And we'll go with a prayer and a pledge of allegiance. 0:13 Lord Jesus, we ask you come this day, bless us, nourish our bodies and our minds, and do the county's business. In your name we pray. Amen. [clears throat] 0:25 I pledge with allegiance to the flag of the United States of America and to the republic for which it stands, one nation under [clears throat] God, indivisible, 0:36 with liberty and justice for all. Moving on to approval of minutes. Need a motion. [snorts] 0:51 Uh, make a motion to approve the minutes from the July 28th meeting. Second. All in favor sign by saying I. I. 1:01 Opposed. Motion carries. Moving on to claims. The just read them all off camera one at a 1:14 time. No, read them all off. Yeah, do them all except for one right away. The Dewey Simmons von Hume I don't know how you 1:24 say it guys or something close enough $450 crane pond fund has $11,310.78 imi aggregates 40767 1:40 Black Creek the fund has $21,93624 in the fund IM aggregates for $446 $643. Little Black Creek Fund has $21,93624. Right away management for $1,52.88. 2:02 The Little Black Creek, the fund has $21,936.24. Rideway Management for $4,140. Weasel Creek. [laughter] The fund has 2:16 $152,88622. Tom's Escavating for $260 for Lil Black Creek. The fund has $21,936.24. Amazon [snorts] 2:33 capital services for $83.68. Office supplies. The fund has $184.25. Tom's Escavating [snorts] 2:46 for $1337. S's Ditch, the fund has $2,512. Extreme Excavating for $2,352. Little Black Creek, the fund has 3:01 $21,93624. Extreme Excavating for 2500. Little Black Creek fund has $21,93624. Bragg excavating for $4600. 3:18 You're going to have to help me out on that. Tim Zion Creek, the fund is $17,6867. And Bragg Exavated for $300. For Luger 3:31 Tile, the fund has $19,55162. question. Go ahead. The two for rightway management, were they extra besides what was in the contract? 3:47 The Little Black Creek was approved and the Katon was approved. The Weasel Creek was done out of Oh, it's out of county. Okay. 3:56 It was done in Wells County, I do believe. Uh Raymond, you asked me about a uh one of these that was labeled wrong. 4:05 Did it get fixed? Yes, the last one that tile is this little back creek with all the imi 4:16 got it credit done now or well done or extreme excavating still has $3,121 due to them from the bid that they gave 4:25 to start with. They're waiting to level the spoil to collect that. What was that number? 3121 4:33 is what they still own. Owed after Little Black Creek, Little Black Creek after all the expenses going to be 400 in the red 4:43 until fall collection. Fall collection is going to bring in around $3,000. So it'll be $2,600 in the black at the end of the year. 4:55 All right. It's going to be close cuz with [clears throat] the 3,000 still owed, it's going to be right at zero by the 5:06 end of the year. So, there's not going to be a whole lot of money to spend on a little Black Creek fund unless we spend next year's 5:13 money. [clears throat] Well, hopefully at least a band-aid on the problem. Yeah. Oh, yeah. That 5:20 was a bandaid. That's the first stretch upstream from 69. So, we're starting on that stretch of the ditch 5:28 to [clears throat] touch it that hasn't been touched for a while. I was going to say it was dredged way back when 5:37 Jack Green and Brankles have kept the fun pretty well dry working on two opposite ends, one on the bottom, one on the top end. And that was some of the 5:46 the spraying from right away was up on the top end on cattails up in Okay. Anything else? I need a motion. I'll make a motion to approve the claims 5:59 [snorts] read off. Second. All in favor signify by saying I. I. Opposed. Motion carries. 6:09 Uh, next claim is rideway management for $28,266. [clears throat] The Katon ditch the fund has $12,87847. 6:23 Move we pay this claim. Second. All in favor? Second by saying I. I. [clears throat] One abstension. 6:35 Moving on to old business. The long branch solar update. I've looked for the legal description for the tile portion. 6:45 Between looking for crane pond legal description. I found one yesterday that goes station to station. I have not determined the beginning point, ending 6:57 point. Hopefully, it's the correct one, but it's all flowing writing and very difficult to read. So 7:05 this both of them the long branch and the I in the books I'm finding now long branch they're calling the extension the Ballinger and I don't 7:18 know if there's two tile at the end of the long branch or if it's just the one with two names. Okay. But the Fs and the L's and the H 7:29 they all look alike and blend together. Yeah, Scott said he's volunteered to help [laughter] 7:40 [clears throat] that that's as far as an update on Long Branch. I'm still looking for that legal description to send to Arthur for the 7:48 tile portion south of the railroad. Okay, moving on to new business, the Elliot tile easement discussion. Yeah. So, um, one thing that's been 8:02 brought up and and another issue is e easements that are updated when tile are moved. And so, talking to Kyle [snorts] uh over the last couple months, Kyle 8:15 Pinger, uh there's been discussion about um when we move these tile ditches or put new tile ditches in, updating the easement so it's recorded. So when we're 8:27 all gone and sitting in this room, uh the the easement matches the tile. And the reason Elliot's on there is because that's what I was familiar with and 8:37 involved with. And so I [snorts] guess the question is for the board, does the board want to pursue that, you know, when we put a new tile in? um you know 8:47 having the land owners sign off that way the way kind of explain is we cannot as a board cannot move an easement from point A to point B on somebody's 8:56 property without their permission because you know when they bought that property or whatever you know that that was easement was there so you know I 9:03 think you'd have to and we need some guidance on we'd have to vacate the original one and and move to the new tile after the new tiles installed 9:12 and then [snorts] and then get it recorded but you'd have to have the land owner's permission to sign off on it so that it is recorded up in the office. 9:22 Whose job is to get the land owner to sign off? I would think it'd be whoever pursues it, you know? I I think it'd be one of 9:29 the things where they'd be probably not be us cuz it's our Well, I think it' be I think the way we would the way I envision it is for them 9:37 to have money out of the account to put the tile in, they got to have the the the paperwork signed off on. [snorts] 9:45 What? Then they signed off the fund. What you're saying? I think they're right. They don't know. Yeah. 9:50 So paid off. So paid down on the fund. The main the fund like on this instance, the Elliot would pay for the fund. The 9:55 Elliot fund would pay for the Elliot new uh legal description. Um you know, obviously on that one was put in in like 4 2014 15 16 time frame. 