she's a new director of the 2:43 Maran public library and new as in about a handful of month tops right yeah well anyway 2:51 welcome to the job welcome City count all these people came out to hear you you know um the microphone is yours please 2:59 introduce yourself to the city tell us about your thoughts for the future of the library sure sure uh so my name is 3:07 Jamie pit and I was not expecting such a big crowd this 3:14 evening um but I'm happy to be here I'm happy to talk about the Marian Public Library more than myself um I've been in 3:23 libraries for 20 years um but I'd rather talk about the Maran Public Library and 3:30 what a gift it is to the community I would like to start um by thanking me and Morel for putting literacy at the 3:39 Forefront of this community and making it a priority because literacy is important 3:46 to our community and so Maran Council Maran common Council 3:54 thank you for the opportunity to speak with you today it is an honor to stand for you and discuss something that touches the very heart of our community 4:03 the Maran Public Library uh for many Americans their fondest memory involves a library 4:12 card think back to your childhood and maybe getting your own first library 4:18 card maybe checking out that first book um and what a special gift that 4:27 was the Maran Public Library has been a Cornerstone of our city it's been serving our community since 1884 that's 4:37 140 years that's that is really significant and the building has been at the corner 4:43 of six in Washington since 1902 and it was established with funds 4:51 from Andrew Carnegie with $50,000 but with the stipulation that the city 4:58 provided $5,000 per year and not only a financial 5:07 commitment but it was a commitment to ensuring that knowledge remained in accessible to all and so the original 5:16 building the original carneg building is now the Indiana history and genealogy genealogy center and it stands as a 5:24 testament to the library's Rich history and ongoing dedication to preserving our County our City's cultural 5:33 history and so as we expanded in 1991 and built the 5:40 new library we expanded to reflect the growing needs of the community and to provide a welcoming 5:48 space for everyone and so today I want to highlight the importance of fostering a 5:57 love for reading especially among our young patrons reading aloud to children whether they 6:04 are little or big can significantly enhance their engagement with stories it 6:11 helps them access storylines model fluency and expression and create a deeper connection with the stories by 6:20 choosing books that reflect their interests whether it's Sports whether it's books about trucks 6:29 whether it's books about artists or architecture or even animals the library makes reading an 6:37 exciting and personal experience so encouraging kids to explore new words and ideas while 6:46 reading can transform reading into a solitary experience into a world of 6:54 imagination and what better way to engage them than by getting them their own library card there's something 7:02 magical about browsing the library shelves and having a personal stake in checking out books it's an experience that not only 7:10 builds excitement but also instills a sense of ownership and responsibility enclosing the Marian Public Library is more than just a 7:18 repository of books it is a beacon of knowledge community and lifelong learning as we move forward let us 7:26 continue to support and celebrate this vital Institution ution ensuring it remains a place where curiosity thrives 7:34 and where every individual has the opportunity to explore and I know most of you are familiar with the quote by Gandhi which 7:43 says Be the Change you want to see in the world and so I'm asking the council 7:50 members and the community to be an example to get library cards to model reading to our children because 7:59 readers they become board of Aviation Commissioners met 13:00 August 1st the main focus of the meeting was the design and the placement of new fuel tanks and that includes estimate on 13:09 the piping and how the road may or may not need to be altered to accommodate the semi trctor trailer that refills the 13:17 tanks it's going to need to be bigger since we're getting bigger tanks and the flight Cadet program is going well students are getting time in the air and 13:26 in the classroom and I thank you any other council members councilwoman 13:35 deine um I was unable to attend the board of Works meeting yesterday but I had a synopsis sent to sent to me just so that we would have an update on what 13:43 happened um there was an a new sop presented by um by Chief Gilbert to the 13:52 board regarding um I think it was deadly force uh so that was was pretty interesting and I know they had good 13:59 discussion about it they also had the presentation from Jeff and uh Chuck from Transportation um doing their annual uh 14:07 review after OT is their review and they got a perfect score again um which is a good thing so that means that that 14:14 program's running well and doing everything that's expected of it for the for the grant money that that they give us so that's what they talked 14:24 about thank you so much any other council members with 14:32 reports okay all right so we're going to speaking city 16:12 Administration good evening uh city council this a honor again to be up here every two weeks to talk to you all I really appreciate it um first President 16:21 McKinley can I get on your screen 16:33 um I'm I'm I'm very honored about this we we've been uh as you know we started with developing the um Riverfront 16:40 District which would have been a couple months ago now um we also voted on the door District which would have been the same time and this is one of the things 16:48 that I had in mind to be able to do a uh major development down the area to attract um and retain talent to the city of Mayor and encourage further Economic 16:57 Development and in that Quest um came across a gentleman by the name of um Shelby Bowen who is uh he'll tell you 17:05 more of his story when up here he's a Marian native and um he specializes in projects like this of the sort so um as we've been working through this now 17:13 which is I guess we're probably approaching four or so months we've been putting this together and it's it's moved along at a a great Pace that I've 17:22 been happy with um and now here we are of the I guess we call it the river me the road and we go through this and uh 17:28 we can turned something that's uh one of my sayings has been turned uh blight into beautiful right so this area in downtown Mar that's been vacant and and 17:37 blighted for a countless amount of years now we have the chance to turn this into a beautiful uh destination if you will for the city of city of Maran and it's 17:45 something I don't take lightly actually I'm very excited about it to be able to um uh capitalize on what I believe is 17:53 our black elimination program as well as our clean City Marion and and wrapping up wrapping that up into this uh major development um one thing that I would 18:02 like to point out this is the first groundup new development of this magnitude in Maran and I've checked now for the last 13 years so we're doing 18:11 something you know that is we have the opportunity to do something that hasn't been done in Maran in over a decade so without further Ado I'll call up um uh 18:19 sh Shelby Bowen um rebar development and Mar Maran native welcome Shelby thank you Mr 18:28 President member of the council mayor you and your team for your hospitality really excited to be back home here in 18:35 Maran I was born and raised here graduated from Maran High School just a couple years ago um and as you if you saw the paper 18:45 in the press release in anticipation of having this opportunity for you all to consider this project it talked about 18:52 kind of this dream or vision and when the mayor and I met earlier this year I noticed right away that he and I shared a passion for trying to move Maran 19:01 forward so what could we do individually and working together and all of our resources to try to accomplish something 19:09 uh here in the city we both love and grew up in and I'll say I have some history here with this project I've 19:16 shared this with others but uh the name River Rock Lofts have actually had for the better part of I think around 10 19:23 years and if you were to go down Adam Street today where it tees into the river you would see this really out ofpl 19:30 Boulder that's sitting there and that's me I put that there about 10 years ago that's the river rock and it's been 19:38 there since we applied for stellar and I've had a dream that this was an important initiative Downtown 19:45 Development and then since that time uh we've been fortunate enough as a firm to deliver a lot of really cool projects 19:53 that have been that first domino in new development in communities that are ready to invest in that growth so I'd 20:01 love the opportunity to present this project to you and ask for your support uh we're an experienced team I've completed uh about 10 projects total 20:11 throughout Central Indiana a lot that we're all proud of the closest one I think is in Yorktown it's called the Oliver and the mayor and his team uh 20:20 have visited and have seen our work it's a really beautiful class a project uh there and we've got others in Central 20:27 Indiana of course I invite anybody who wants to tour our projects or talk to our partners our architect team and 20:34 design team and and all of our project partner partners are highly accomplished a lot of successful projects and so I'm 20:42 really fortunate to have that group when the mayor took office and the count started working with the council 20:51 to set out that Vision or refine that Vision I think we've all known uh certainly you all have I've been following along that they is an 20:59 opportunity to improve the current environment here downtown and across the city and when I saw some of the initiatives that the council was taking 21:08 and I met the mayor and we talked about our desire to see growth and movement and progress I was really inspired through some of those initiatives that 21:16 relate to things that I think our firm is good at and we have invested in in other communities and you see those kind of set out we pulled some of the 21:24 language from both when you set out to create the district and Dora and other initiatives in your early 21:32 planning and then of course you know the district that you all have created here downtown and then now of course the 21:39 project site which the city over the years has Acquired and demolished and uh I think is an incredibly fantastic 21:47 opportunity the asset of the river is extraordinary the proximity to downtown I think is awesome especially with some 21:56 of the projects that have already happened in last uh several years and so for us this is uh really an awesome spot 22:05 for us to try to do something special go ahead and Mir one more here is the proposed site plan there's a a 22:13 little bit of uh there's a power line and a gas easan and of course mcclures and I know the McClure family and we talked about this and being neighbors 22:21 but there are some things there and what we've been able to do is really set out a site plan that takes full advantage of this 22:29 parcel uh working around some of our neighbors and the easements in place what I love about this project proposal 22:37 in the site plan is all of the apartments are facing the river that there are none facing what is that South 22:45 I have the directions correct there I think so and so this is really maximizing I mean it's just such an extraordinary place because I try to 22:52 design projects I have a little more local knowledge here but I think where would I want to live and what would I like see out my window and on my balcony 23:01 and I just love the way this is laid out you can see we're proposing kind of a shared public private Plaza I just think there's a 23:09 cool opportunity to enhance Adam Street I mean we're just right there and so making that connection more walkable 23:16 bike friendly uh and then creating kind of a plaza that we that that anchors this downtown project as you kind of 23:24 think about hitting the Riverwalk or the plans that you all have to the East this just could be a really cool kind of U 23:32 public uh Plaza area this is kind of the first four proposed plan with a little bit of 23:40 commercial space on Adams there's a lot of folks already in Maran that are working hard for their businesses to succeed and we're not looking to compete 23:48 uh with those folks we want all high tide to raise All Ships so we've been mindful of adding some commercial space 23:55 cuz I think we could succeed here it' be a cool place to have a small business or a small restaurant um but not too much 24:03 where we overwhelm our neighbors we want to we want to add to What's Happening Here not make it harder for other folks and so we've tried to reach that balance 24:11 here and it's close to parking and street parking and I think be a great spot for commercial use upper floors this is a four-story 24:20 building we're just trying to make the most to the site and the views and it will have an elevator and uh you can see all the apartments here it's 44 24:29 apartments and about 3,000 square ft of commercial space the renderings which I'm very 24:37 proud and I would encourage you all who are can I'm sure have already researched rebar development as go