing against the road and everything out there when I drove by there, but I I didn't see Well, probably the reason you didn't 1:25:42 we've got 1.5 grade from 100 to Eddie's place. And so once we got over a 2 in rain, we're not using the tile no more. 1:25:51 We're running on top of the ground. 1:25:52 Yeah. So basically when you talk about coefficients and bigger tile, how much water is going under the ground and how much water is going above the ground. 1:26:00 That's basically all we're talking about here. 1:26:02 And then you get elevation drops and yes inlets and holding the water back. 1:26:09 You understand exactly what it is variables in the situ. But we have enough grade that that's why there's not just ponds of water standing because we 1:26:17 have enough grade to kind of get it down to where there's just some ponds standing and our ground is not ponding. 1:26:23 We don't have any ponding areas in any of our fields that is like a lake. Right. I do. 1:26:28 So now Eddie Eddie's got some over there that's in trouble and we're going to relieve it some too. North of North of his barn. 1:26:37 Yeah. Going back in the middle of the section tries to go through the Pennington. 1:26:41 Yeah. And and I'm saying in a year's time with this thing collecting 20,000 a year, we will stick that in next year. 1:26:50 So depending on whether the highway would be a little efficient, and they might be. I don't know if the right people talk to them. 1:26:57 When we worked on the Simon's ditch down by 26 and 69, I think it was less than a year by the time we contacted them to the time they had it. 1:27:05 Yeah. And if we can if we can get a date like that, then Mark and I will be in favor of a bigger tile under the 1:27:13 highway. And it put us off a year. But a year's okay. I just don't I just don't know if this one to 5 years, you know, 1:27:22 and and I need it privatized today so I can start collecting money tomorrow. 1:27:28 What does that necessarily mean, privatize? What does that I think uh I mean I could make a motion 1:27:35 but uh we we just turn this over to the land owners to do the project to do the project. Project is complete. 1:27:43 I promise you I'm working with you. I'm not working against you. You know you're not after bad drainage. You're after we're all we're all here to move water. 1:27:52 Exactly. That's our point. 1:27:53 And we can move water together. That's what we can do. And so Raymond, from the get-go, you wanted to come on to look at this. 1:28:01 Yeah. I just just an observation of what cuz this is the first map that I've seen. 1:28:06 Yeah. We I I had a couple calls into you last week, but and I was going to meet a busy person and I knew I knew you was busy. I knew you didn't call me back and 1:28:14 that was fine. But we will still meet with you. That's not a problem either. Okay. 1:28:19 Uh I just need I can't collect any money until you privatize this thing. And and if I don't get the money collected pretty soon, I might even be deceased, 1:28:28 you know. I mean, I'm 75, so and and to be clear, Max, you're one the money out of the Lumbbo account to help pay for some. 1:28:36 Well, yeah, that's our money, too. 1:28:37 Yes. And that's so that's that's what you guys got to vote on to release money to tax the use. What's our 200,000 number? 1:28:46 Uh 80,750. I think brings in another 6,000 this fall. So done it. I even did it for a while. 1:28:53 I don't know. I got a question. 1:28:57 I So still some people what I hear what I'm hearing. Some people they're 1:29:04 not going to be for it if they go too big cuz it's going to cost more money. Well, am I right? 1:29:12 Well, we're talking time and money. The count brings in 20,000. You these people have already said they're not they're not going to raise it. If I call them 1:29:20 and said we raise it another $200 an acre, they're out. Yeah. 1:29:23 So, it's either going to go or not go. I mean, that's where we're at. 1:29:27 And Max does a good job raising the money because you you got a Okay. 1:29:31 Unbelievable. I when I raised my hand here four weeks ago, I really didn't think this project could go cuz I thought I can't how am I going to talk 1:29:39 18 people into letting $700,000 go out of their pocket right now? 1:29:44 Does that 700,000 include the money in the account? Yes. Okay. 700,000 per project. 1:29:51 So he's might get it might get bigger if we go under the highway. It'll get depend on who pays for under the highway and depends on the tile. 1:30:00 The state highway pays for under the highway. 