10:04 So we're going back if we do that one. But you know, from here on whether we're talking about the Lombo, whether we're talking about whatever. 10:12 Yeah. I'll probably draw something up to make it simplify it. Yeah. How do we how do we do that? 10:19 Well, I think um cuz I have a we're going to have to hire a surveyor to go out and survey it. 10:24 Yeah. You know, who' you mention last week? Wood Manzy. Yeah. 10:28 Wood [snorts] Manzy from Gas City has shown interest in doing it. And so the fund would I think I have envisioned as a fund would pay for it. I 10:35 think as a board we need to vote on it that we start pursuing that. Yeah. that way. Well, the old 10:43 the old easement, if if I had a tile breakdown in there, I come to the board, if you're using the old easement, I can get the tile fixed. 10:54 Correct. But [clears throat] see, now, you know, now we're telling them, you know, we talked about taking the old tile out. 11:00 New one over here. Yeah. But if you take the old tile out and move, put a new one in. I understand what you're saying. So 11:07 that's I guess I just want to bring up the easement too. Yeah, cuz you have to move the ement because you're moving the tile. You have 11:12 to move the easement. Um like you say, you got to get a matter of who's going to do it. Like the leg 11:19 [clears throat] tile is not laying where the easement says the tile. Yes. And you bet, you know, like like for instance on the LA, you know, I 11:27 assume the main thing would be solar panels out there. You know, I don't think the city's going to make it out that far, but but in [snorts] our 11:33 lifetime, but the main thing would be solar panels. with it. Uh cuz now we just have the old easement and like we ran into the him like where is it? Who 11:40 is it? And where's the new one in when that group's all gone? [snorts] You move east, you're moving closer to 11:48 people's buildings or Yes. possibly homesides. So I think the um 11:55 you retrospect going backwards after them or you just going to go forward? I would, you know, I'd probably do the Elliot 12:02 if we people. Do we do we know of any others that were moved? Low max. 12:08 Yeah, we need to do it too. Well, now you know that was just that was voted on back in [clears throat] 2006 or seven to do it too. 12:14 Well, we got the powers going to be around there forever. The power. Yeah. And so I I think I think what we got to do just like that right there. 12:24 When you come across one you think of, you got to write down or bring it up in a meeting. [snorts] But I was using the Elliot as an example to get started and 12:31 say, "Hey, I know this is one I'm familiar with." Well, that's the one first big one I know that we've done. 12:38 Yeah. I mean, did the Lowmax slaughter back comes to mind on me. where what was 12:44 spluttered back out by the uh cemetery where the the tile used to go across the property at an angle and you turned it and took it 90° on the edge of the 12:54 property which would have brought it into that gentleman's yard that it wasn't in his yard before. 13:00 So I guess what um how hard is it going to be to go back now you've already moved it with the homeowner? 13:06 Well I think I think some of them are going to be hard now that you know and then we may just have to eat it. I mean, it just 13:14 Yeah, I I don't I don't know. I don't I don't know. You know, we were we were involved in a couple that if the easement was moved when the tile was 13:22 moved, I think it would clean up a lot and and and uh future ones would be Lumbbo and Echelog 13:30 Circle would be two big ones. But but you know, it's you know, and so I I think the landowner today has the right to say no if we've already moved it, 13:38 right? You know, cuz you we moved it without that easement. I think that I think it's going to be one thing, but I think what 13:45 we need today is a motion and a vote on from the board to pursue the writing and and if this is the direction the board wants to go. 13:54 Motion a second. It's it's the alley I think about people still here know where it moved. That's and I [clears throat] think can't think 14:06 of anybody that would object because they're farmers and owners and they invested in it or somebody else buys a farm. 14:14 Yeah. And you they're invested in it and yes, I agree. So, but lowmax that's a different story because you got too many land owners 14:22 down there and they're not how would they say they their water doesn't go anywhere. [laughter] Quite [clears throat] truthful. If you 14:33 kept Lowmax's easement in their what their plats show as a drainage easement, as long as it stayed in that drainage easement, I 14:42 don't think they'd have much argument or I don't think they would have a footing for argument. [clears throat] That's a recorded easement. 14:48 Yeah, there already says it's an easement. So, I got a first and second. All in favor signify by saying I 14:59 opposed. Motion carries. So what we just we'll give it to lawyers and see what they got to do. Yeah. See what he'll draft up the form 15:08 to do it and then I'm not trying to be contrary who's paying for this. It'll come out come out of the ditch 15:14 funds comes out ditch fun for each individual time like so like we we go back to the elements. 15:21 Yeah. Right. Wood Many had said something when I talked to him about two different prices. one for an ongoing and another 15:32 for individual prices. I don't know if clarification on that for sure would be you just going to talk to him. [snorts] Is it me or 15:42 we don't have enough to keep him retained on going do we? I I don't know. I like the like the law let's go back to long branch for a 15:48 minute. You know, I think when you get that find that legal description, somebody's got to draw it up. Yeah. to say, "Hey, this is where it's 15:56 at." You know, to protect interest and protect tile that are out there instead of just saying, "Here, here's a legal description." So, I think that's between 16:07 I think that's you and him and you come back to the board and you want me to be good. 16:12 Yeah. Back to us. I don't get any idea what this is going to cost. I mean, it's got to be cheaper than iron 16:22 go farmers. Yeah, whatever. So, it needs to be done. It's got to be done. 16:30 We'll ask Mary to work with Kyle and then try to get something that so we can vote on in the next meeting about how [clears throat] how we're going to do it 16:39 and if we're going to go backwards or go forward. Yeah. 16:43 Okay. All right. Moving on to Little Creek. Carl Kits maintenance request. Little black. 