ahead Mary you can go 24:45 to the next slides I am really proud of the fact that if you went and visited our completed projects and I put the 24:52 rendering next to it we've uh at least or most cases exceeded the expectation because I know the initial thought is H 25:01 this is pretty shiny uh you know of course great presentation but we have executed projects to back up high 25:08 quality materials great outdoor streetscaping public spaces big balconies great views it'll be a mix of materials 25:17 between cast stone brick and Hardy PL panel uh all of the finishes exterior 25:23 and interior are high quality considered class say one of the things we're proud of is regardless of the community where 25:32 we invest and and build projects these finishes are topnotch so we don't go oh it's only 44 units and it's in over here 25:41 and it's not in you know this city so maybe we can just not have as good of finishes I think the mayor can support 25:48 the fact that we use the best quality materials and finishes these will be wonderful apartments for people 25:56 live project facts of course you know about our investment 10.8 million commercial space uh one bedroom one bath 26:04 and two-bedroom two bath Apartments common areas and then in this building despite the fact that it's only 44 units we will have an amenity room right on 26:13 the Plaza we'll have gas grills for our residents to use fire pits uh and so um but that's with the amount of renters 26:21 who have pets it's an important amenity indoor bike storage of course proximity to all the great things that are already here 26:31 project highlights again I pulled a lot of this from your you know your plans your goals for downtown and your goals for development and what I can say 26:40 consistently having completed enough of these projects to see the outcomes is this is not um you know this is real 26:47 stuff this is kind of a domino now does it does it change the world just one project certainly not but it's an 26:54 important kind of domino towards those goals and it does matter and if you talk to employers that visit Maran I can assure you they're going to want to see 27:03 the river rock LS as a potential place for their employees and the folks they recruit that they they may want to live 27:10 and so I believe strongly in these highlights as the mayor said you know 27:17 we've been able to move quickly because we have a shared Vision you all have been prudent with your financial resources you've got a good team in 27:25 place so we have confidence in our partner ship with the city of Marian so we we're requesting that you approve the 27:32 project agreement and then we'll need and I know your counil would if he is not already advised you there's a due 27:39 diligence period so we agreed to this agreement but we still have a lot of work to do on rebar side to complete our 27:46 plans investigate further the site and so before your commitment is in place you'll be able to see that we've done 27:53 all of our due diligence we'll have our financing we'll put in our own equity and that's all a requirement before you all make any 28:01 commitment we could start construction probably more realistically the beginning of the year a lot of that's weather dependent but the goal is we'll 28:10 get started as soon as we can heading into next year and we hope to have folks living there by early spring of 28:20 26 I believe that's presentation I'm certainly open for questions and of course the project agreement outlines a request from us for your support so I'm 28:29 happy to answer any questions about the agreement or the project or personally or professionally yes sir hi could you 28:37 go back to the big the first one the big overview slide of the site plan yeah 28:44 please uh the map my question and I I'm try my eyes aren't good enough to see it from here 28:53 where is the old Frank's piston where does that property fall in there leases it and I didn't know if the city was planning to incorporate that 29:22 into it and deal with it's about halfway through the lease if I remember what I remember and I didn't know if that was going to be incorporated and what the 29:30 city planed um that's a bigger Vision but not part of this project we trying to figure out how to buy it okay 29:40 thank um what what is your your like your one bedroom two bed what kind of a price range are you looking at the one bed one bath will start at around 1,300 29:49 a month and the twoed two bath will start out around 1,700 a month and up some of it depend on what floor and your 29:56 view um and the size of those units showby how much um are you relying 30:08 on there being a uh decent winter because you know we could have one of those winners where it snows every day 30:15 and talk to us about what what that's going to mean one way or the other yeah great question so where where we have 30:22 the current planning is is to straddle the fence on that meaning the site work can happen during the winter so we hope to get started and we've got some 30:30 flexibility in the size of the project is that we could actually get it enclosed and nearly finish by the end of 30:37 the 25 going into the next winter when the building would be covered and heated and we can be finishing the interior of 30:45 the unit so marring some anomaly shouldn't affect our construction timeline thank 30:53 you any other council members counc for ice I appreciate great thank you I 31:01 appreciate your investment thank you in the city of Maran and and taking place especially downtown as the mayor said 31:07 we' needed it and he's implemented it I think it's fantastic I appreciate it very much thank you um and I know that 31:15 we're going to help with part of that project on the infrastructure and stuff like that yes sir and then you're going to do a 3.5 million Tiff Bond on that um 31:25 I take it that Baron stormberg is writing the bonds for you correct yes who's your trustee on the bonds who do 31:32 you all use so you'll get to select the trustee normally financial institution 31:42 usually use a financial institution like a bank okay you just don't have a pick that yet okay that's only questions I 31:51 have apprciate it very much yes sir councilman incline yeah this is just if Drew clich used to be charge of the 32:00 Indiana fiscal policy and retired Economist and I just remember him preaching that if you want to improve 32:07 your town you want to improve your city something you've got to give people a reason to move there you got to give 32:15 people a reason to live there and in my book from what I've heard if there's something hidden I've missed it but in 32:22 my book this sounds like something that fits what Drew clich would say so thank you yeah Drew clich spoke at Indiana 32:29 Wesley about 10 years ago and he said if you weren't investing in your community you were just managing the decline and 32:37 that really stuck with me really I mean that that was that's why I totally recognized Drew cl's name and his vision 32:45 for trying to inspire communities to continue to grow Council woman 32:52 Divine as far as figuring up the rents per month um a couple questions with that did that include utilities remind 33:00 me some utilities are included water and sewer and trash and then uh the residents will pay their own electric 33:07 bill and our internet is included but in addition to rent and that'll probably be $60 a month there's no equipment rental 33:14 there's no contract you move in you get your internet Wi-Fi password when you move out you turn it off it's pretty slick and it cost less than the other 33:23 providers hopefully nobody from Comcast or AT&T is here we we we beat them on 33:29 price and product okay um and then how does how do those rent prices compared to the other units you've done like in 33:38 Yorktown and and similar um communities yeah that's a good question because what's interesting about this kind of product especially when it's new now 33:47 Mike H stead's project at Ridley Tower is kind of proven that there's another tier of rent renters and rent prices 33:54 here in Maran and what we have found is it's some times hard to judge that you can achieve that level of rents because the people who maybe would pay those are 34:02 living elsewhere in a project like the one in Yorktown I know we have people that work in Maran that live there and these are comparable with Yorktown the 34:11 two bedrooms here are a little bit less than the ones we currently have priced in Yorktown and we were pre-leased in Yorktown there's 26 Apartments there 34:19 that we leased before we were done with construction and we've had a waiting list the last two years then that was the other part was um how how quickly 34:28 you expect to hit 100% occup well can never I mean it's real estate and there's risk and as we sit here today I 34:35 have zero tenants and willing to make the investment you know in Maran but we've been fortunate in that the product we've delivered we've leased up to 100% 34:44 in all of our commercial and residential within the first six months and that's all projects across the 34:53 board councilman Bronner real quickly Shelby have you thought about about uh any type of 35:02 um communication with the Grant County family YMC about how they might want to get involved with their proximity yeah 35:10 100% because we typically would have Fitness in our building some form of that but there are just so many not just 35:18 the Riverwalk but the YMCA is it's really almost going to be a part probably of our sales package if you will is try to create some partnership 35:27 with the local YMCA thank you any other council why 37:29 this showed up on your agenda um um trusty Kan sent this information 37:37 to me and I you know I had been living my family had always lived on Lincoln Boulevard my whole life and only thing I've ever known was of this Cemetery was 37:46 to be a mess I I mean I just thought it was a that's all I thought it was was just a 37:53 mess I've never seen it in any other condition in my 31 years of life and i' I'm not lived on that street for 27 of 37:59 my 30 31 years of life so um when she presented this to me with the with the possibility that there was a pathway or 38:07 Avenue for us to be to do something about that I wanted to begin the the process and you know doing whatever we could to be able to come towards a 38:15 resolution um so now so here we are um before you today is a request for from 38:21 is a request for money um to be able to uh begin that process and and take care of that c and I won't um again like I said the 38:30 first time I won't steal truste Kane Thunder I'll let her uh do the presentation more in more detail I just 38:36 wanted to say that our give the reason behind this and kind of give my history knowing of what that cetar look like in 38:44 addition to our uh our our intentionality and addressing black throughout the city this has been 38:53 one of those sores that has been there so long you just think it's naturally you think there's no other option but for it to look that way um and I do 39:01 believe that um again you know another saying I've been adding to My slogan M slogan bag is you know marrying deserves 39:09 nice things and want to thank the council for P for the passing the ordinance onto the second reading public 39:38 hearing as I'm speaking once again pictures will be scrolling through these are not the same pictures from the last 39:47 hearing but they were just taken within the last three to six days they break my 39:55 heart I hope that you will hear what what the community is saying in their communication to the council through email or by being here in the chambers 40:04 in person Mr for I question my knowledge that the cemetery was not in the city limits but rather in the county I had 40:12 already confirmed that through the tax documents that it was but I went to the expert Randy Miller who was a surveyor 40:20 that provided the documents to create the boundaries for the city of Marin which includes the cemetery he is here 40:27 tonight to answer any questions you may have I've also asked him to complete another updated survey for my records to 40:35 have the exact division of County City along with the boundary lines of the cemetery however more than three qus of 40:44 The 100 acres are in the city limits I also have a written response from code enforcement regarding their 40:51 responsibilities and their ability to take the additional workload stating that the size of the cemetery would 40:58 require daily upkeep our office does not have the Manpower or additional time to M maintain such a large area Mr fosnight 41:08 is here to answer any questions you may have of him I had scheduled a video conference with the Attorney General's 41:16 office Aaron Tuttle legislative director Thomas brigh real estate litigation section 41:23 chief who put any complaints on the on a fast file with the attorney general Todd Rita office they also cited State 41:33 statutes we spoke of in the first reading in which the township has statutory right to move forward with correcting the situation in multiple 41:41 ways and provided guidance to the steps that can be taken I have since received two decisions on 41:48 complaints and the letter States it since it appears that your office May in a better position to assist in this 41:55 matter we are referring it to your attention please review this complaint and if needed investigate further we 42:04 request that you please let our office know the outcome of any investigation so we may update our records 42:11 