of psychedelic 1:26 seller and I'm a board member of marine Arts commission I'm wanted to come up here to essentially parot what uh Mike Halstead said at the last board meeting 1:33 two weeks ago that the money that we're requesting for this director role the role of the director is to go and seek 1:41 these grants for the city of Maran right now we don't have anyone that's looking for these grants that is honing in to 1:48 find out whether we are qualified for it and if we're not qualified how can we get qualified for it so in the words or 1:56 not in the words to put the numbers out there $35,000 for one person to go out and seek thousands of dollars and grant money for 2:04 Maran where that $35,000 investment could bring back $75,000 $100,000 in 2:11 Grants so in regards to the numbers I just wanted to parir that what my cad said last year or last week or two weeks 2:18 ago that the role of this director is not to come in here and to take the money and then to go and do whatever it is to go and bring that money back and 2:27 in Surplus it is an investment with a profit and if that doesn't happen then yeah it's a failure so just wanted to 2:35 state that out there money um this is a huge investment a small investment for huge returns and so 3:41 I ask my fellow councilmen to support this and when you're ready for a motion I will make 3:50 that vice president Force I'd like to make a point on that too is that uh you know when we had the 3:58 first hearing on this and it it was uh printed in the paper or online or whatever this is H what the city is 4:06 doing is a startup for the Arts commission and they they've made it very clear that uh they don't want to be 4:13 dependent on the city money it's just a startup and their their uh goal is to 4:20 bring more money in jobs and businesses into the city of Maran with the option 4:27 of having an Arts commission I I think it's a great idea I think they're established with the Kennedy's Art 4:34 Center I've known Wendy puffer for a long time and um I I just think that it's a plus plus for the city of Maran 4:42 to have that option to have the people that are dedicated to do this for the city of Maran so I want the public to be 4:50 aware that it's it's not your tax dollars just giving it away to the Arts commission these artists are going to be 4:58 trying to get uh grants on their own and bring other businesses and other artists to the city to make it better and enrich 5:07 our lives so I'm for this project too thank you so much councilman brener 5:15 you know I've been here 54 years and there was a time in downtown Maran where it was 5:22 just vibrating every Friday and Saturday night and we lost a lot of that and I think we're seeing under mayor Morell 5:31 that there's a attempt to bring Maran downtown back and I think this is another big step in the way of uh moving 5:41 forward with uh what we can do downtown with uh the Arts I think everybody understands I'm not I didn't hear one 5:48 person say anything about uh damaging um the downtown area with with an art uh uh 5:57 commission so um I would like to make a motion at this time toh pass this uh this ordinance uh uh on 6:06 um second reading this is already the second reading public hearing 6:14 yes so do you want to move this to a third reading or suspend rules I know yeah make it uh throw the rules out say a few things um I am in 100% support of this um the folks at Kenedy 7:15 Art Center Mac all of them are doing a fantastic job I'm excited uh I mean we featured um under a community Spotlight 7:24 a couple meetings ago um and I'm really excited where this position is going to go and kind of what vice president for I 7:33 said um it's kind of a seed money if you look at it in a way we're seeding the program this will help us establish an 7:40 actual Arts District which then opens us up for those grants that we're not currently eligible for and the return of 7:49 investment really is endless for years and years to come um I think it definitely could help with 7:56 tourism we have these River Rock Apartments coming downtown um there's just the landscape of downtown I 8:05 think in the next 5 10 years is definitely going to change drastically if not in the next year or two this is definitely going to contribute to that we have excellent people at the Marin 8:13 Arts commission that are so dedicated not making a dime off of this to really bring the rency back to downtown as 8:21 councilman Brunner said um the only thing and I've been on the record about it is as they know this person I hope 8:28 can raise the money to then self fund over time um I mean that's kind of the whole point I mean there's so many good 8:35 organizations in town um the other thing I'm going to add to that I is uh and I have to say this I've talked to the 8:44 mayor about it you know I have some concern so there's some current proposed legislation down state that could drastically impact funding in local 8:53 cities um and so if things change um then certain programs