16:50 Oh, Little Black, I'm sorry. fund has $21,936. It doesn't matter. [laughter] I'm reading what it says on the back. I 17:03 know that before Carl gets started, you guys have a p two pictures stapled together that 17:10 Carl is going to talk about. When Doug contacted me the other day and brought up about anything was needing done on anything that we had in the 17:21 northeastern part of the county and which we had just had there had been work done on Little Black Creek, but there is two more log jams right south 17:32 of the cemetery lane which is 550 north. And Raymond, he knows about it because he seen them when he was out there. He's talking about page two. The second 17:41 page is what he's on. Okay. and that was brought up and I said, "Well, we got two more log jams there 17:47 that would greatly help the water flow on Little Black Creek," which I know we don't have any funds now, but something to look forward down the [snorts] road 17:55 if we can get that on the books or whatever. And also on that same page, the Harry Kston County tile goes through that 18:05 farm, goes into Little Black Creek. I talked to Doug about that. It's overgrown on the top of the tile going into the ditch. And there's a couple 18:14 places more that I didn't fix this year that was blown out on that 18-in tile. I need a little help to fix it. My equipment that's it's kind of all 18:24 mangled up where people patched it. So, that was another one was mentioned. And then back on the first page on Big Black Creek, 18:34 I got a couple outlets from the last time I cleaned it out years ago that just gradually kept blowing back into the field. And I got two um outlets that 18:45 are blowed out right off State Road 5 on that first part of the upstream on Little Black or on Big Black Creek, excuse me. So, 18:57 so how how much does this bring in a year of maintenance? Let's talk about big black or little black. 19:03 Little black first so we can clear it. Um 5700 black 19:08 57. Yeah. And there is some talk um you know Carl and I talked about it. Uh there's about 19:15 four or five others out there that are on it that called and said, "Hey, would you be willing to carry a petition to raise it?" And so there is some nobody's 19:25 carried a petition yet, but there is some chatter or some talk in the background of it getting raised yet this year. 19:33 Not much. Roman said 5,700 a year. A dollar an acre. I say a dollar and an acre. 19:40 Dollar acre. And so we talked about, you know, among some private conversations, $10 an acre and $5 an acre. $10 an acre is not wellreceived and but 19:52 five five is has been discussed positively. Yeah. If you go from 5,000 a year to 25,000 big difference. 20:04 So I told her so on Lil you know told Carl come in and get your name in the hat on the list to get it cleaned up and go from there. So 20:11 and give petition to carry it. Yeah. You have to bring it back to us. Yeah. Of course you get that done they raise it. Yeah. 20:20 He talked he talked about Harry Kston. Um well that's got a big crap big black. Yeah. 20:27 You want the main black back to little black. Is that where is that where the Harry Kston outlets is where that brush pile is 20:37 or is it downstream further? Those two right south of Cemetery Lane where you guys went north on the last time right there in that bend. There's 20:45 one and there's two within within less than 50 yards of each other that are jamming up where that curves there. But where where does the hairy crevice 20:54 come? It comes in south on to the south on that creek. Okay. It actually the blue line doesn't 21:03 show where it actually goes into that field. That dark horizontal line where it goes in 21:08 it kind of before that big snake being on down there, you know, halfway across that field in that wood. That's somewhere in there is where it comes 21:16 into. I just wondering if Harry Ken money could clear out the brush pile. the brush pile. 21:27 Basically, it's just trees that have overgrown on it. And I'm sure it's not helping any. And right past into the edge of the field, there's a where it's 21:35 blowed out. And like I said, it's been patched by several people. And I don't know how bad it actually is. Trying to get down there and fix it. So So what 21:44 are you doing on Big Black Creek? That fund's got $175,75764 in it on Big Black Creek. It's got more 21:56 again. When I was talking to Carl, I called him and say, you know, I see you're on big black. If you'll come to the board, if you have anything needs to 22:04 be done on Big Black, come to the board and ask cuz there's money sitting in there. So on your picture that has um uh the just just the one writing is 22:15 where he's at on Big Black. And like you said, there's trees on there, there's wash outs, and it just, you know, there's money sitting in an account, and 22:23 the account is shut off. It's been shut off since 2015. But big black on this big black. 22:31 And how much is it of maintenance on what's acre? A dollar an acre [clears throat] brings in 32,800 a year. 22:41 That's not much an acre then either. Dollar an acre. Bless you. But there's, you know, the money is just 22:51 sitting there. So told him to come to come to the board so at least the board can if they want to initiate it. So Raymond or he can Carl can initiate it. 23:00 The board could direct Raymond if they wanted to to go out and look at it and you know use some of the money that's sitting there instead just sitting 23:08 there. Tree still grow. That fair? Yeah. I use a start again. Yeah. Yeah. You got to use uh uh about 44,000 45,000 before it start. 23:23 Do you want me to look at this with clear or cutting the brush on the whole distance or just doing these locations or 23:34 he wants to come out? We can go I can show him where it's at and whatever you feel we need to start with or whatever. So, 23:42 okay. I mean that cuz you had another spot you wanted to talk to me about the county tiles coming going off the east side of Black Creek. 23:51 You had mentioned about coming out after I got my weed cut. So yes. Yes. They're behind Dale Turner. Yep. 23:57 Yes. Nice thing about cutting all them trees off on one side then you can spread it and keep them maintained. 24:02 [snorts] You know, if you want to spend a chunk out to get the fund back going and versus doing a 24:11 couple of spots, we do the whole stretch and put it out for bids and take quotes on it versus doing a little here and a little 24:20 there. Well, you got that money. You're the first one here, so you get to choose. 24:24 I've been telling everybody I talked to up there, got something you want done on Big Black, let us know. Well, I was under or I had heard they was talking 24:32 about doing between 1,000 and 300 north, which is which it's already been bidded to do, which is part of what we farm along. So, 24:42 yeah. On that creek and then it goes from 300 north to 5. We farm all the way along Black Creek. So, um, so that's what we're what we need to 24:53 do if we're going to do it or I was just bringing up about those two warouts on their blowouts on the outlet. Yes, [clears throat] the trees are 25:03 there. And just to bring it to the open, do you know whether they're county tile or if they're private tile or the ones that 25:14 the two blown out ones are just private tile? But after the last time washed or if just over time is washed out from after the last time they cleaned Black 25:24 Creek out. So do they come off of your property or do they come off of somebody else's? They come off mine, my aunts. ones on my 25:29 amp and which we own the field together part of that field together. So generally the board to be bearer of of uh controversy whatever the board 25:40 generally won't pay for private tile fixing will pay for regulated tiles being fixed. We have worked on tile outlets before that came from other 25:49 people and discharged on another person instead of trying to get the fire person to pay for an outlet that's not even on them to keep the dirt out of the ditch. 