accordingly I have unanimous approval for my Township Board to pursue funding to continue pursuit of ensuring the 42:19 cemetery can be taken care of in the manner that three 36,000 plus persons buried on the ground and the thousands 42:26 of amilies affected by the current deplorable conditions deserve and I desire to 42:33 provide I am in legal proceedings and cannot release confidential information regarding where I am in the 42:41 process however I would like to update to the council that the previous administratively dissolved Corporation 42:49 by the Secretary of State in June of 2023 failed to file the notice of change of governing person 42:57 dated December 16 2021 to transfer the president title for the Maring Cemetery 43:05 Corporation from Neil Jeffrey to his brother Brian Jeffrey that was not officially filed by the secretary of the 43:13 Maring Corporation Craig Persinger three years ago my understanding that has now been submitted as of July 29 the 43:22 community now has two named board members rather than just a secretary of state mandated dat dissolved Corporation 43:31 for not filing Financial reports since 2018 I currently take care of two 43:39 cemeteries located in my Township and Mr President if you could show those pictures 43:57 I believe it's these no not that one those are still 44:05 bad ones there we go that 44:16 one when I took office I quickly replaced the sad looking and falling apart wooden signs 44:25 with a beautiful galvanized steel signs and had my lawn service begin trimming 44:31 trees cutting shrubs and taking vegetation out of the cemetery and and 44:40 cutting them away from the T the headstones to protect them Brandon is here to answer any questions you may 44:47 have of my expectations of cemetery care but as you can tell I care about my 44:55 cemeteries I do not have funds in my budget which is based on taxes nor can I Levy any 45:04 additional taxes to take on this huge project that is why I've come before you to ask for help I'm also waiting for the 45:12 County Commissioners to respond to my ask for funding for the from the county if the community desires to communicate 45:20 their wishes and concerns to the Commissioners you can find their contact information on the Grant County website 45:27 under count offices without both entities assisting with this initial funding 45:34 request I'm not sure if I can pursue further as a community respond to my request for 45:42 support please contact the Commissioners the funds will be put in a nonreverting stipulated fund that will 45:50 be under an ordinance for the care of the cemetery only this fund will have monthly reports to financial government 45:58 and agencies and no cash transactions will be conducted only bank checks will be used for all 46:06 transactions the move forward will take time there's much to do along with the continuing negotiations so if you pass the 46:14 ordinance tonight I beg the community to understand they if they don't see changes immediately I am and I promise 46:23 to be constantly pushing forward to obtaining funding for Future Care and returning the cemetery back to the 46:30 pristine condition those buried there and their families deserve in honor and respect of the lives 46:42 lived Saturday a very discouraging and sad situation was brought to my 46:50 attention and I got approval from the family to release the name of David Kinsey 46:58 their family had their husband and father who was a Vietnam veteran exhumed from the cemetery as they just could not 47:06 accept the disrespectful disrespect shown to their F father for the lack of care provided to his grave site when he 47:16 was buried he's been buried there since 1977 please do not let the voices of the 47:24 past in the families go heard as one gentleman wrote in his letter to the council president I believe that every 47:33 generation should pay it forward to honor those who came before us that belief will always materialize 47:40 with unknown twists and turns but will always be worth any effort taken to keep our heritage alive for future 47:47 Generations listen to our voices and it said a thousand words a picture is a thousand words and as you're seeing 47:55 these pictures up here these pictures excuse 48:06 me these pictures broke my heart I could hardly sleep that 48:11 night I was out at the grave at the cemetery and I saw the burning embers of 48:21 a fire that was only 2 feet from a headstone then I saw a pile of nice 48:29 freshly piled dirt with tracks going between headstones so I walked over 48:39 there if you see as you see there are headstones buried I'm sorry there are headstones 48:47 buried and covered with rock and stone and dirt you can you can barely see the 48:56 Headstones and as the president Scrolls through those you can pick out where some of the headstones are barely 49:03 showing above the stones and the dirt in the 49:16 pile the last picture the last picture is the one that 49:24 says it all that one the father's 49:36 headstone had been knocked over by the tractor and just 49:43 laid if you do not support this ordinance and help me in the 49:53 township these situations are on your shoulders and not mine thank 50:00 [Applause] 50:11 you really appreciate that truste Kane um I was present at your um County council meeting and I 50:20 knew at that moment that you had a lot of investment into this so I appreciate that um was there anyone else that you 50:28 wanted to speak or okay fantastic so like to go ahead and just have a discussion maybe you be able to ask 50:36 questions um well we'll go to a public hearing as well so some of this might be public hearing but yes um we'll go and just 50:45 open up discussion be able to ask you questions if you don't mind I know vice president calgo would like to say a few things um I've been working on this 50:55 project with de uh since we started this and uh my sister's here she can attest to 51:02 this my mother and my father are both buried out there my grandparents are buried out there a number of ants for the most part most of my 51:12 family's buried there and I remember the days when I was a kid when that Cemetery looked like the other two that de has 51:19 now that Brandon does such a great job um but over the last 10 15 20 years whatever I I'm I'm I'm really big on 51:28 respect anybody knows me knows that and I don't think that there's a way that you can disrespect somebody more than 51:38 this I mean the family and U that had to Exum their father out of there and their husband 51:47 man somebody should even have never have to do that and then they spend good money to have it done because they love their family enough and he's a v Vietnam 51:57 I mean come on guys this you know there's what 35 36,000 headstones out there that's a lot of families that's 52:05 that it's like somebody doesn't care and and it's just I I can't stand 52:13 it anymore I can't I'd like to ask a little thing too anybody that's here for the cemetery tonight can you just raise 52:20 your hand I don't see how anybody can vote no on this I I truly 52:28 don't th this is uh I'm I'm disgusted by it all I'm tired 52:35 of we we have seen people we' seen couple of elderly ladies that was trying to get a push mow out of the back of an 52:44 SUV so they could take care of their daughter's gra we've seen that too many times I've took care of my family's grapes too many 52:52 times we talk about progress we talk about beautifying Marion and stuff well then we let's start here the place that 53:00 we should start and give our family the respect that they own you know I told that when we was out there one time we was at a point where you could see just 53:09 tons and tons of headstones as far as back and I told her I said you know now I want you to imagine every person that's in in their grave they're 53:17 standing beside their headstones look at that look at the history we got there look at the stories that their families 53:25 and their love ones and and we the the loved ones that are alive now that want to honor our family they deserve the 53:34 same respect too you know when you bury somebody you do it on on the hopes that 53:41 it's going to be taken care of and it's a big Cemetery out there it's huge but the way it looks it's it's it's 53:50 enough's enough and I encourage each one of my fellow counselman to let's let's do do 53:58 something thank you vice president calill um I do have couple questions um 54:07 trusty K I definitely think we need to be doing something about it and I support your efforts um mine's more of a technical 54:15 thing on the resolution or not the resol I'm sorry the ordinance Just the Way It Was Written I just want to make sure if 54:22 we were to approve this that um it's written properly in the ordinance 54:29 so um basically the ordinance to be frank with you it's just like there's it's very 54:38 brief um and it's not you actually and I might have the mayor hopefully answer or comment on this it just says 300,000 to 54:47 ioof cemetery so more of a technical thing like so if you if your office were to 54:55 take that over is it still legally called like these I don't know who can answer still legally called the ioof 55:03 cemetery um I just want to make sure with this how this is written I just want to make sure we don't get ourselves into an 55:13 issue and also I think you did comment on this would go into a rever um nonreverting 55:20 fund um my question and again maybe the mayor can answer this is if this were to be 55:27 approved would the money are you requesting the money to be transferred immediately or the city to hold the 55:34 money until you were to legally take possession if that does occur is that 55:41 what you're requesting yeah okay um it's not called the iwf now that's we've all known that for years it's the estate's 55:51 uh thank you everybody um so that is the the legal aim of it as far I would I would and if it's all right with the 55:58 mayor and everything I would even make a motion that if it is approved that it's 56:05 it's written that the money stays with the city the money stays with the controller's office until it would be conveyed to the 56:14 Township's office and then at that point when she is responsible that it could be transferred in now if we need like some type of allocation for an expense or 56:23 something then she would come in but other than that the money stays with the city they I don't think it should go to De 56:31 until it's completely done anyway right and now I appreciate you yeah that's what we talked about and 56:38 we also mentioned that to the mayor today when we had a phone call that that that would be our 56:44 desire um because I still have some litigations and I'm um to go through yeah and I understand you still have to 56:53 get through all that I just just without looking at anything the way it was I just wanted to make sure thank you for bringing that up if we were to pursue 57:01 and there's a consensus by the council to approve this that we will possibly need to make an amendment to make sure that's clarified in the language yes the 57:10 other thing so I you know what vice president Calo said about City holding on to it uh until there was a legal 57:20 takeover of the cemetery if that does occur um to to 57:27 also I don't know maybe add language to say um to amend it to show that the money is going to go to the center 57:35 Township Trustee because this says iof Cemetery right so technically whoever owns a states of serenity now are we 57:43 giving them the money right you know so it's a technical I know we're not I'm speaking to techn technicalities I spoke 57:51 with our Council earlier and this I'm just making sure that if we pass this we don't have to come back and fix it 57:59 because of the language on there so thank you it was more of a um rhetorical question I would say so make sure it 58:06 just says it would go to the center Township Trustee upon proof of acquisition for costs of acquisition and 58:15 ground maintenance yes does that sound right exactly perfect okay and then the other thing I would 58:23 propose like I don't know how long it's going to take you right and um and I hope you're successful um but then also 58:32 just making sure that there's a time limit on that at some point I mean we can't hold on to 300,000 forever 58:39 obviously and we hope it doesn't take forever for you for everybody in this room and all the families all the 60 emails I received that I 58:47 appreciate um but maybe attaching a time limit so if if we hit a time limit that money then has to get reappropriated 58:55 from the Council and then if then we can come back and and 59:08 reappropriate but maybe putting a trigger on that councilman CL stes 59:19 sorry it's sacred land has been desecrated I hear a lot of 59:26 what if and what and such as that and my daughter's gone turn around 59:33 um what about I'm throwing this to you Mr President tabling this so we get all these questions answered ironed out 59:43 written down in a document so we know precisely what we're voting on does it have a sunset where's the money go how 59:50 long does the money go there who canw down and when there's a lot of questions yeah yeah we can do this yeah we should 59:57 do this we need to know precisely what we're voting on go ahead Mr Klein if I don't know 1:00:06 this and then I can't move forward so I can't help you I can't help you get those answers if I don't know that I'm going to get 1:00:15 funding so the money will not be con will not be 1:00:21 given to me until the cemetery is acquired um it is put it'll be put