1:30:01 If they'll pay for it, we're probably talking add 40,000 to it, which might take another year or two to get clear to the end. And the Pennington ditch would 1:30:10 be four years down the road. So we're just talking time cuz we're not raising it anymore. These people aren't going to raise it. I mean, they're out. 1:30:19 What the county what the state highway is going to say if you do this thing right and get with Fort Wayne Fort 1:30:27 Wayne's got to get the Indianapolis politics of this thing. They're going to say they're going to say, "Do you want a 1:30:34 fork or do you want to cut say you're only going to have it shut down for three or four? 1:30:40 If the state's doing it, we don't care how they do it." Now, we're down on assignments how they opened it, right? There was an open cut on the islands on State Road 26 and they paid for it. 1:30:49 They paid for it. 1:30:50 Okay. So on that, did they have a minimum? Did they I mean they set the grade to where they wanted it or they engineered it. 1:30:56 Yeah. So on your So somewhere we have to know or you have to know what grade you're going to hit. Yes. 1:31:04 If if we're going to pursue the highway cutting it, we're going to pursue the highway either way. Let their two engineers talk together. 1:31:11 Yeah. And that's where we got to get to. 1:31:13 We got a we got a a one 1.1 grade to to Taylor Creek and could even get more with a little dredging or brushing. 1:31:22 So, we could come in under it. 1:31:24 Well, we don't want to we don't want to go less than 10th grade. 1:31:27 Well, I understand that the gentleman we're dealing with is out of gas city off gas's location. Well, that'd be good. 1:31:35 We're getting better. 1:31:36 So, but what I need to do, I mean, I I can't collect any money until you privatize it. And once we once we start, I just got to know where the grades at. 1:31:45 And then we could stop at the highway and wait on them. I don't I don't mind waiting on them. I just I'm just don't I don't like 3 and 4 years down the road. 1:31:54 So, we're talking no project or a big project. 1:31:56 I don't I don't like the idea of the water coming out of the new tile to go underneath the highway to go back in the new tile. But 1:32:05 with with the tile downstream being poor efficiency at the moment, if that was 1:32:13 replaced from Taylor Creek up to State Road 13, the outlet is going to be extremely better and you're only going to have that 24 that is currently there overloaded on extreme rain. 1:32:25 So I I I would be in favor of go ahead and doing it and do it on change it on both sides and when the highway gets 1:32:32 there with the highway put the new connection in and do it at that time you still want to look at this before we 1:32:40 release it. I wouldn't mind it but I don't think it's necessary. Like he said they're all experienced or most of them are experienced tile people. They're 1:32:49 wanting the best result out of it. They know what they need to look at. They know where the pockets of water are. 1:32:55 If they do it wrong, they're the ones who are going to pay the consequences. 1:32:59 And we got other options, too. Even if we go across the highway with the existing 24 now, um we could come back 1:33:07 in four or five years and and and bore 20 under the highway and add to it. We can also go to the north ditch to relieve it. this and I don't know how 1:33:16 many ditches I'm familiar with that actually go from a 24 to a 36 and how much pressure would be relieved 1:33:24 in that tile to start with clear to the creek. So, and then if it's not relieved, it comes out the manhole and 1:33:31 goes under the highway through a culvert and everything's really on concrete all the way. I don't like that either, but it actually it's just not a tile. It's 1:33:40 just it may be something to give the state highway more urgency to get it rectified. Uh-huh. 1:33:45 I I once we get to 13 and get it all done, I don't really expect that tile to 1:33:52 to really relieve itself any, but it might. Uh I've been told that under the highway is a 24 in petrified tile, which 1:34:01 is smooth. What are they 4T long or something? 1:34:04 They can vary, I think. But that smooth core is going to run some water. I mean, if smooth core runs water fast, faster than clay or like tile, 1:34:15 there might be a little pressure right there, but since it's relieved on nails out of the highway, I think it'll just go. And so, except for an extreme range. 1:34:24 Yeah. My thoughts. 1:34:25 Well, if it's come over on top of the ground all the way anyway, it you won't even know that horizon's oozing out any. 1:34:32 It's going to be running under the highway. 1:34:33 What What are you going to propose? 213 a 30 36 36 all the way from Taylor Creek to 13. 1:34:44 Okay, that's not changing. That won't change any no matter what happens. That's not going to change. 1:34:48 That's not changing. It's just from when we get on the east side of the highway, we can we can pick up a couple 1:34:56 80s on a little bigger tile. So, if this all comes true, we come out of the 1:35:02 highway with a 30 and we go under a 36, drop down to a 30 and go over and pick 1:35:09 up a couple more 80s and get this thing way over a/2 in coefficient just like that. 1:35:15 We're spend you're all we're proven you're going to spend the money. 1:35:19 Yeah, we're not asking for any money. We want the money in our account, but uh I can't I can't just call somebody and ask them for 50,000 if it's not private. I 1:35:27 understand that. But I've heard a couple concerns. If you're going to go too big, not they're not going to be in favor of it. Is that true? 1:35:37 Well, he's got he he's addressed the concerns. You've already increased it from what you originally thought. Correct. 