might have to get 9:00 cut or we have to find other ways to fund things so uh I don't say that to scare anyone I'm just being realistic things that are in front of us so whoever if this gets passed and 9:09 somebody's in this position um I hope they're Full Speed Ahead whoever you choose to find that funding um because 9:17 as I say what the government giveth they can take it and there's some current legislation right now that things could be taketh and um I'm just want to be 9:25 upfront and transparent about it um so I appreciate all of you coming and and support and keep up what you're doing and I think you guys are having um a 9:34 show this Friday too we'll talk out the end there okay that's all I had to say I appropriating certain funds in the amount of $2,200,000 from the general fund to 10:53 board of works for Capital Improvement mayor Morel has introduced a capital Improvement plan aimed at driving 11:00 significant enhancements across the city this strategic initiative focuses on addressing critical Improvement needs 11:08 identified within each City Department developed through close collaboration with department heads the 11:15 plan ensures that allocated funds are utilized effectively and efficiently to achieve the city's goals and priorities 11:24 speaking mayor Ronald moral Jr well thank you yeah thank you again um we've been at this now I think it's 11:32 probably week 10 and a lot of we had our budget committee meetings we had our one-on ones and we had all different things I first want to thank you all for listening and um taking part in this 11:41 this Capital Improvement plan this was a you know something that we wanted to kick off with um in preparation for this year's budget where we took over a lot 11:48 of capital outlays and capital um Capital expenditures out of the budget to make sure our budget was balanced and we wanted to come and present some 11:57 expenditures that we felt were were needed so we have the plan before you and U I think most of my team is here most of my team is here you have any 12:05 questions specific to uh that a certain ask in the department um and we would like to work together to move forward 12:13 thank you thank you mayor appreciate it again for the public's information I think we've had two budget committee meetings 12:20 uh this is obviously the second um reading so happy to have the council members either ask questions unless they want to wait until the public hearing is 12:29 over perfect okay all city any potential businesses or uh people wanting to live here or 13:11 whatever it's got to be a professional place you know and all almost all you like you said almost all your department heads are here and for the citizens that 13:18 don't realize this I'm telling you I see these people every day they work their tails off for this city and we got to get this city back in the way it used to 13:27 be um I'm 100 % for this Capital Improvement in fact I think there should have been more I think our furniture should have been replaced everything 13:35 because this is where it is it's like if you have a a a new truck and you send it in because you you want it to look the best if it's fairly new they're going to 13:44 do an oil change rotate the tires back there's not much of a cost but then if you have a 40 year old car which is what 13:51 we're in now you send it in it's going to be a lot more money to fix it now it'll look like that other one but it's going to take more money to fix 13:59 we are now at a point where it it's it's it's time to put up what we have to do 14:06 to get this place in order and and we owe it to all these city employees that are working their hind ends off every day and mayor you know he we first took 14:15 off you know kind of a thing with him and I said you know put the pedal to the metal and don't let off he hasn't he's working his his butt off and Robin and 14:23 everybody um we got to stay on this I'm 100% for this like I said I wish it had been a little bit more to be honest with 14:30 you um I I encourage my fellow council members just to pass this on because it it's time to get Maran back where it 14:38 used to be thank you councilman cill any other council members vice president for I 14:46 thank you very much and uh U I would agree with Brian on our uh our staff and our workers and our department heads and 14:54 our employees I think they do a fantastic job um and and uh I agree with the majority of uh this Capital 15:02 Improvement although I still have some uh issues with some things that I have asked some department heads to get me 15:10 some more information on and I don't have a problem moving ahead with it and I will continue I've been down to the bus terminal and I've been in the city 15:18 hall and the Controllers Office and I've talked to most of them I haven't got all of them I'm still doing research on some stuff and that's probably my fault if 15:26 it's taken me too long but that's just the way is I'm trying to be thorough so I don't have