in a 1:00:30 nonreverting fund just for Cemetery care I am required by State Statute to also report 1:00:38 to financial governing a agencies like State Board of account and dgf on a 1:00:46 monthly basis on every account and every fund that I have and that is that is a 1:00:53 record you guys that can be attained um and provided to the 1:01:00 city so I I appreciate um your comments on that I if I correct me if I'm wrong 1:01:07 trusty Kane but from what I'm hearing is that without any kind of 1:01:14 financial support basically you're going to be dead on arrival trying to acquire the cemetery am I correctly exactly so 1:01:22 if you're able to go to the powers that be that can help you acquire and say I have this sitting here ready to go that is going to help your cause am I correct 1:01:30 it is it's going to help my cause and um also upon acquisition of the cemetery in 1:01:37 the negotiating of the finances and the purchase after the acquisition I can also then go for grant 1:01:46 money I can I've already spoken with Community Foundation but no one can do anything without it under my umbrella if 1:01:56 we delay this then I'm going to lose opportunity for some significant Grant funds that are coming 1:02:04 up it's no different if let me kind of put this in simple terms if you're going to buy a house or buy a car you go to 1:02:11 the bank and you got to get preapproved before you can buy it that's exactly what this is we're asking for the pre-approval that we know that we're 1:02:19 approved that then we can move forward no different than that my my proposal is is 1:02:27 um you know I would like to take a vote on it today because if the majority of the council votes no then I don't want 1:02:34 to waste any more of her time but my proposal is when to propose an 1:02:41 amendment um that shows again that changes it to from iof Cemetery to the 1:02:48 center Township Trustee upon proof of acquisition costs and grounds maintenance maybe with a six-month hold on that it however legally our legal 1:02:57 team could write that up uh and even maybe go to as far as the mayor needs to sign off on each dispersement if um just 1:03:05 for that extra checks to make sure that everything is is going through um and then push it to a third reading 1:03:14 right so there are I do believe there are reasons for a third reading so that way if we do propose if we propose an amendment then we can come back to the 1:03:23 third reading and see the the newly typed um ordinance with that new language on there and then take a final 1:03:31 vote on that new language is that um I'm just looking for input from the rest of the Council on 1:03:40 that I agree councilman Forex I think that I got to agree with you and Mike with the 1:03:48 way the way that this appropri appropriation ordinance is written it is very vague and it and it's very specific 1:03:57 that that comes out of the general fund to the iof cemetery so I mean you either have to resubmit a new appropriation 1:04:05 ordinance with the specifications in it because this is the way this was advertised and you can't amend an advertised appropriation that's the way 1:04:13 it was advertised so that's the way it's supposed to be distributed so and then number one that's number one number two 1:04:21 I will stand corrected that a portion of that is in the city you're right I agree agree with you I stand corrected on that 1:04:28 I agree that it needs a lot of work I agree with that also and the third thing is it is a privately owned Corporation 1:04:36 and you don't have control of it I do not see us spending money out of the general fund budget to send to the 1:04:45 township trustees number one I don't believe that we can do that I have been told that you cannot take general fund 1:04:52 money out and fund another government entity so I I think that Mike's right and you're right there's a lot of legal 1:05:00 ifs in here and we can't we can't move forward with this appropriation the way it's written 1:05:07 without more specifications on it I agree that it needs work I've spoke with the owner he agrees it needs work and 1:05:15 needs help but it is as far as this appropriation ordinance and legal can help me on this Marty that the way that 1:05:25 this written the way that this was advertised we should not move forward on this it 1:05:33 can it can be amended without read vertising the advertising isn't uh necessary unless it was a rate change 1:05:40 ordinance and since that's not in play um we don't have to read advertise we just make uh a motion to adopt it with an 1:05:47 amendment as uh President McKinley has set for you're correct it does need to be cleaned up and as far as is that 1:05:56 taking the money out of the general fund I was told that we could not take money out of that general fund and and and send it to the Township Trustee since 1:06:05 it's a privately owned Corporation and there is an owner on this Corporation she does not have control of it so the 1:06:12 way that this ordinance writes or reads is that we're giving it to the I that's not true it's not true under State 1:06:18 Statute 223 cemeteries are totally different than anything else state statute 20234 1:06:25 2023 69 2023 68 2023 75 gives a a 1:06:33 Township that that Cemetery lies if that Township is or the cemetery is not being cared for and and done the way it's 1:06:40 supposed to be that she has every right to have 1:06:45 [Applause] 1:06:47 it well can I can I interject here real quick statute also 1:06:55 levia Township Cemetery tax to create a fund for maintenance of cemeteries under that 1:07:02 chapter correct and I'm just saying legally Legally we cannot should not move forward to this because she does 1:07:11 not have control of it once she gets control of it or receivership of it through the state then that's a 1:07:19 different story can can you buy a house and move into it before you pay for it that's a that's a whole different situation 1:07:26 you're buying out a private Corporation or trying to take over a private Corporation if you want to get 1:07:32 real hold on hold on a second hold on hold on order come on 1:07:38 guys guys listen I think we're going down the wrong path here okay we are not 1:07:45 giving money to the ioff cemetery we are not giving money to the center Township 1:07:52 Trustee unless she takes position of it so I hear what you're saying councilman pise what she does on the legal front is 1:08:02 on her and the trustees office what we're looking at and what I proposed for the amendment was to vote 1:08:10 on this amount contingent on the acquisition of the property so if she doesn't acquire 1:08:18 and that legal battle is not successful that money stays in the city general fund and it goes nowhere that is what 1:08:25 we're proposing so I just want to make sure that's what I'm proposing as the amendment so councilman Dave Kane you haven't spoken yet and and you are 1:08:34 exactly right Mr McKinley and I I believe councilman calill has an amendment ready to go where there's a 1:08:43 lot of arguing here for absolutely no reason absolutely no reason 1:08:51 now I know uh trustee Kane has worked on this 1:08:56 this so zo very hard um she's given her all into this and I appreciate every one 1:09:05 of you that's come out tonight I appre you Mrs Kenzie to was in rubbles shambles 1:11:55 um stuff everywhere and um was over there the other day I had to 1:12:03 attend a funeral actually so I walked around and there are these open window holes into the 1:12:10 masoleum and magically the maum's been cleaned up but it's still padlock shut so no one 1:12:18 can go in there and visit their loved ones it something needs to be done we 1:12:24 get phone calls all the time because PE the cemetery is in the township so they call the township trustees 1:12:32 office and our hands are tied we can't do anything we can't help those people great I appreciate it thank you 1:12:41 okay you're welcome uh at this time I'm G to go aad and open the public hearing um and just because I know there's less 1:12:48 that are not in favor if I could just ask those that are not in favor to come up first because I know there's uh a 1:12:55 couple of you and then um maybe have a couple speak that are in favor for the council here both sides and so I'll upon hours upon hours out 1:13:37 there the funding is a problem and if it's under the 1:13:43 city I could do a lot with that money other than that you know I have 1:13:52 retained legal counsel and any questions you have needs to be referred to him his name is David Phelps 1:14:01 which he has contacted your attorney here that you have on file 1:14:10 and that's where you need to go okay thank which I helped formed 25 years ago with Neil Jeffrey Brian's 1:15:27 brother who is the UN who invested significant personal capital of his at the time to acquire that uh Maring 1:15:34 Cemetery Corporation was administratively dissolved two years ago uh my friend Brian here um is incorrect when he says 1:15:44 he owns the cemetery he does not own the cemetery Maran Cemetery corporation owns the cemetery U I think truste I commend Deb 1:15:52 Caine I've been involved uh peripheral I don't represent anybody or anything I'm just here to provide a little history 1:15:59 and and hope that the council and interested people can benefit from whatever involvement I've had uh the I 1:16:08 commend Deb's efforts that the trustees involvement I think is long overdue there's under Indiana Law you can uh 1:16:16 have some sort of limited involvement where a Township Trustee supports maintenance efforts in a nonprofit corporation or up to the point where the 1:16:24 trustee can acquire the property in whole um now I I don't represent the corporation anymore I don't represent 1:16:32 Brian anymore I understand he's hired council is taking efforts uh but as of now or at least as 1:16:40 of a week ago the corporation is dissolved and a corporation that's dissolved has the ability to wind down its Affairs including concluding 1:16:48 negotiations paying claims for lost weight for overdue wages things of that sort 1:16:56 um but I think um there is an opportunity for a quick and negotiate this does not have to be a hostile 1:17:04 situation I think there's a Poss there's a good possibility that this could be included in fact if reasonable 1:17:11 Minds U Prevail here there should be a negotiated settlement here I understand the emotion but there's I also know what 1:17:20 Neil and and Brian have done there just has been no money to run that secretary for 30 years there is a Perpetual care 1:17:26 fund it's still it's turns out a princely 10 to 122,000 for maintenance which as you can 1:17:35 as you know would hardly do a week's worth of Maintenance there's maintenance needs and there's also Rehabilitation needs there's the 1:17:44 daily maintenance and the rehabilitation needs I don't know if Deb's obtained any price tags on that but it's got to be 1:17:50 enormous so um so I would I would I'm not here to give legal advice or I'm not here on behalf of any client or 1:17:59 individual I'm just here to try to let the counsel know some of my involvement over the years and to 1:18:07 encourage reasonable Minds Prevail and and and try to seek a negotiate settlement which will acknowledge the 1:18:13 trustees and and Deb's efforts here to uh to take a much larger role whether that's by acquisition or by some sort of 1:18:22 negotiated agreement it should be done that thank right thank you Mr Pinger I just want to remind before anyone else comes up here because I did 1:18:31 get um a lot of emails and I did give truste Kane permission to have my email out there not like it's private anyways but to put it out there so I have 1:18:39 received probably close to 60 emails a lot of them very good passionate emails and stories I just wanted to to just 1:18:46 clarify I there was quite a few emails I want to make sure people understand the city does not own this property I got 1:18:53 some emails saying that they approved or or supported us conveying it the city does not own this property the city is 1:19:01 not involved in any legal part of this uh we do not have Council involved in 1:19:08 this the city is just being asked provide funding contingent on trustees office which is separate from the city 1:19:15 of Marin um if she were to be successful but I just want that Clarity that the city in no way what whatsoever is part 1:19:23 of any legal litigation for the Takeover of this Cemetery or attempted takeover or however you want to describe it um 1:19:32 and we are not con we are not voting tonight to that 1:20:25 I understand the cost you have to make it happen you have Perpetual care and 1:20:32 you are disgracing every person out there 1:20:38 if I have so many people and my Cemetery looks like her trustee cemeteries that 1:20:46 say out of grief and out of anger I what if it was your parent out there well my 1:20:54 parent is where I work is your parent where you work well ma'am excuse me um correction David 1:23:09 keny is the man that adopted me Gary Wayne hovas was my father he was a 1:23:16 Vietnam veteran he came home from the war he died at the Trel Mill Dam in 1977 1:23:23 trying to save another man's life he was buried at iof where he shouldn't have 1:23:30 been he was buried next to a tree um that has grown ridiculous besides his grave I've been telling my mother for 1:23:38 years since I was probably 15 he's not resting it's always been a mess out there 1:23:45 um they would pull up decorations from other Graves and put them underneath the bushes that were by my dad's grave uh