1:35:44 I think they're pretty well. Well, I talked to Ryan Cage yesterday. 1:35:50 I don't I don't think we've increased any tile sizes. 1:35:55 Go ahead and ask a question. Well, Ron's concern was that if you go again, I don't know what figures you're using, 1:36:04 if you're going to up it again, they won't be in favor of it. Up the money. Yeah. Not the tile size. 1:36:12 Well, yeah. I don't know about tile sizes. Okay. Okay. From from 13 for maybe 1,000 ft or 2,000 ft, we 1:36:21 would put a 30 in instead of a 24. Then it go right back to where we was at. So, it's just a short section to get the coefficient and move a little more water 1:36:30 under the highway, but that's that's in your 700,000. 1:36:34 The 30 in on the east side of the highway is not in our 700,000. But that's just time, too. Yeah. 1:36:42 Like I said, if we can get that under the highway and give it get us a date, then we could come to the highway and stop. And you long as we got a date and 1:36:51 we got some commitments from the highway, we're on board. And then the other thing they're all they're pushing up against is a limo quits click will not collect past this year, right? 1:37:01 Unless there's some money spent out of it. So, but you privatize today, we'll get the money out. 1:37:05 Well, and so that will give if they get so much money spent out of the account that'll get that that to collect next 1:37:12 year and get another 20,000 in the account, right? But but that that'll be tomorrow. We could start ordering tile 1:37:20 and they'll want payment on it and we can get stone coming and that count won't stop. But we just got to be able to to go and dig. 1:37:30 That's what we want. The only thing I got to run. Yeah. You want to talk? 1:37:36 Clarify clarify the conversation we had at that meeting the last meeting. The 1:37:42 talk was if we have to pay for boring the highway and upside the tile 1:37:49 in the vicinity of $150,000 could be 140 could be 160 1:37:56 and what I've always Gordon is I don't think our people are going to pay that 150. Now, if we can do it over 1:38:05 a period of time and delay the project, that's another thing. But I don't think we can go back and ask for money, more money. 1:38:14 Well, we've been told not to. I mean, okay. 1:38:16 Couple said they're done. I mean, if we if we raise again, they're walking. Okay. 1:38:21 Well, it's better to have a undersized and have a tile working. And it's we'll prove you. Well, you guys are going to prove what you do. 1:38:31 Yeah. that that puts a kink in it and they're relying on the state highway. Yeah. 1:38:38 Putting it in for free, which we don't know at the moment for certain. 1:38:42 Well, in the past, I didn't talk to that person directly. I don't know if that person has the authority to approve it. 1:38:52 We heard we'd heard that through some other people that they would take care of some. So, yeah, you're right. It just that's iffy. But also too, if we know we 1:39:01 have a date, like I said, I'm I'm more worried about time than the money. But the money is a problem, but the time is more of a problem. 1:39:12 Let tell you what, this thing, the state highway is ham. 1:39:21 Hell, you might as well go on the street and get somebody to talk State Highway. 1:39:25 Somebody's got to set and go to the state highway, know what's going on. 1:39:31 We are. We are. So, we're working through uh County Highway cuz they have the contacts for this. Um and so I think 1:39:39 Brand and I have both talked to the same person at County Highway and we're on a we've heard the same story. Mhm. 1:39:46 And um so I think it's optimistic that there is a chance that you how would you 1:39:53 word it? uh equipment past projects would say that they pay for it. I mean, 1:40:00 we've I've known the Davidsons that had one down across 22 was installed at no cost to them and then the Simmons that 1:40:07 was put in at no cost to the ditch. So, I I I would think, but I I can't swear what the state's going to do. 1:40:17 Well, the state may say, "Hey, you can cut the thing." Yeah. I you know 1:40:25 the right gun even if he says we can cut it and they don't pay for it there's still cost involved they want they want flowable fill all 1:40:33 the way to the top and you know it's not free but if it's free that's better yet but we might even entertain a not free 1:40:41 if we have a date and we can go um but I I just got to start collecting this money getting this going and this 1:40:48 thing's rolling and we can make it roll we can move water together and this will probably be your easiest project you've 1:40:55 ever worked on if you just uh let us go and we will confer with you. We'll we'll work with you. It's not like let us go 1:41:04 and heck with you guys. It's not that I don't know if we can vote on it since they're not on the agenda. 1:41:13 We can do anything we want. Yeah. Yeah. You got a quorum legally. You can vote on it. else we get. 1:41:19 Plus, I have a motion that we let them go. 1:41:23 J made a motion to let them proceed with our project. 1:41:28 I I'll second it. Then I got been moved and seconded. 