a problem on passing this on to third reading but I would 15:35 definitely like more time to go through some more things and talk some some more with some department heads on some of the expenditures that they have so 15:43 that's my feeling on that the rest of the council can uh do what they would propose to do but I would just like to 15:50 have just a little bit more time to do some deeper research on some big number items that uh I have some issues with 15:58 thank you appreciate that any other council 16:10 members uh councilman or vice president for I those particular items were there questions you wanted to ask while we're 16:18 here or anything we can they can help you with today well I I'd uh really like to get with the department heads on some of the issues because some of the stuff 16:27 I don't think that is needed that on some of the expenditures that I would like to see that if maybe we could work around that or or change some a few 16:35 things on that and I don't think that they some of the information I just still don't have on some of the the bids that I've 16:44 requested that I'd like to go over and look at on comparison on some things and for that I would like go to a 16:53 third reading on it I don't have a problem with the most uh 90% of the expenditure but there are some that I 17:00 still U would like to speak to a couple more department heads and get some more figures down to the netty gredy on it 17:11 okay so what you're okay you're you're in support of this but moving to a third reading is that what I'm hearing that's 17:17 correct I don't have a problem with that I think 2.2 million it's pretty big expenditures and I want to make sure all 17:25 the council members are are comfortable um and there's nothing necessar on that list that's pressing at this moment and Urgent um so I don't have a problem with 17:33 that but we'll leave it up to the entire Council on that any other questions all right I would entertain a 17:43 motion Mr President I'd like to uh fig we've like he the first one already would be the 19:44 conflict of interest disclosure acceptance of the uniform conflict of interest disclosure 19:51 statement GCA title is a locally owned title and Escrow Company in operation since 1947 six it provides title and 20:00 search services on an as-needed basis Michael Hots is the corporate Council for the city of Maran and has a 20:08 pecuniary interest in the company that predates his position with the city the enclosed conflict of interest form is 20:16 State mandated and has been disclosed and approved by the mayor this form was submitted to the mayor and Council last 20:24 year and is done on an annual basis no action is requ IR ired by the council other than to acknowledge receipt of the 20:32 conflict disclosure the form is filed with the state by the Controllers Office speaking corporate counsel Michael 20:40 Hawks good afternoon always a pleasure enjoy the hot seat sometimes today U here for questions I mean I 20:48 guess summary we um and did this last year was kind of an annual you know thing uh under the statute I think last 20:56 year we we had uh councilman for I had some questions about a resolution not really asking um that this year kind of 21:04 went back the drawing board looked at it I think the purpose today is just to just acknowledge that you've received the the conflict disclosure it's already 21:11 been made to the mayor he's already signed off on it and as a precautionary measure we we bring it from the council just because you you have the power of 21:18 the purse as well so happy to answer any questions council members with 21:27 questions I do have one uh and we might have answered this last year but um what so I know this a conflict of interest 21:36 disclosure um is there does a city have a contract with GCA title is there any kind of relationship there already uh no 21:43 it does not so the city is is free to to pick um title anywhere they they'd like 21:50 to to go for that so um yeah there's no no standing contract so it's just it's a 21:57 case by case uh deal it can come from uh various different sources I think Board of Works will be on um 22:06 they'll when they demolish a building they they'll do a title search uh for that and so they can go out and do you know appropriate 22:13 notifications there uh Redevelopment May order you know searches from time to time um I don't I don't typically have a 22:21 lot of searches that I necessarily um generate um but it's it's kind of an 22:29 autopilot thing I really don't even know what uh I think I saw some searches get order today from border works and that was probably coming from uh Board of 22:38 Works meeting on some demolition so yeah but there's no no contract it's just the market market 22:45 rate as far as the charges go great thank you appreciate that y any other council members vice 22:53 president for I so Michael when um when the title work goes through your company down there do you just 23:01 completely absolve