my 1:23:53 mom's been trying for years to have him move to the VA which she finally was able to get to 1:24:01 do um he was exhumed um almost two weeks ago my mom and I were there for the 1:24:09 whole process they were not supposed to break ground until the morning of so that my mom and I could be there when we went out there his grave was already dug 1:24:18 up and had been sitting there all night open and exposed there were no caution tapes there were no tents that were supposed to be there there was supposed 1:24:26 to be a tent that we paid for that was not there so when my mom and I go out there and see this you can imagine how we 1:24:34 felt um in addition to him not being the kindest man that I've ever met 1:24:42 um the tree roots I know aren't under his control had cracked the bottom of my dad's 1:24:49 Tombstone or his tomb which caused moisture to get in that tore up his 1:24:56 casket um he was cremated he is now going to go 1:25:05 to uh the ba I got to be part of that whole process um however he has gone 1:25:12 from there which makes me very happy my grandfather and my uncle are still there right beside where my dad was 1:25:19 buried he dug up my grandfather's headstone and it is thrown against a tree by the road still sitting there 1:25:27 almost two weeks later my uncle his headstone is missing you can walk out there right now and the only thing you 1:25:35 see is the tree and the tore up dirt and there are no headstones you would not know that my fa my my grandfather or my 1:25:43 uncle were still buried there and and for me to walk out there or for my mom to walk out there right now we would we wouldn't be able to 1:25:51 point pin pinpoint where they were buried because there are no headstones um I don't know why two weeks later that this has not been taken care of all 1:25:59 right ma'am your time is up so I appreciate Youk we get this man out of there okay guys I just ask that everyone 1:26:06 just please keep decorum in here um I understand there's a lot of emotion and I recognize that but we do need to keep 1:26:15 you know some respect in decorum I know there's a lot of opinions but for the sake of this council uh state of Serenity Cemetery uh my name is Robert mathas 9547 West Ali convers Grant 1:26:39 County uh I'm here tonight regarding the uh the cemetery it is uh it has been a family Cemetery for over 90 90 years for 1:26:48 us uh we have 25 uh members and four close friends there uh and six unused 1:26:55 grave plots maintenance and management has been a growing concern for many years for us the roads have been have 1:27:02 potholes trees have fallen mowers and possibly back holes that pushed Stones off the foundations and they haven't been reset 1:27:10 or repaired the signage and the grave lot markers are down or missing grass is 1:27:16 10 12 Ines tall or more uh many times during the summer we have mowed our 1:27:23 family area several times uh the beautiful M mum marble vaults have been vandalized and the stained glass windows 1:27:31 have been broken uh and I assume the last uh this last 1:27:39 caretaker or possibly the last one have worked with h a disadvantage of reduced funds that we have heard the previous 1:27:47 caretakers I think during the 80s had uh mismanaged funds uh the 1:27:54 two valuable cannons at the war memorial uh were sold and a large amount 1:28:01 of R iron fencing was sold for scrap price that my father was told and that's how I know this fact uh that was back 1:28:10 during that time of the 80s I believe um this Cemetery in the past has been a nice well chain well-maintained older 1:28:19 Cemetery especially under the i i management it has a lot of character with mature Trees and 1:28:28 Landscaping also many valuable artistic older Stones I have been told that some of the 1:28:36 his historical and famous people are buried there in conclusion we would like to see a federal or state Grant of some 1:28:45 sort or state or some type of funding with an oversight type management to return this potentially 1:28:53 beautiful C back to it once uh where it once was I thank you thank you for your time thank you one question is there 1:29:01 future expansion to the South between the dog cemetery and that wood is that you guys so you do have future just 1:29:10 thank you for your time thank you we'll invite the next person up don't want to 1:30:15 forget the past my father recently passed away in April I've lost my mother 1:30:22 my father pretty much much my my my side of the family are buried out there me 1:30:29 and my wife were out there Sunday and we try to go at one time when our kids were little we'd go and go to the old Penguin 1:30:37 Point get food put it in the truck and head out there and we'd make a day of it we'd mow 1:30:46 me and my wife and the kids would mow anywhere from 20 to 25 to 30 Graves family members 1:30:54 and we were there Sunday and I can't moow like that anymore you know and it's no disrespect 1:31:01 to him we have a relationship because my father just recently passed away and everything I've asked him with my father he took care of I understand he has his 1:31:10 hands completely full and he only has a few people working for him but this has gone on for way too long way too long 1:31:19 and like he said it it's total disrespect I mean that's all we have is respect to try to have respect for 1:31:26 people and our word I mean if you don't have that what do you have you know it's it's not right it's been going on we had 1:31:34 these cleanups out there every year they put on Facebook or whatever about clean up show up show up show up and then you do it and it goes right back to the way 1:31:43 it was before so I mean you're GNA do that you're just going over beating your your head in the wall you're not you're not doing getting anything 1:31:50 accomplished you can go out there constantly and find something and like I said I'm not beating him up but it's John mccaa whom by all historical accounts was very philanthropic to the Maran Community I want you to hear the voice 1:33:08 of jaywood Wilson whose wedding gift to his wife we now enjoy as the hostess house I hope you hear the voice of Martin Boots Chief Pioneer of Grant 1:33:16 County I want you to hear the voice of 21-year-old father Larry Goss who died in Vietnam leaving behind a daughter 1:33:24 whom now serves as a state representative I hope you hear the voices of those who are unknown due to double selling 1:33:32 plots and lack of recordkeeping I hope you hear the voice of Raymond Abraham Lewis and 27 of my other family 1:33:40 members we cannot sit here and say we are proud to be part of the Maring Community when we can't even honor and 1:33:46 take care of the Dead who founded it nothing changes if nothing changes 1:33:55 we are hindering the grief and bement needs of the community it is impossible to mourn when you have to mow a path just to locate your loved one's grave it 1:34:03 is impossible to show expressions of grief when your loved one is padlocked in a mausoleum because it's caving in due to a lack of Perpetual 1:34:11 care I leave this inventary more distressed than when I first arrived it's not called rest in and amongst 1:34:18 chaos it's not called Rest In Pieces it's called rest in peace this cemetery 1:34:25 is anything but Serene or peaceful many of those buried at Estates of Serenity died before the creation of death certificates or didn't make it into the 1:34:33 census these broken crooked dirty tombstones are the only proof that some of these people ever 1:34:40 existed I don't have a zero turn mower I don't have a chainsaw I don't have a million 1:34:47 dollars but the resources I do have are passion and love for my proud to be a gas City resident 1:35:53 now now but I'm from Northeast Marian and my parents lived in Northeast Maran all their life when my mom 1:36:01 passed my parents gave away their plots at Gardens of memory in Huntington because the tradition in the south is to 1:36:09 have decoration day and be able to put flowers and decorate and do these things my mom wanted to be moved I had no idea what was happening when we bought that 1:36:18 and my dad buried his wife there um but I do know it wasn't as bad as now but I do know 1:36:26 that when my dad was buried there in 2020 we had to ask for a bush to be cut down so people standing around could see 1:36:34 what was going on my husband takes care of my parents' Graves everyone doesn't have 1:36:42 that and I know people have mentioned money and that the current caretaker doesn't have all the funds he needs and 1:36:49 that may well be but when the sign falls off on the ground that tells you the rules of the cemetery and when to come 1:36:56 and when to go you can't put a a piece of plywood with a sign back up this isn't just about what money's available 1:37:03 that's not the only thing things have gone wrong things have been bad things have not been as they should 1:37:10 be it is about money but it's not just about money and now I 1:37:18 wish I wouldn't have had my parents go there or we bought plots there at the same time 1:37:26 I was getting ready to look out look what it would cost to move them to but I think that that's hard for a family to 1:37:35 decide you can't just have the money you can't give the current management the money but families 1:37:44 shouldn't have to be constantly taking care of their graves and other people's 1:37:49 graves in a cemetery thank you thank you 1:37:57 welcome hi I am a resident here at Marian my name is Derek Brown um I'm 41 years old and this is the first time 1:38:06 I've been down um to do this but uh my father is here with me tonight Rick Brown who we just buried my mother there 1:38:13 uh two about two years ago my father goes over it retired at 69 years old still to take care of my uh mother's 1:38:21 grave and when my dad is gone God willing I'm alive I whether this is taken care of or not I myself will continue to do that in honor of my 1:38:29 parents and I know many others will to me this is beyond thinking of what to say here um I felt like I needed to say 1:38:36 something but listening to everything and and what was said is this isn't a matter of someone's opinion everybody 1:38:43 has a story about this um there's a lot of people here obviously that this touches closely I think everyone knows 1:38:50 is a very um hot subject for a lot of people a a very um sensitive subject and it should be 1:38:58 but I'm optimistic in the town that I live in I chose to move back to Maran and become part of this community a 1:39:05 taxpaying citizen and I'm optimistic that as the leaders and the work that she's done I know I won't pretend to 1:39:13 understand all the legalities that she has to go through to try to pull something like this together and actually make it happen so I'm 1:39:21 optimistic that there's a lot of good brains here and that we can unite on this subject and come together whatever Mr Harker said about changing the 1:39:29 wording that it can at least be pass for now the money can be allocated so she can go ahead and move ahead put whatever 1:39:37 stipulations on that that can be done tonight whatever stipulations it is that money stays in the city fund until it's 1:39:44 ready to move ahead um I'm optimistic that that can be done that this team can unite of the people that's our mayor and 1:39:51 this board that's together right now serving this community and can make a difference that um many people would 1:39:58 enjoy and that is respecting um our city and I'm excited about all the new things here but I am optimistic that we can 1:40:05 take care of of the things that's it's a right just gone way too far and I know it's not their problem they're not in there 1:41:44 to go mow the cemetery but if you're going to take them out to Bo properties why not take them out there you want Marion to be beautiful you think people 1:41:52 drive by that cemetery and think Marian's beautiful looking at that Maran may not own it but Maran ought to want 1:41:59 to make it look beautiful you away in 2005 1:43:30 so we I know we all have stories but I have a story of of back in 2005 when my wife passed 1:43:38 away I went out there and to see if I could bury her there at the 1:43:46 time I was told well we don't know where anybody is buried our our records got burned up in a fire all we can do is dig 1:43:55 down if we if we hit bones we hit bones whoa so that's my story they said 1:44:03 if we hit bones we'll just put them in a box and we'll tuck them down underneath your wife and they won't say 1:44:10 anything so that's that's my story I have uh at least 50 relatives buried out 1:44:20 there my great great grandfather from Virginia Virginia is buried there my 1:44:27 great-grandfather my grandfather my wife is buried there uh when she passed away in 2005 Dev and I 1:44:36 got married in 2006 so we spend countless hours out there a lot of time a lot of energy with 1:44:46 our equipment our gas our time our sweat I know what everybody's feeling 1:44:54 because I feel it so this has this has to happen guys this has to happen if we 1:45:01 if we show enough respect in this city to take care of white and tear down buildings we have to show respect for 1:45:09 1:46:42 2007 Neil Jeff was over the cemeter EV then he kept it pretty well taken care 1:46:50 of until he mve moved to Garden Of Memories or Grant Memorial I'm 1:46:58 sorry I am 71 years old I load my I bought me a little electric push mower I 1:47:07 go up there I mow Tom Sutton's family cemetery plots my grandparents my 1:47:14 great-grandparents my husbands and my mother and father-in-law's