25:59 I go look at it and report back to you as far as what it looks like. [laughter] My opinion, I know it's hard to do a lot 26:10 of they should take care of. Yes. They don't take care of it. We take care of them. We should build them, but I 26:17 don't know if we can do that. That's why I brought it up cuz I know Well, I just when he asked I just, you know, was on a ditch. So, I mentioned 26:25 that. So, yeah. [clears throat] So, the Harry Kon he brought up that's on the first page and and Brandon brought it up. Um whether since there's no money 26:35 in the little black creek, whether the Harry Ken tile or fund can help pay for it, help clean off top the tile or you say you got some blowouts on it 26:45 underneath there. Well, it just there's one right right edge of the field. And so we want to look at that while 26:52 you're out there, too. Yeah. I mean, we we've used tile fun to open an open ditch up so the tile would have an outlet. I mean, so I don't if 27:01 you guys are okay with that, I'm fine with that. Cutting apart a little Black Creek and spending Cravis Money to do it for the outlet to be in good shape. 27:11 Yeah, I guess I go look at it while you're out there. You come out and we'll go look at everything. 27:17 Take a watch. Huh? It might take a little bit. Yeah. So, [laughter] 27:21 thank you. All right. Thank you. Okay. Moving on to the Taylor Creek Steve Dersps 27:30 fund $332,5506. You guys got a sheet for that. [clears throat] You got the sheet? 27:45 Yeah. Uh Steve Durk is uh we're looking at doing some ditching on a lumbbo tile back here and just wanted to see if uh have somebody check out the Taylor Creek 27:55 to see if it's open and if it needs to be drenched or anything like that. So we brought this up a couple meetings ago um that where the lumbode drains 28:06 into this wooded area right here on your sheet. Um cleaning that up with the Taylor Creek money. And then while you're why there the equipment's there, 28:17 whether we can dredge any farther north and take any trees off going north to prevent log jams or to help them guys gain some depth on that mountain. When 28:26 we cleaned that 3 or four or five years ago, clean down to past Clausers, 28:41 the Phillies, ass Billies, [snorts] Squeak it, and almost to Ninth Street. And when you get to Ninth Street, from Ninth Street 28:53 on, Max Fast had cattle were running down through the creek and he lost a calf up there 29:00 and we went along with him and we quit there. We was out of money. In the meantime, [snorts] 29:11 up Patician sees the houses and all that. That whole ditch is a complicated deal, but it needs cleaned. 29:25 I don't know whether you're going to take one side or both sides. Going to take money to go from there. And then you get into to is it Howard 29:36 County? Miami. Miami County up there before you get to to 29:45 [snorts] Big Creek comes in. I break my break. Okay. But 29:57 [clears throat] you're going to [snorts] have to get Howard County to participate with us. Why? 30:04 Did the last couple three mile. down around from Ninth Street going to 18. There's a lot of trees down through 30:16 there and needs to be bid and somebody with a saw or something to cut. Make up your mind whether you want to cut both sides or they take beds. 30:32 You know, you only got a couple three guys that's got saws. So, we're going to have to send Raymond out there. Check us out. 30:39 Raymond's going to be busy. Yeah. Tell me you're going to be take take a lunch break. 30:43 All right. Busy. Now, one other thing I want to ask Raymond, you know, 31:00 they're fighting. They're Armstrong's pits. [snorts] They're at the Are you right? 31:06 Plowers. Okay. The plowers, old lady, stop them from going around behind his corn cribs and 31:14 coming back across the creek and going across 200 more than you. Now they quit spraying that and it's grown up. We've got to come back and clean that. You're 31:30 on Taylor Creek sale. Are you north of Main Street? Are you north of Main Street? South 31:36 of M. You're south a mile right on street. 200 Armstrong's Pits down there. 31:43 Right there on the southeast corner of that intersection. Yep. That's what he's talking. You know what he's talking about, 31:49 Raymond? I didn't stop anybody from spraying that. Well, I seen the right boy quit. Now she 31:57 come out there. It was a major deal. She got got after squeak, you know, because she walked that creek 32:10 and had a bird up in the tree [clears throat] and she didn't squeak took the tree out. Then that set a whirl. Okay. 32:21 The bird just moved over another tree. But anyway, I was somebody stopped him from coming around behind Clauser's blood. 32:37 Armstrong's pit. You just have to look at when you go out there. I think the main thing is to run. But Billy's is clean. 32:42 Billy's clean. Um I think the main thing is to keep trying to get this thing opened up or see if it needs opened up for Lumbbo 32:51 and then report back going north from point north. Well, they're want to come in with a 24 in 36 33:00 and go in go into Taylor Creek. Yeah. I'm not questioning they're going to have to have 33:06 is a clean one going north. It goes downhill once you get past Nice Creek going north. It goes downhill though. Go ahead. 33:17 And that creek's not flat. It goes downhill. But the reason we quit was was my spouse. Well, he run those cattle down through that creek. 33:27 Go ahead, Raymond. Did is the board in favor of spending Taylor Creek's money to clean that little tributary of Lumbo or that goes 33:37 up to Lumb? We vote on anything. I'll vote on it. Yeah. If we're going to spend money out of Taylor Creek on that little tree, 33:46 it causing a problem on Taylor Taylor Creek does clear it. There was a tree down there earlier that this year that Mitch took out that blown 33:57 into the Taylor Creek from that thicket. Taylor Creek goes clear to Creek. Yeah, we're we're talking about spending the fund out of 34:07 Taylor Creek to do this little tributary. Is a lumbbo lumbbo a tile or is it open tile? 34:18 And the outlet's on the right hand side of that thicket. There's an open channel in that thicket. I mean, we can vote on it now or we can, 34:27 you know, you go out there and then come back and say, "Hey, here's what needs done." 34:31 Yeah. What needs done? Here's And then this I can tell you what needs done. This section here off of where the 34:36 Lumbbo drains into is going to be this much. And [clears throat] you know, we vote on to vote vote in. I probably do that. 34:42 Yeah. That way we know exactly what we're voting on. Okay. 34:46 Wow. But that with Steve coming in that gets the process started, right? Initiating. I just that was Steve's goal. Just get the thing initiated. 