1:41:32 Does that mean the go through the drainage board secretary or do the funds strictly theirs? 1:41:38 Say what? Are the funds going to be run through Mary and done or are they going to be there to Hey, if you guys would 1:41:46 run it through that account, that'd be great. I mean, they have to to get an account with their tax, right? 1:41:51 We can I can open an account and I can run it through and I'll have somebody with me to protect me. But if if you guys can run it through and we don't 1:42:00 have to decide that this minute, we can talk about it tomorrow. 1:42:03 Richard brought up a good point. If they run it through the drainage board, they don't pay taxes. You don't have to pay tax on the 10. Well, we don't pay taxes. 1:42:12 They quit charge that Ohio was first. We was second, but you know, that's good deal. However, they want to do it. 1:42:19 I want the project to go. Mhm. 1:42:22 And I hope that you guys can get together and make the project go cuz you need it. 1:42:29 Yeah. I think they would be better off for scrutinizing max wise and moneywise if it went through the drainage board. 1:42:36 Oh, that'd be great. in there record. Yeah, that'd be great. 1:42:40 Yeah, I'd just leave not be in charge of that. 1:42:44 Yeah. And a couple of us will watch, you know, when when uh say Steve turns in a bill or something, we'll scrutinize it, make sure it's kosher and Mary could pay 1:42:53 it. That that'd be great. Uh I just didn't know what was legal. I didn't know if you could This is kind of like not an assessment, but it is. 1:43:00 It's a landowner. This money up front. Okay. Landowner contribution. Yep. 1:43:06 Yeah. And I can get with Mary and we can send out the bills and and uh you know that'd be great. I love that. 1:43:13 So we have a motion. All in favor say I. I oppose. Same sign. Good luck. Thank you very much. 1:43:21 Whoa. Don't run off. 1:43:26 Taylor Creek to the Ninth Street Bridge. Third one to go in was a 30 or 36 Taylor Creek. 1:43:37 36 in Taylor Creek. Right. 1:43:40 You're one Taylor Creek clean north to say well there's a there's a little 1:43:48 tributary that's got some brush in it and then it's pretty clean clear to Noo. 1:43:53 Well, but but yeah, where we're going in we'll eventually we need to get with Howard County. Mhm. Taylor Creek's all 1:44:03 in Graham. Taylor Creek goes north of Converse into Pipe Creek and Pipe Creek goes into Miami County. So Kenny Taylor, 1:44:11 we talked about Taylor Creek last meeting and we're waiting on Raymond to come back and say, "Hey, this is what we need to dredge and don't dredge on." 1:44:18 What I'm saying is we need to let take bids on clean trailer creek on north. 1:44:29 But it's all in they're in Denny in Howard County. Okay. We got money in there. We got 300,000. 1:44:39 Well, we're not going to have that much. Yeah. Yeah. Anybody have anything else? 1:44:48 You're sure that county had done it? 1:44:51 I got a question gentleman coming to the You got a question on what? You got a question on on Herbs tile. The tile was broke down 1:45:01 draining very poorly. Went in and jetted it. I dug down to make a access point 1:45:09 and we're out of money. But there's still water standing there. It's not getting to the main tile outlet. needs 1:45:17 jetted and a riser still put on it, but I don't see any choice other than to jet it and put another put a riser where we 1:45:24 can access it. It's going to put it in the red. 1:45:28 Can't leave can't leave the holes open and how much? Probably a couple thousand. 1:45:35 I'm married and then agreement just 1:45:45 south Mary and Peterson. We've worked on it. I've got two laterals of the main ditch opened up did 1:45:53 require risers numerous times. We break it loose and go downream. We have to go downstream to break it loose to keep it 1:46:01 going. So, we do have those open up. 1:46:07 That's all of my comments. All my other It's below 4,000. We don't need to prove those, do we? 1:46:15 I just want to ask you. 1:46:18 I don't like spending the red money without you guys. Have anything else? 1:46:28 You don't know what you're doing. Richie, pardon? Yeah, Sid Richie. 1:46:33 And I'm coming to the board hoping that you will consider cleaning my ditch banks on a property that I own, 40 1:46:40 acres. It's on Dry Fork um on 400 West. 1:46:47 Like to have it cleared and maybe set up on a spray schedule. 1:46:53 Not been sprayed. You know, did you just buy the property? Yeah, I just bought it a few months ago. Okay. 1:47:00 So, the former owner didn't spray it. 1:47:03 Sorry. No, former owner didn't spray it. 1:47:06 No. No. It's all grew up. It's The shrubs are real bad. Uh several trees. 1:47:12 Uh you can't even see the ditch in several places. 1:47:15 It's um Any money on dry fork? 1:47:17 This is the first year for it to collect, I think. Why not? It's got $14,352 in it. It'll have 2,2700 at the end of the year. It disappeared. 1:47:25 Put on your list. Go check out. Good. You're on the list. Okay. 1:47:35 Any other business to be conducted today? Make a motion journal meeting. Do second. 1:47:43 All in favor say I. I same sign.