I also have a sister-in-law who passed away two years 1:47:23 ago this coming Jan or this past January her grave was not 1:47:30 leveled until they could put the headstone they couldn't put the headstone until the Gad was level finally after a year and a half they put 1:47:39 a headstone up there because he got the grave leveled there is no reason on God's 1:47:47 green earth that our families should be laid to rest and place where somebody does not care enough to take care of the 1:47:56 graves I understand money and finance may be a thing let's pull together and get what 1:48:03 we need to get this Cemetery taken care of if I had the money to exume my husband's body I would take him to the 1:48:12 Fountain where I'm was born and raised and have him buried over there but because he he is buried right next to 1:48:20 his mother I knew that that's where he wanted to be I am fed up I went up there 1:48:29 this spring right before Memorial Day I could not find my mother and my grandparents headstone because the weeds 1:48:37 were up to my hip there's no sense in that and where's the National Historical Society in there we have 1:48:46 ancestors that have been buried there for decades and years where there has to be something to where they can step in 1:48:55 and say look this is a National Historical Cemetery I thank Deb 1:49:04 for putting this over Facebook and bring it to everybody's attention I have been and I know some of you know Tom Sutton 1:49:13 he used to be a police officer here he can't go up in MO he has a missing leg 1:49:19 his mother is 96 agree with you I'd like to clean up the appropriation but I'm also in favor of it I have family members 1:52:29 buried there but I'd like to see the wording fixed so that we know we're 1:52:39 legal I agree I would like to see the wording fixed I don't like the idea of doing it all in one night without time 1:52:48 to really look at it and think about it so I'll my other proposal I said earlier was to send this to a third 1:52:56 reading as well so um you know ultimately at the end of the day if we clean it up and opinions change at the third reading it's could 1:53:04 still get voted down um but I my opinion is we vote on this with an amendment I mean there's no guarantee I haven't 1:53:13 heard enough yeses yet uh informally but if it were to pass um then move it on to a third reading so that we can see that 1:53:21 language have more time maybe to do some more homework if we need to ask more legal questions if we need it and bring it back for we'll call it the final 1:53:29 third hearing so any other council members Council for I could all the council people get a copy of that Amendment so we can see what's in it and 1:53:38 how it's going to be structured well I mean that's okay I appreciate bringing it up uh maybe I should have brought up earlier I did 1:54:55 have that discussion with Marty ahead of time and we did discuss about them they 1:55:02 already have they're retaining their own legal that would have been nice to know yeah I'm so sorry I should have 1:55:11 said councilwoman Divine so one of my other questions that I have noted to myself here is we are in the middle of 1:55:19 August and if we do a a Pro this through the third reading um that only buys a couple months before we head into the 1:55:28 next budget and how are we going to be handling that to roll it if there's a to think about the rollover provision to 1:55:36 continue to hold it or is an encumberment um because we'd be then taking this up again in January because 1:55:43 that money that appropriation goes away at the end of the budget year I just wanted to make sure that was out there too as we were talking amendments 1:55:54 um yeah and I I concur that I do think there should be a time limit whether it's by default or we set our own time 1:56:01 limit that if nothing happens by a certain date whether it's it ends at the end of the year um then we come back and 1:56:08 look at it again um but I I agree something should be in there if it is voted in favor I would 1:56:18 hate to have all that work done and then have to do it again come January because I know at this point we cannot increase the budget that's been 1:56:26 presented to us Mr Mr President go ahead trusty Kane 1:56:34 and in state statute for the budget whether it's the city or the township there is an 1:56:42 encumbrance that you move over so you don't I don't have to come before you again in January because it would 1:56:48 already be an encumbered bill or invoice that you or an ordinance that you have approved so it just rolls there's 1:56:56 nothing that has to be redone so I think these are this is 1:57:04 great so this is exactly why I think we need to go to a third reading or at least take a vote today and give it the opportunity to go third reading if it 1:57:12 does pass because it gives us some time to clarify the language maybe address some additional um this is where I think a third reading is appropriate so but I 1:57:21 do appreciate and that comes from State Statute and what I have to follow and what all government agencies have to follow thank you and I understand the 1:57:31 incumbrance process that's what I'm trying to make sure that this language includes that if we want it to continue until this process has gone through to 1:57:39 make sure that that is properly encumbered with this appropriation because it doesn't your budget doesn't just automatically 1:57:47 encumber we have to do something to create that encumbrance whether it be contract with you that it holds or it 1:57:54 has to be something that shows that money specifically allocated to something and I don't know the nonreverting fund right and this the way 1:58:03 this language is in the ordinance is not going that direction yet it's just sitting as an as an additional preparation to the general so that's why 1:58:11 I want to make sure if we're approving this and amending it that it's holding that for you otherwise there was no point in approving the money and I want 1:58:18 to make sure that we use the money you know if we're going to use it to clean up then that's what we so I I drive around the city as much as I can and try to uh see 2:24:11 what's going on and one of the things that come to my that came was brought to my attention numerous times our citizens other conditions of our alley so if you 2:24:19 spend any time traveling down these Al you you'll know that uh they're in dire need of attention so I drove down quite a few of them in the last council 2:24:26 meeting I put a picture that one aly's um I don't I dare not call it a pothole anymore it's something else that's en larger than that was had the ability to 2:24:35 swallow a whole Yukon so we're in a situation now where we're uh we're having some issues so I um not to get my 2:24:43 years too off give or give or take uh year or two on each end but it's been about 30 years since the city has any uh intentional focus on what we're going to 2:24:52 do with our alley so at the last council meeting we proposed three different options and I think I listed them as 2:24:58 like I think Bentley Cadillac and um chevolet and um after we went through those options you guys voted that you 2:25:06 want to go with option one which option one was to um grade the necessary alleys down then redo them with um with gravel 2:25:15 so um then that I think that's anything else yeah anything else you want to add yeah I think I think that pretty much uh 2:25:24 it comes to that um so yeah any questions that I can answer or any oh also our engineer um so still don't have 2:25:33 a name for him yet but I just call him engineer Mike today I guess um is as any questions as well but um I think the 2:25:41 reason why that we had kind of got landed on the uh the gravel selection from A administrative perspective was 2:25:49 because of a few things one being the cost to implement the execution of the alleys two um the cost of mainess and 2:25:58 three the the uh the ability to maintain it with inhouse with ourself with our Manpower in our street department who 2:26:05 was here in our street department so um yeah anything else you want to add for no I again there there was a question 2:26:14 about life expectancy on on certain materials uh alleys are very difficult to to to ascertain real good life 2:26:23 expectancy because it's different the way it's driven differently um so that to the best of my knowledge I try to give you a good 2:26:31 representation of what I thought longevity might be uh but one thing about the stone is if we we can put some 2:26:40 Stone in it when it starts failing or getting potholes Stone will last forever asphalt does have a a life cycle no 2:26:48 matter if it's 10 years years or 20 years someone down the down the line from us will will be maintaining asphalt 2:26:56 uh I do recognize and have recognize there are um Brick we're not going to take up any brick we don't we don't have 2:27:04 that in the plan to take up any brick um and if there are decent alleys there 2:27:11 that we can keep up with uh with a little bit of Maintenance uh we're going to keep those we're just not going to fullblown just because it's an alley 2:27:20 take the asphalt off that's just needlessly spending finances that we don't need it to be and then we do understand that there are going to be 2:27:27 alleys that are so far gone that we're going to have to Dig Down Deeper put in more material and those will be just 2:27:34 taken care of on a case-by casee uh basis so when when I looked at the total numbers of alleys that is the total 2:27:44 number uh so that with our request um and even with 2:27:50 the next one that'll that'll come later uh you're going to have some that is going to take more work and some that 2:27:57 won't so hopefully that offset will be taken care of within that number any questions I'd be glad to 2:28:07 help any council members can you say what you said again about the asphalt sorry as far as the 2:28:15 longevity of it uh no the you're not going to remove any so yeah so well so if there are decent alleys that are that 2:28:23 are there that don't have numerous Pooles and have have a good life expectancy still in 2:28:31 those I don't plan on removing that asphalt until it's it's deemed necessary I I just think that just to remove 2:28:38 asphalt because it's an alley is a needless expense so if the asphalt's good you're leaving it but if it's in if it's 2:28:45 already failing and in po poor condition you're going to Mill that off correct 2:28:53 council member Runner I take it engineer that there are some alleys 2:29:01 that go beyond one block and and and I think I've heard some of them where the first block you drive it seems like this 2:29:10 is okay and then the next block is really a correct yeah so so as as you've 2:29:18 driven them so so have I and yes there are that that state of of of disrepair is in some but not in all uh so you 2:29:27 could have half of an alley that might be in pretty decent shape so we'll just play those by um by ear there are a couple streets that because of the 2:29:35 dramatic slope uh let's say White Street or um Second Street or anything that has a dramatic slope we may have to look at 2:29:44 putting uh Asphalt in that because the stone will never as the rains come when the water pours down we'll be constantly 2:29:52 putting ston in so we'll have to play a little bit of that by year as well is this something you can get done for all 2:29:59 the alleys by the time the SN no sir no no no but the the good thing about it is 2:30:07 we're not relying on a an asphalt plant uh that typically would close in November we can go into into the winter 2:30:16 months uh if if the conditions are nice remove that asphalt stone is available all year round so give me give me a 2:30:24 rough estimate what percentage are are just on you're going to put asphal on what percentage you're still well I'll 2:30:32 be quite honest with you I I don't have that number it's until until you fund it I don't want to say once you pay me I'll 2:30:40 go look at it but just by the sheer numbers of uh of inquiries we get on a daily basis I'm going to say I'll 2:30:49 probably replace 85% and probably 15% that may be either brick or or decent alleys thank 2:30:58 you any their council members before I speak 2:31:05 great um I wasn't here at the last council meeting um mayor knows where I stand on this but I 2:31:15 adamantly adamantly against replacing asphalt alleyway ways with rock um I 2:31:23 don't believe we've done enough due diligence on this at this point um I had a meeting with utilities director Robin 2:31:31 last week just a discussion about how City can also partnership and get more funding Etc uh was kind of a caveat of a 2:31:40 conversation I had with the mayor he's familiar with it and um you know I discussed the proposal of 2:31:47 rocks and Alleyways and and there is some concern from utilities they said that they have not been a part of conversations when it 2:31:56 comes to alleys uh they have trash trucks that go up and down these Alleyways constantly um I didn't know this until 2:32:03 she told me um because I rely on an Alleyway I live off of an Alleyway my trash gets picked up on an 2:32:10 Alleyway that in the winter time the utilities actually plows the alleys that where their trash trucks go I thought it 2:32:17 was the city maintenance doing it but the utilities plows it to allow their trash trucks to go down uh and she 2:32:24 expressed concern with plows and rock and issues that would come from that um also you know I heard the 2:32:33 argument that this