34:53 Okay. All right. Moving on to the I got a question. How much is maintenance on for Taylor Creek? 35:01 Taylor Creek is $5 an acre, $50 a home. Uh it has um 332,000 in it and it shut off it shuts off at 261,000. The house is in $50. 35:17 So, it's almost 70,000 before it even kicks back on. Well, see, seem like we should spend the money to get kicked back on. 35:28 Brings in need to not just waste of time, but uh brings in $65,383 a year. 35:34 65 collect one year. Yeah. So, really does it shut off? Does that need to spend 300,000 get more than does that need to be 35:43 30,000 get two years? What do you say? Does it need to be lowered? Need to be lower. I think I think once 35:49 lower the rate if we're not if it's going to sit there. I don't want to sit there with a couple hundred,000 and not do something. 35:55 I agree. But I think I think well I guess I want you to come back with is how far north we're going to go to clean everything off. 36:04 Plus how far you going to have to go on that Lumbbo to make it right. I guess that thick here. 36:13 And so I guess I don't want to lower it until we talk about lower until we get the whole thing cleaned and dragged and sprayed and 36:20 working it two or three miles back down there to Armstrong's pit. Get that while we're at it. 36:28 You're going to look at that. Yeah. Okay. Moving on. I know what it is. 36:34 Moving on to the Potter Creek. Got water in there. Per Creek, Scott Rogers. Okay. Um, 36:53 last September we uh did an estimate for 4500 ft of 18in tile to replace an 18-in tile that runs uh like [clears throat] I said that's kind 37:08 of a complicated name. I I call it the highly branch of the of Drip Creek. I don't know what it really is. Um 37:18 anyway, it was approved and then uh I we're ready to to get started finally. And I called the other day and uh the tile 37:32 price had went up $3 a foot, which is about $10,000 for the project, a little bit over that. And I just didn't want to uh to do 37:43 something without you folks being aware of it. I didn't know if that was a deal breaker. You said it's 4500 ft. 37:52 Yeah. How much was the original when we approved that a year ago or whatever? 38:01 Right. What was the problem? Did they want to ship the tile that day that right away or what? 38:10 No, nothing was. We never got that far as far as shipping. Well, you was the one that was Why didn't you get a fret say, "Hey, I got 38:19 this job and this is how much tile we're going to need." Okay. When I get chance to get to it, 38:30 I'll get to it. But put me in there. Lock me in. That's a You can't. Huh? You've got to take delivery. You've got to pay for it and 38:40 take delivery. You got to take delivery then. Yes. [snorts] 38:44 And I just didn't see I I didn't think we would get to it till this summer. And it was dry when it was wet. 38:53 H It was dry when it was bit. Yeah. So just give a little history that I 39:02 just read through the minutes. This is back in um September I think. Yeah. September 9th meeting the 2025 and 39:08 you got to bid with $85,275 on it. Redmond and H&W ditching bid on it too. There was three bids. So um [clears throat] and so Scott got the bid 39:20 uh at that time. And [snorts] so it comes out 13. You say $3 a foot. Well, that was the other thing. It was it it's $3 a foot, but we uh we also 39:35 mark up our tile before we sell it. And so to make this taste a little bit better, I backed what I was going to make off. 39:47 So it came out to about $3 a foot instead of more than that. I I pulled.7 cents a foot off. Yeah. So we're talking $13,500. 39:57 All right. I just took three times 4500. Well, it's going it's like 10 10 or $11,000 because I've taken a little bit out of what I was going to make on it. 40:08 Just tell you price. What franco tell you? What did they tell me? 40:15 They tell you they wouldn't wouldn't that's that's common knowledge. They're not No. No. It's not that's not common 40:24 knowledge. You you get the wisdom and ruin hell. Well, they they won't move on any on the price, will they? 40:32 No. Well, and actually, you may not be that route. Actually, this was this is an ads bid. Okay. So, they won't they won't uh they 40:44 won't move on the price then. They'll d what's his name? Tweets are telephone guy that across that gym wooden. 40:59 You put a tile underneath 13, right? No, we went up 213. Went up to 13. Yes. 41:08 You didn't go under? No. Did the state put one under? Not to my knowledge. 41:14 So, what are you going to do now? Cut 13? No. Um, [clears throat] we're picking this up on the north side of 400 North 41:26 and um, that's still an 18in tile there. And so we were going we were going to pick it up at that point. It's an 18 going under the state 41:40 highway. Mhm. Now, here's one other thing. Um, I'm not sure. 42:00 I guess you guys want this back filled with stone, and I'm not really sure why. You guys are the customer, so whatever you say goes. 42:08 But over 20 years ago, uh, LICA 42:19 invited contractors, county surveyors, and the pipe manufacturers to a meeting so we would discuss 42:31 installation of big tile, large t large diameter tile. about half the county surveyor showed up. Grant County didn't, 42:41 but at that time with everyone there, we agreed that if we had uh contoured buckets on our machine and a contoured boot that fit the outside diameter of 42:55 that tile, um there would be no need for stone. now. And so that's the way we we proceeded for 20 years 43:09 and we've put in I think I figured it out there today 50 mi of dual wall pipe 15 in or bigger and um 43:21 on 18s we've never back filled with stone unless we're in a really deep cut. Um the the purpose at that time was, you 43:33 know, to provide support underneath that tile if you were laying it in a flat pouch to provide support for it. I guess what I'm getting at is it's it's 43:43 kind of ironic that we're $10,000 over on what I said we would be, but we'd spend about $10,000 putting stone on it that I'm not really sure why we would 43:54 unless you guys just want it. And I'm not trying to be difficult. If you want it, that's fine. What was the 85,000 44:03 275? Was that for stunt with stunt? Yes, at the time it was. Yes. [clears throat] Doug, do you have the other competing 44:12 bids? Just in the minutes, the Redmond was a 92,550 and H&W ditching was uh $88,875. 44:22 Those are all with stone. They all they all in a minute. I submitted a bid with and without,000. Okay. So, 44:29 and so his bid, Scott's bid was a difference of uh $9,000 with stone. 9,000 higher with stone. [snorts] 44:42 Say that again. Uh Scott's bid with the stone added $9,000 to Scott's bid. 44:51 So, it wasn't 85 85,200. was 9,000 higher. Is that what what you're saying? Okay. So, let me read these minutes. 