would help with um drainage okay well the water is going to drain through the rock get underneath 2:32:41 the Rock and then soften whatever is underneath it then thus creating potholes I grew up where I grew up my 2:32:50 driveway in my house was right off of an Alleyway it was in the town of wona lake and I grew up on a a gravel Alleyway it 2:32:59 was horrible we're constantly trying city was constantly putting Rock in couldn't ride my bike down at half the 2:33:06 time and I I understand that we have some asphalt alleys that are the same situation right now but they were constantly out there um our alley didn't 2:33:15 get plowed because of it um and then my soft High School the town went through 2:33:22 and paved all the rock Alleyways and it made a huge difference I didn't our cars didn't get dirty pulling out of our 2:33:30 driveway um we didn't have to worry about rocks being kicked up into the yard because uh previously when they 2:33:39 would put rock down some would always end up in our yard but just the quality of life you know we discuss excellence 2:33:46 in this city I my and I'm very passionate about this I believe going back to rock is a step backwards when it 2:33:54 comes to Excellence but I understand that there's a cost associated with it um asphalt does cost more I commend the 2:34:03 mayor for addressing this so I'm not criticizing um any of that I know he wanted our opinion on it um thus I'm 2:34:12 giving mine um I do think we need to address these but my opinion is every alley is is a different situation is a 2:34:22 different story has a different need um I did get a let me get to 2:34:30 my Al maintenance here so I had Robin utilities send this she also sent it to the mayor this week showing all the 2:34:39 routes on the screen here or the um utilities trash 2:34:46 trucks um there's all throughout the city all the lines or are trash routes um some of them are on the 2:34:54 streets some of them are in the alleys but again I just think there needs to be a further discussion about which alley 2:35:00 gets what um some of these alleys uh could just be resurfaced in my 2:35:07 opinion um I went around just spent 10 minutes and looked at some 2:35:16 Alleyways uh so this was a rock Alleyway in Maran or maybe it used to be asphal I 2:35:23 don't know but it's rock now so that's what our Rock Alleyways are going to look like unless they're traveled on every day all day that doesn't look as 2:35:32 appealing to me vers you know 31st and carry that alley looks pretty good um 2:35:40 and I know we're not going to tear up good alleys or I would hope we wouldn't but I would rather us resurface that 2:35:47 maybe for a little extra to last a lot longer longer than to go back and have my alley look like this um the other 2:35:55 issue on alley maintenance and again I know the mayor's on board with this and it's it's a Manpower thing but we got a 2:36:02 bigger problem than just our asphalt um 21st in Florence this alley looks in good shape to drive but I'm not going to 2:36:11 make it through because we have so much overgrown brush in fact the utilities director said that's almost a bigger problem than the condition of the actual 2:36:20 Asphalt in the alleys is you can't get down the alley I drive down to get to my house um I navigate around more tree 2:36:28 limbs than I do spots in the um asphalt um because I don't want streaks and scratches down my truck so I just think 2:36:38 I'm for funding alley maintenance I just want something just more comprehensive I 2:36:45 think we need to spend more time and figure this out there's Adams and for 14 my other um push back is so as these 2:36:53 alleys start to get in bad condition we're saying we're going to replace them in the Rock but if we go downtown Maran 2:37:00 right we're building this nice uh we aren't but we're uh supporting that uh construction of apartments or any of the 2:37:09 businesses downtown so when those alleys downtown behind all of these businesses get in bad condition we're going to in put Rock there's so many asphalt 2:37:18 driveways or asphalt parking lots at these businesses downtown and even around the the city that connect to 2:37:26 Asphalt Alleyways um but especially downtown I just can't imagine driving downtown and all of a sudden now we have 2:37:35 Rock and then it just separates out the driveways and I just don't think it looks good I don't I'm not so much 2:37:42 convinced on the maintenance of it I'm going to be trying think how I want to say this 2:37:51 so our alleys have been neglected for a long long time um to nobody's particular fault funding has always been an issue I 2:37:59 get it Manpower is an issue but whatever the issue was we are now saying we can go ahead 2:38:08 and keep up with all the alleys I just I'm I don't I don't I'm not sold on that at this point like if we couldn't keep 2:38:16 putting if we couldn't fill potholes before how are we going to continue continue to fill potholes with rock um 2:38:23 you know maybe this city should look at put H asphalt or maybe we develop a plan a 10 15 20 year plan on alley 2:38:31 Replacements I just my my purpose of of this is really just a push and say I 2:38:39 think we just need more strategy um no different than our roads you know we just don't do a one-sized fitall or we don't we're not going to replace roads 2:38:47 with gra with gravel and to that point some of us that live off an alley our alleys are our roads they are our 2:38:55 primary access point to our house so if you lived off of a road and I tore it up and just put rock you probably wouldn't 2:39:03 be very happy um especially if you went to the car wash and then you throw a dirt on your car there's many of us that live in Maran that our primary access to 2:39:12 our home is an Alleyway and so I am I am not for rock um I I think there just 2:39:19 needs be more conversation with utilities um Co code enforcement I know they're strapped with they don't have 2:39:27 enough help but how do we eliminate these weeds in the alleys uh if we go to rock you think our our weeds and brush 2:39:35 are are over going now let's put Rock in the alleys and see how much grows through that on the edges and the middle um and they're going to become even 2:39:43 harder to navigate and um let alone I just I really believe and the mayor's of excellence in this city and I commend 2:39:51 him for coming to us and giving us these options right he didn't come and say I think we should just do rock let let's look at these options but my opinion is 2:40:00 and I'll rest on this is I don't think there should be an option one or two or three I think every alley just like any 2:40:08 road needs its own specific attention some alleys might need M down all the way 8 Ines and started fresh up but if 2:40:17 they're done right and we put a little money in now it might save us more later right quality over quantity um because 2:40:24 in 10 15 20 years I think we're going to be sit back here if anyone's left on the council probably do talking about the 2:40:32 same issues when it comes to rock um so that's my opinion I can speak longer on it but I know we have a long meeting so 2:40:40 I'm open to anyone else's opinion I would say I would be for this 500,000 if 2:40:46 I had um commitment that we aren't going to replace anything with rock that is 2:40:54 not currently Rock especially without some kind of a plan or analysis on which alleys need to 2:41:03 be addressed first so I'll leave it at that if anyone has anything else they want to share or 2:41:12 add I do have a question for you mayor so um so if this were to pass the 2:41:20 500,000 I do I will say because we do have under new business 600,000 for first reading to add on to the alley 2:41:28 maintenance um that's $1.1 million so I I believe I don't have in front of me I apologize that $1.1 2:41:37 million how much based on the Rock proposal why 1.1 million and how many 2:41:45 alleys do you plan on doing with that um 2:41:50 see so with the the option one to do the 463 alleys the the quote would be uh $ 2:42:00 1.125 million um and out of all the alleys we have um as engineer Mike was saying um 2:42:09 all of them won't need uh attention some of them may need more attention than other so that $1.1 million allotment will allow us the the space to be able 2:42:17 to do uh Ali specific uh specific needs so that's what that that total ask was for and and if we remember the last 2:42:25 Council me the reason why I went ahead and asked for the extra 600,000 was because it was like a general consensus that we should go ahead and uh do do all 2:42:34 of the alley so my original proposal was only for half a million dollars but from the what we got from the last council meeting um unofficially everyone said 2:42:42 that we should just ask for the whole amount okay so that's that kind of goes back to so the premise then 2:42:49 if we do the half million to the 600,000 for the 1.1 is basically you're saying we're going to do option one and so that's 2:42:58 where I just want some clarity like okay if we if you if if the consensus is we're going to do all this 2:43:06 rock because that was The Proposal every alley for 1.1 million in rock but then I'm being told that we're not going to 2:43:13 do that this is where I just there's a gray area there's some confusion if we appropriated one .1 million what exactly 2:43:21 is the plan with that right so with the with the $1.1 million appropriation that would allow for the administration to go 2:43:28 out and use our our staff to make the you know executive decision on what alley get what from a you know executive branch of government standpoint so the 2:43:37 the the money that we're asking for is just the allotment to be able to do alley maintenance and address you know this AO issue that we've unfortunately 2:43:45 inherited so that's that's all the ask is for right downtown um it's catac corner to 2:44:26 the where Firehouse one is going to be rebuilt um the Alleyways everyone's 2:44:33 talked about like houses and access to houses a lot of Alleyways that are affecting businesses and those Alleyways are used for offloading things at the 2:44:42 rescue mission for example food donations things like that come in we have that Alleyway if that was to be turned into to gravel for some reason at 2:44:50 the point where it needs maintenance which it kind of does um all of a sudden we're trying to offload things large loads pallet size loads that we get into 2:44:59 gravel that becomes very difficult to move and and it also becomes a walking and tripping Hazard for many people stay with us have physical needs and physical 2:45:08 problems um I think asphalting the Alleyways especially in the down toown area where you're going to have businesses they're using those becomes 2:45:17 very very important I can't imagine putting up a new fire station and then having gravel Alleyways surrounding it as you're trying to deal with the fire 2:45:24 trucks moving and and heavy load so I think there should be consideration that you can't one siiz fit all with gravel you need to think 2:45:34 about the areas where they're at um what is needed I appreciate and applaud the efforts it's 100% needed um but I don't 2:45:43 think I don't think we should pass this at this time until we think a little bit more about what is going to be done with that money how are these streets going 2:45:51 to be done because that looks a lot like where our warehouse is at and we have semis that come and take bailes as as we 2:45:59 get donations um gravel is not going to be very conducive to semis so please consider thinking about this a little 2:46:06 bit more about Robin patteron and I live at 1012 West 10th Street here in 2:46:31 Maran and I have lived there for 17 years and used to the trash truck did 2:46:38 come down our alley and then that may be what ruined our alley I don't know but I do know this uh for many years and for a 2:46:47 couple years I've talked to Brian about this on several occasions of trying to get something done with my alley and my alley is paved but it has a lot of 2:46:55 potholes and now we're having to like you said and I'm so glad you brought this up the foliage that these people 2:47:02 are not keeping their houses up and it's all into the alley so that forces cars to you know go off the road into other 2:47:11 people's yards and it's making potholes we've got potholes all through there I've had to replace my control arms on my truck I I have a camper that I have 2:47:20 back there that I try to get down the alley I've already lost on my old camper I lost a uh antenna off the side of it because it got caught in the brush going 2:47:28 down through the alley you know now when I go down there it wraps around the top of my air conditioner it's a constant 2:47:35 you know and my my alley is only a block long it's not even that long you know so it's been something that's been a 2:47:44 constant for years now and I don't know how many times we've complained and compl and plain about all the foliage 2:47:51 over the over the alley and on a few occasions we had the inmates actually get to come down and and you know clear 2:47:58 that out but the problem with that is how's come the homeowners aren't being fined for that I mean the homeowners ought to be taking care of their 2:48:06 property I've got one right next door to me that's got I don't know he just got rid of 11 lawnmowers yesterday and I 2:48:14 don't know how many bicycles he's got over there he's got a yard set almost every day he's got Junk he he he's 2:48:22 collects scrap and I am so glad that I that was probably the best decision I ever made to put a privacy fence up on 2:48:29 that property because it's a rental and the people that live there their daughter used to live there but he's a junk man and he'd always bring his junk 2:48:38 there and it's just making it worse and and it it's GNA breed if it hasn't already it's going to breed you know 2:48:46 mice and cockroaches and I'm just not about I'm not about living in cockroaches you know so and if you go down the alley on the left side of the 2:48:55 alley you where all the brushes hanging over there's two more yards in the same situation why aren't these people being 2:49:02 fined for their yards I know there's got to be codes to this and when I go down that alley and I make a left onto Ninth 2:49:11 Street there's a um pretty sure it's a code enforcement car that's parked right there that lives right there I'm almost 2:49:19 positive it's and I'm thinking why is if you live in this neighborhood you got to see that don't know what can be done but I applaud the mayor for taking these 2:50:22 movements towards the alleys and whatever we can do to get alleys taken care of one way or the other some kind of consensus engineer and our team is I mean I don't know if the 2:51:53 public has all the information regarding the cost of these um so the pave the alleys and Mar looking at $ 9.28 five 2:52:02 million um versus um rock man what we talk about right now so I I do think I'm very much 2:52:09 agreeing with um council president Kenley that 100% I want the alley to be paid I think now we just have to uh make 2:52:17 a choice of what as a city can we afford to do can I I ask you a question do you know in the previous year's budget if 2:52:27 and maybe Mike could address was there anything ever allocated for M alley maintenance which is what I thought that's why I'm saying I'm not point 2:52:34 fingers at anyone I know it's a funding thing sometimes a Manpower I commend you for coming to us um I just want to make sure we're just taking the right step so 2:52:43 in 5 10 years we're not readdressing this um so and then and then one more thing about the utilities you know utilities been driving these alleys for 2:52:52 30 40 years and they never tried to do anything so now all a sudden like they act like they care it's interesting and um also they did she did respond to our 2:53:00 email said they don't have the funds to participate right at the moment yeah so just for transparency there were some 2:53:07 emails back and forth with Robin utilities part of that was about so 2:53:17 basically the conversation with Robin was they are willing and able when they're financially able to help 2:53:25 contribute to Aly maintenance where their trash trucks go up and down the alleys um so as of right now they can't because 2:53:34 well they're they have some Financial issues hence our rate increase that we approved they have to pay back a loan but their goal is to become financially 2:53:43 healthy again get those loans paid back and once they're in that situation uh Robin from utilities said absolutely they would love to sit down and talk to 2:53:52 the city and partner um to discuss how the utilities can help contribute to 2:53:59 Alley maintenance um because she and Robin I she's new executive director right so she maybe has some fresh ideas 2:54:07 just like we have a fresh mayor with fresh ideas um that the the foliage was a huge issue for them for trash trucks 2:54:15 of course potholes is as well but again it goes to um I think down the road once they're financially able I think they 2:54:24 would prefer alleys to be paved and I think they would consider helping maintaining those the other question I 2:54:31 have maybe it's for Mike if we have a pothole in an Alleyway uh what do we Outsource that 2:54:38 Mike or do we do that inhouse and I know that's cold versus hot asphalt what does that look like Outsource what does it 2:54:46 cost to send do we have one company we use or we pay 2:54:52 by the time that's placed so like we need to fill one poth hole what does it cost the city for that for like a 2:55:00 Alleyway depending on the size yeah some pot holes are an inch and a half some are six inches so it's just it's by the 2:55:08 tonnage so it's so if they if they go and and purchase five tons we pay for the five tons that they use to to place 2:55:17 so do you know like expected cost for a ton like what do we pay for a ton you pay right now 100 about 2:55:27 $104 for T of asphalt and then you pay for the labor to place that okay if we 2:55:34 were to approve this um could this money be used to go and fill potholes in these 2:55:41 asphalt Alys and and I know it's a patch but at least get us through for a decent amount of time I wouldn't say that 2:55:49 unless he told me to because that's not what I'm I'm just saying is it physically I mean we can we have the abilities if we out if you give 2:55:56 me money I'll spend it however you'd like me to I I figured that just again trying to think outside the box here yeah councilman 2:56:05 pise yeah can I address that for uh for Mike because watching the bills when uh the city has poth holes filled on the 2:56:13 street through Outsourcing through Donnie Scott it normally runs basically you can correct me if I'm wrong because 2:56:20 he charges for two to three men the truck plus the asphalt it normally runs $800 a day is what he charges to fill 2:56:29 Pooles that's what I've seen on the billing for the labor when I'm billing and and asphalt and truck and labor okay 2:56:38 it normally runs about $800 a day and you can correct me if I'm wrong but with a bills that what he submitted on 2:56:45 Donny's bills for filling potholes it's usually about $800 a day with the truck and correct on on a on a week you you 2:56:54 probably get bills if you look at them we anywhere between 25 to $33,000 is what he if he's obviously the 2:57:03 wi weather dependent but if he's out there every day which he's not out there every day but that's that's a typical great thank you so much 2:57:12 appreciate that Gary is that like for an eight hour day that kind of money yeah nor normally uh I don't know if they get 2:57:20 a full eight hours with lunch and and everything so but yeah normally their work day is uh is Two Guys sometimes 2:57:29 three depends normally two guys he charges for the truck he charges for the labor he charges for the asphalt and it it if you break it down it runs like 2:57:38 Mike said $2500 a week or something if he's got a list and they provide a list to him it breaks down to about $800 a 2:57:46 day councilman Kane did you have something well I just wanted to say probably back 2:57:54 in the uh late 80s I think everything was Stone Drive or stone Alleyways um under the 2:58:03 Ron Mai Administration uh Mr mauy was getting a lot of pressure from homeowners and so 2:58:10 forth and and like you said they didn't like the dust on their cars they didn't like driving down Alleyways um 2:58:19 I I don't know whether I'm in favor of going all all pavement because 2:58:26 I don't think the city can afford $10 million um I don't know how you spread that out over the 2:58:35 years um stone is a lot cheaper but you're going to have a lot of Fallout from that 2:58:43 also um but you also have to remember 2:58:51 that the mayor is not always going to be here and what priorities does the next 2:58:58 mayor have on keeping upkeep to the alleys so if you have a May some Mayors 2:59:06 like we've had in the past alleys are not even on their radar and so they fall into 2:59:15 disrepair and here we are today and we've got Alleyways all over the city that are paved alleys that are in 2:59:23 disrepair with full of potholes we've got Stone Alleyways that are that certainly need Stone but you 2:59:32 just can't lay stone on top of stone can you Mike I mean you have to go in and 2:59:38 and knife that up to create a new base or that new stone is just going to roll 2:59:45 right out of those potholes so there's a lot of work on on both but wow when you 2:59:52 look at A10 million price tag for for Paving all the alleys I don't think we can we can afford that either so I think 3:00:00 we go back to what you said President McKinley that we need to probably pick and choose on 3:00:08 how we move forward with with with each Alleyway com my thoughts but for what 3:00:15 they're worth I I didn't come with any to any conclusion there but just some thoughts and I appreciate that I just um 3:00:23 wanted to have this discussion because I just didn't want us to just say yes let's just go and do all rock because I just didn't think it was appropriate I mean here's I don't think we need to 3:00:32 spend $10 million I just think we need to spend money on the alleys that truly need to work right like 301 in carry let's not 3:00:39 touch that one it doesn't need touched um if we need to out of this money can we give Mike permission to go ahead and 3:00:48 fill potholes if I mean some alleys there is I mean I walk down them sometimes some alleys just need a poth hole filled that's it and if we fill it 3:00:57 sooner especially with this app I've already reported a couple potholes in the app myself um if we can address those sooner it prevents them from 3:01:06 getting bigger right if we can fill them sooner they don't fill with water they don't disintegrate give Mike the resources through this funding to 3:01:13 address potholes and if there's an alley that has one or two potholes I don't want us just to go well we're just going to clear it out and put Rock in it because we're going to be back in a 3:01:21 couple years and addressing it anyways and to your point in the future if there's a different mayor neglect is neglect so if we had if we had Rock 3:01:30 Alleyways they're going to be neglected no different than if a mayor neglected uh any other type of Alleyway so I just and I would hate to see Rock being 3:01:38 neglected and then it's just going to snowball but we're dealing with what we have we have a mayor that's willing to address it and our hope is is our 3:01:46 constituents um hold us and the mayor accountable for excellence and quality within the city 3:01:53 um so that's my opinion I don't know I guess maybe if there's other consensus we're not necessarily voting on what type of Alley we're doing but I know 3:02:00 that was consensus why he came back with the 600,000 councilman um I gotta admit I 3:02:08 was in favor of the rock because I thought man if we can fix everybody's alleys then that would be great everybody would be happy not realizing a 3:02:16 lot of people now that effect we saying we don't want R so I think we we I'm in 3:02:23 favor of giving Mike the money um what I mean what kind of a study are you you think we needed I 3:02:30 mean I I don't know I mean this is above my head I'm not the expert like Mike I'm just doesn't address it who cares what it's labeled we have a mayor that wants to 3:03:26 address it we have a mike that's more than willing to I think go along and and and fix these alleys up I commend the 3:03:34 thought of the thought of redoing all of them but um I just I'm a all I'm asking 3:03:41 for my vote is a commitment that um every alley is assessed and and Truth 3:03:48 unless an alley comes to our order of 3:11:37 business and agenda um and so essentially uh a few tweaks on the order of business uh neighborhood Spotlight is 3:11:46 going to be community spotl Spotlight it's whatever but the bigger one under that is going from first responder Spotlight to City employee Spotlight and 3:11:54 I did run this through both the police chief and fire chief first um and they were passes a first reading it would require a majority vote from the council um and then after an ordinance has passed the first reading it says it 3:13:56 shall be placed on the agenda for the next regular meeting and lastly this is ADD we are adding a decorum section which um I think is important and our 3:14:05 rules we had no rules about the Quorum and so this just talks about um language Behavior refusal to obey orders of the 3:14:14 presiding officer and it it basically States The Authority for a sergeant-at-arms to remove anyone who intentionally disturbs the Quorum of a 3:14:22 council meeting um so this just adds a deor language in there so just wanted to make sure for transparency so everyone 3:14:31 knows what exactly this is so we're g to go and move it to the public their their request to um the plan commission the plan commission gave a 3:20:34 favorable recommendation to um switch it from I2 to R3 uh if you look at the overall map in 3:20:44 that area uh I uh I2 is doesn't there isn't very much in that area and this may be 3:20:52 the last parcel that they and I'm going to probably say it wrong they whole malib is that right is that how you say 3:20:58 I say it right okay Mal uh uh is R3 now uh which means that uh 3:21:08 anything that that's built in an R3 could be in that parcel just as easy as it could be this parcel uh so 3:21:17 there are some things that if it stays at uh at I2 that that the neighbors may not like and there might be some things 3:21:25 if it goes to R3 that the neighbors might not like but that's not specifically what we we just look at the zoning itself as the plan commission 3:21:34 trying to clear up some of the the issues that are that are out there and this this is certainly one that once it 3:21:41 was presented to us uh and the plan commission looked at it and reviewed it that they they came the the 3:21:48 recommendation that it it should probably be an R3 similar to what is in the surrounding area so uh if