45:00 Okay. Uh after discussion regarding the need for stones, Gordon Golf made a motion to 45:07 award the job to Scott Rogers with Stone for $85,275. Motion is second by Candy. Motion passes forward and none. So, Scott's the 45:18 current bid is $85,275 with stone. If you take the stone out, it's $76,275. They had those guys on those excavators 45:34 that D on the wheel when they put in that big tile, right? Some guys do. Yes. You guys never did. 45:44 We really [clears throat] never put When we have put in with an excavator, we just back fill the stone. When we put in 24s with our machine 45:55 right now, we put in with stone because our frame's not wide enough to get that contour bucket for the 24. But the 18, I mean, it's supported almost halfway 46:07 underneath. And [clears throat] you know, we can get it for stone. That's what we got to we got to stay at 46:13 it. I mean, you're saying because the price of tile went up, I've been in business for 40 years. If I'm doing a big job, I'm [snorts] If 46:24 I got to deliver that pipe to put it on the ground and reload it myself, that's what I do. I mean, you got to allow for that. 46:34 [clears throat] I mean, I laid a mile pipe at the cemetery on 26th Street. I I know. 46:40 I bought the bike when I got because I knew it was going to go up. Sat on the ground. Can you wait a second? What' you say? 46:50 What were you going to say? Chuck was talking. What did you say? Let him go. I think I said that 47:01 Scott puts a lot of tile in C 38 street over the Herz road. [snorts] I still think Fredco 47:15 and we want number one top. We don't want number two or three or whatever. But we let the bid on that and I say 47:27 talk to the head guy that fractal. Not hell. They don't even have a salesman around anymore. Used to I know. And that's a sore spot for me. 47:38 Well, I understand. Um [snorts] a lot of them fractal used to be big in this area. 47:45 Absolutely. They go these ditches with Fratco and then they got to use it number one and number two time. 47:54 But I [snorts] think I still think if you talk to head guy and tell him say, "Hey, this is what my problem is. I know you raised the price, 48:04 but I can try." They was telling me I was going to have to take this. [clears throat] 48:09 You know, maybe that was what supposed to do back then. Yeah. I mean, 48:17 we're putting these bids out [clears throat] or estimates out and at any given time we might have four or five of them and it's just awfully hard 48:28 to Now, I could have maybe bought the tile ahead, came to you guys and asked for the money, but I've never did that before. 48:38 So, and if it's if that's the way it's going to be, that's the way it will be from now on. Well, but right now I it's just never it's 48:46 never been a problem. The game's changing. See, I think I think this is a touchy subject. 48:52 I tell you what, Springfield's coming in here. They got a salesman in here and so forth. Use that against them. 49:01 You know, I I can't We're not going to fill a farmer. If you got money in here, that's up to you guys. I'm I'm saying [clears throat] 49:14 I can pull clear out of it. I don't care. No, I want you stay there. I'm not I'm not I want nothing against 49:20 God, nothing against fret. I'm just saying that yes, these are unprecedented times. I want you to stand there and let me 49:29 speak a minute and I think this is a touchy subject. This is just my personal opinion. And just like Scott says, you you bid on these jobs and whether it's 49:37 weather and you try to keep a job ahead of time, but I think to protect the protect the board in mind when I found out about this last 49:47 week, I a couple things come to mind to protect the board from opening this can of worms of contractors coming back and saying, "Hey, I need more money or those 49:57 trees were bigger or whatever." Um, I think it's one thing if it's different if it's longer footage or, you know, I hit a 12-in child, they need some more 50:04 wise. That's different. But, um, I I think in my personal opinion is we got a couple options. Um, we got I have three options. Call ADS, 50:15 say, "Guys, can you split? I mean, whatever. You're smart. You're a smart enough man. You've been in business." Second option is, will the land owners 50:22 help pay the difference that the ones that are benefiting from this personally? Yeah. 50:28 or should we rebid it, open it up for bids just to protect the board from, you know, why didn't Redmond get rebid on it or why didn't H&W why didn't them guys 50:41 come back and say I thought Scott went under 13. You didn't go under 13. You I didn't even go underneath 400 North. 50:53 That goes [clears throat] over 400. There's a creek over there behind the high farm that runs down that road. That's where you go into. 51:05 We came through that woodmancy woods. Well, that used to be a wolf farm up there. Okay. And we came through the woodmancy 51:13 woods and came up and [clears throat] with with a 20 wood man was a different deal. Uhuh. [clears throat] 51:19 Okay. But you asked where I'm hooked on at where I'm going to hook on. We came up through the woodmancy woods. Came across the farm to the north there and 51:32 into that corner of 13 and 400 north. And we hooked on right there at the highway on the west side of the highway. And now you're going to be on the east 51:43 side of the highway now. Yeah. Well, and I'm going to be like I say even north of 400 North. Morgans is going through Morgans, right? 51:51 It's going through Winger first and then Morgan. Yeah, there ain't much on Winger, is there? 51:59 Um, I don't know if it's 1,000 ft maybe. But do you see where I'm coming from? So, you're on both sides 13 then. When do you got to have an answer? 52:12 I mean, when are you going to be there? I would have been here by now if this hadn't come up. 52:17 You know, I get it. Um, and like I say, if we have to change way we're doing things, that's fine. But, uh, this is just a 52:33 I know that people do jobs and come in here and they've already spent they've already spent 52:39 had a salesman around. Yes. I'm I'm going I'll go along with you. I'm not I'm just saying. had a salesman 52:49 said, "Hey, I got this job or I'm bidding on this and I got this job." You know, they put that away anymore. 52:57 Nope. Or a new ball game. Scott, how do you want to handle it? Whatever works for you. 53:04 My opinion. I'm not trying to be hard to get along with at all. I know. And 53:09 Yeah. No, I No, I agree. I I think you'll stay right in there. I I think we ought to work it out one way or the other to protect you and protect the 53:17 board and protect the future from But but like I say, perhaps the board needs to think about, hey, when someone gets a a a [clears throat] bid, 53:29 maybe our job to think about. Maybe they need you come to us with a bid. You're Are you saying that maybe the 53:36 board ought to the contractor ought to be able to buy the tile and the board pay for it? I think that I think that is a very smart idea 53:45 and [clears throat] that's just a lot different than what you guys are used to hearing too. You know, it is but like Kenny said, it's part of 53:50 the time. I have a problem with that too because now we put that in there about you got to have this work done within a year, we 53:57 rebid it. Mhm. You know what I mean? So if you buy the tile and then somebody don't get it done 54:02 in a year, you know what I'm saying? The tile you want to belongs to the jobs up. What do the chances are of ads? I don't 54:10 know. I I'll just have to find out. So, here's what I would pre here's if if ADS and the land owners don't want to help pay privately. [snorts] I think we 54:20 ought to ref and and we can make that motion today. I think we can do one two two different things. We can make that motion 54:29 today. [clears throat] We don't need to do anything. He needs to go talk to land owners back and then they don't want to do it. 54:36 And if they don't want to do it, they It's not the land owner's place to play. They pay tax into the dream, right? 54:44 What I'm saying is they don't pay it into this. It's between Scott and Fraco. ADS. It's ads. 54:53 Well, whatever they call it. Well, you got you got Fraco and you got ADS and you got Springfield. ADS. 54:59 Uh, out of They're out of Brazil, Indiana. They've also got they own Fredco. Two Two different companies. 55:06 Two different companies. Two Two different companies. Well, who do you buy them both off of for it's kind like it's kind like John Deere and 55:12 KIH two different companies everybody makes a tractor. And the reason that one of the reasons I went with ADS was two reasons. One, I'm 55:22 not convinced that Fraco's quality is any better anymore than what ADS's is. Secondly, it's because the ads salesman at least comes around once a month. 55:33 I haven't bought Frackco for Where do you make ads tile at? Southern Indiana, Brazil is one place and Finley, Ohio is 55:41 another, but we have bought Fraco for years and years and years. And uh I haven't bought anything from 55:51 them for a year and I haven't even been contacted. Not supposed to work that way, is it? Right. You've been you've been 56:00 and so I guess what I'm saying is I was trying to go where I knew I would get representation in a situation like that. 56:07 Who whose tile was you using when you b this ads? ADS. 56:13 I don't know them. I go back to ADS and then and ask them to help in call Raymond. 56:21 Okay. And then we're going to try to work with you. Okay. 56:23 As fast as we can or the government. Well, it'll [snorts] be at least two weeks. Yeah. 56:30 Yeah, that's fine. Um, but while we're here, could you tell me about this the stone on this tile? What 56:41 What are we What's the objective of putting stone when I've already got the bottom taken care of to me? I just don't know that putting 56:51 stone on the top is worth I don't know if you're going to get $10,000 of value out of that. Yeah. But what I'm saying is we done 56:58 quoted it. I'm not worried about this one. We'll do it with this one. I'm saying what I'm saying is if we have to rebid 57:03 it, then they can rebone needs to be on it. I'm I'm a contractor. I put stone. Used to we used 4L gravel, but it's practically impossible to get 57:16 anymore. Well, I've always been, you know, taught or um preached at or whatever by by time we 57:24 use it. just it's just support. It's just it's just support. It supports it shapes it all the way around. And I I I agree with you. I think you can find 57:34 different contractors that believe differently and different companies that believe Mhm. differently. And it's just a you know, 57:41 we're putting this tile on for 100 years. Absolutely. I I get that. And so I think everybody's going to be 57:47 different [clears throat] and that's one thing we've talked very little about on the board is what is the standard? I guess that's what I'm saying. 57:54 You want to know the standard? Yeah. And I and I think that's still more discussion to come. Um and I don't think we're smart enough to 58:00 do that. We need input from the tile company. Just like on the Lumbbo tile, you know, we told Springfield that you know, you 58:07 got to come up with the Rex on it. Mhm. What tile you using out there on 38th Street 58:14 EDS or whatever it is? Yes. One Fredco. You don't use Fredco anymore? I haven't for a year. 58:24 [snorts] Uh, let me ask the board this. Um, if to speed this process up, if Scott goes to ADS and they don't move, 58:32 um, do we have to rebid? Well, that's what I'm asking. If if if Scott, let's say Scott calls ADS and ADS 58:40 says tomorrow, we're not going to move. Can he call Raymond and say, "Raymond, can you call these three that bid on it so that next meeting we can vote on it 58:50 and move this process along? Ask the three people that bid on it. What if they will rebend the project? Oh, 58:58 well, no. You'd have to send out to everybody. You going to send out to everybody. We're not trying 59:03 out business. Yeah. And I'm not trying you. I hope you understand. I've always tried to get along and do a 59:10 good job for you guys. It's not that. I've got a question. I've seen the 24s put in with the machine and it was I saw it and it came out like a almost sand. 59:28 You know what I mean? And it rolled right back in the top, you know, it didn't move my opinion. 59:40 So it makes a difference how the dirt comes out. I think in my opinion, but I'm not an engineer. I don't know. The stone deal was a lot of work. I'm not 59:52 sure if it's worth it, but it all depends on how you put it in. If you put it in the esavator, you're going to have big chunks. The machine 1:00:00 depend on the operator. Depending on the operator. Yeah. So, I don't know. I'm confused. So, we're leaving with Scott. He's going 1:00:12 to call ads, report back to you, and then we'll go from there first if we got to rebuild it. That's fine. 1:00:18 I'm sorry. That's fine. It happens. Yeah. 1:00:21 Uh but you know, I'll learn on the next one. I'm just not used to these prices moving around like this, you know, and 1:00:30 let him know what's going when you got to have place to store. Yeah, that's that's a lot of, you know, just like when do you store 1:00:37 that many feet of tile? Well, and and at that point, you guys own it. Uh-huh. 1:00:45 Are you going to buy insurance on it? Cuz mine's there for a year. Somebody steal it. Yeah. Or 1:00:52 some contractor goes out of business, then we have to move it to another location. But yes, we do have the highway department. We probably can 1:00:58 store Well, it's quantity. Oh, yeah. There it is. All right. Thank you. Thanks a lot, 1:01:05 guys. Moving on to other business. a little newbie of Back Creek received quotes. The fund has $17,644.76. 1:01:17 The first portion was awarded to McCain's for $22,743 [clears throat] on 42826. Uh, you want to read these books off? 1:01:32 Yes. Um, John's repair [snorts] was $26,24. Now, wait a second. 1:01:45 Which one's this one on this? John's repair. Oh, forget it. That's just it for section. Okay, forget 1:01:55 it. Uh, hang on one minute. Raymond, explain how you did this on because there's two um one price north of 22 and the other 1:02:03 price is for south of 22. state road. They're supposed to be added together to make a total. [snorts] 1:02:21 So like on John is that section one through three and then one's north and one south. Okay. That's what is that the way you 1:02:33 read that around? Yeah, that's the way I read it. I'm not [clears throat] sure what the section 1 2 3 and section 4 mean 1:02:42 to go. It's the paragraphs in the letter. First three paragraphs for north of 202 and oh paragraph is south of 2010. 1:02:55 Okay, we don't have a bullet. Okay, moving on to Bailey's Landscaping and Excavating for $74,784. That bid was received 831 or 26. 1:03:11 And then we have McCain Brothers for $48,137. That bid was took August 10th, 2026. And this 1:03:27 is Craig Nukem. It's a extreme excavation. Okay. Extreme. Their bid was $44,100. 1:03:36 Their bid was took August 3rd, 2026. John left here. Yeah. Wait. [cough] 1:04:08 My [clears throat] question on that would be expediency. How fast did you get there? You don't know what the section 1 2 3 1:04:24 and section four are. I think it's the paragraphs on the letter. Okay. The first three. Do you have a copy of a letter? 1:04:32 No. Give it back to me when you're done. At least you say Bailey. Yeah, it's right here. 1:04:46 Oh, okay. Okay. that way. I wonder why you broke that down. [laughter] 1:05:18 26. Everybody seen the same letter, right? Yes. You always 1:05:31 repair the yards and take care of the trees and dispose of the trees. Correct. Burn the trees. And this is clearcut. Everything's cut 1:05:40 clip clean on the upper radian side and to the top of the opposite bank and then 50 ft wide to the which is this 1:05:49 little movie there at 22. Can you um can you make it that uh I guess my concern is that like you say the 1:06:06 timeliness of of when John's repair can get there. Um cuz I'd like to see this thing get dredged this winter yet too with 1:06:16 uh let's see where we at here. John's repair has holl over by upland to do and then a couple little jobs. Uh m uh extreme [snorts] 1:06:29 that Craig Nukem they have big black creek to do and uh Leech prong a big prong of Baron Creek. 1:06:40 And they also have Taylor Branch of Monroe. It's a short brushing job and dredging. What's Mlan got? [clears throat] 1:06:52 McCain's got little newbie the brushing part through the trailer court and that's at the moment. What' you say? 1:07:06 We we've asked for a possible quote from him for dredging through there. [snorts] I guess what I was getting at was um if 1:07:23 we give it to John's and you call them and say, "Hey, the only way we're given it to you is if you're there in uh 2 months, 1:07:31 we changed the quote on." That's right. That's right. Cuz the letter said to be in a year. Yep. 1:07:38 you got to within a year. So, I think Mary added that in there. That's not what the letter is. So, I 1:07:53 don't know. Is that what the letter said, Andrew? Uh, yeah. August 11, 2027. August 11th, 2027. 1:08:02 We could be there within a month. Huh? We could be there with him on pretty easily. We're right across the street now. So 1:08:12 Oh, yeah. He's right across the street now. They're across the street now working on I agree. 1:08:18 Done probably close to half. More. You've done [snorts] more than half what I saw. You got you got through the trailer 1:08:28 court after we had the windtorm wires got knocked down on top of the trees and you're trying to do it telephone lines that don't go nowhere 1:08:37 still in the trees. Yeah. Drive across the road, you know, just to be 1:08:45 what I McCain's is there. But what I'm trying to justify is how do you how do you tell the taxpayer that you gave him almost twice, you know, $20,000 more 1:08:56 bid? But, you know, I my personal preference is McCain is there and let him keep on going, but I it's it's hard to justify 1:09:05 $20,000 Uh-huh. more. That's what I'm that's what I'm struggling with. Well, if we're able to dig the ditch and with the funds 1:09:15 that we have, we're removing 3 ft of 3 and 1/2 ft of dirt south of 22. It's going to relieve a mile worth of ditch where there has 1:09:26 been den. We weren't talking that yet, are we? No, not the dredging yet. Just the the urgency to get it done is what I was 1:09:36 saying. 3 and 1/2T 3 and 1/2 ft of dirt in a ditch holds back water for a long ways. Yeah, that's true. But I don't have the 1:09:46 money. So there So So there's going to be about $85,000 in this fund after McCain gets done on the east side of Main Street. 1:10:00 Okay, make sense. How about you got some money? We spent some money at the end of year. Uh, it's Paramount. 1:10:08 Yep. Around that. Paramount. I talked to them. They don't see an urgent the the sewer project. He doubts it's done in 6 months for us to 1:10:18 get in and do the brushing in Fairmont. So, we didn't see an urgency on that. And we went out and looked north of Fairmont on Back Creek. There wasn't any 1:10:28 obstruction other than trees growing on the banks. and they may slow it down when it's high water, but in a regular drain, [clears throat] it's not holding 1:10:38 back anything. So, I don't think an urgency of doing anything in at the moment. What you going to do? 1:10:45 [laughter and snorts] Need a motion. [snorts] Can we do anything but go with the low 1:11:01 bid without a legitimate reason why expediency would be the only one that I would 1:11:15 if they're not able to get there readily but they're both bit the same got to be done within a year. Yeah. It just so happens McCain's is 1:11:29 there doing a different project? Yeah. [clears throat] Do I need to get another machine? Hire 1:11:42 more help. All you do is get in trouble, right? I move that we uh award the project McCain Brothers for $48,137.50. 1:11:56 Second. All in favor sign by saying I I opposed. No. 1:12:07 I I agree in some sense but we got to figure Hey, all we can do is get dr. That's right. Well, now you can't I talked to learn 1:12:16 about that. He said it's up to us who we want to give that bid to. You don't necessarily have to give it to the local. 1:12:21 Well, but if if a land owner would come in Well, yeah. Right. Right. But I'm just saying we get we'll get chewed out. 1:12:28 Get sued. But but it's possible that uh we don't have to kick if we've had problem in the past with somebody doing 1:12:39 the job. We don't have to take the law. I think the guys done the job in the past right guys there. He can get it done. 1:12:49 Y he can get it done. He says he can. That's why I make a motion. I'm on the fence. All right, we need a motion to adjurnn. 1:13:00 Second. All in favor say I. Ajourn. You need to sign something. 1:13:26 do what they think so they're doing. They need a sample from behind them to back them up. But you can't, you know, like you said, 1:13:40 we can't just get a different life. It was for buying [laughter] 1:13:54 after not cheaper. Uh, she's in the office. I see.