yourself from that business of that property or abstain to doing anything on that since it's 23:09 involved with the city or do you refer legal advice to them on that or are you 23:17 completely absolved of it when your firm does the work like okay so you're saying like what's my level of you know involvement on the opinions sure you 23:26 know I my I guess my role there is is considered um on on paper the sort of operations guy but um I do have a title 23:35 insurance license but I don't I don't sign commitments uh that's um you know we have our order team that process that we have our own Searchers I don't search 23:44 the product they you know um Connie plumber and and there's two other Searchers take care of all that and then the examination team that's that's 23:52 really up to them to sign and give their opinion on that so yeah I I from time to time I may have a legal opinion on um it 24:02 would be more I generally get involved if it's a buy cell transaction that's you know not involving the city there may be some problems that need to be 24:11 resolved or some weird title issues but yeah with far things we really don't have that because I think the the title searches that are generally being 24:19 ordered by the city are just more of like give me a status of who the owner is what type of mortgages or leans or are against the property or incum is 24:27 those could be weed Le those can be judgments um they they generally do not access me access me for those those type 24:35 of things in that regard so yeah I mean as far as my I don't I would not say that I'm involved at that Gran level to 24:43 say issue this or don't issue that that's that's not really sort of my my role specifically with regard to the uh 24:52 the city surges so on the conflict of interest uh just kind of Define that for me on conflict interest if uh it it's 25:01 you or council person because we have to sign those agreements too so we can't financially benefit from any business 25:08 that we delegate to a business or a contractor or award contracts or approved contracts or so financially 25:16 that would be a conflict of interest to us what correct is that correct yes so a conflict is defined in 25:25 the statute if you have some sort of pecuniary Interest so if there's if there's some sort of um that can be ownership that can be Financial if 25:33 there's some way that somewhere along the way there could be some profit generated from uh any business you do 25:41 that's that's what the the state defines as a as a conflict that needs to be disclosed yeah and they say essentially if you don't disclose it it could have 25:49 criminal ramifications so which means I'm very particular about making sure that or at least ethics 25:58 yeah they've made a a judgment about you know ethics and and that so yeah it's not coming from an attorney conflict ST 26:05 which would be a different different thing that's yeah that's not what's um necessarily driving this this is more of the the statute 26:15 y all right well appreciate any other council members yep hope it wasn't too much of a hot seat for you but thank you for answering 26:23 all the question questions you guys are you know you ask great questions I appreciate it great thank thank you okay moving into our last agenda 26:33 item the general ordinance 42025 first reading an ordinance for parking in residential districts and the use of the 26:42 public RightWay the city of Maran proposes an update to the existing abandoned motor vehicle ordinance to provide for 26:50 enhanced enforcement through one greater Clarity in the definition section two 26:57 upd ated fines and fees and three regulation of parking in residential districts including alleys and streets 27:06 speaking corporate counsel Michael Hots it's been a long time back up here 27:14 again so uh I think just a brief I guess summary of of this I I 27:21 think it's been something that's been looked at over the last couple of years there's been tweaks at it it's kind of actually 27:30 a little bit of a a a complicated area to navigate for a couple reasons uh one is that we essentially have state 27:37 statute that that defines what you can do with abandoned Motor Vehicles whether that's in the public rideway or private 27:46 property but the definition of what an abandoned vehicle is and whether that can be in a particular property is also governed by our our zoning and you know 27:55 the the city has its own you know uh if Mike was here I think Mike was here earlier we have you know zoning maps that we've sort of planned out 28:03 commercial districts and and that changes what you can do in those districts so this is this is really just looking at residential areas and uh you 28:12 know as I was Maran city court judge for three years I saw a lot of these cases come through and we had some pretty robust arguments about what an abandoned 28:21 vehicle was and I I remember asking a JN one time he like well can you get in if I had the keys and how how long would it 28:28 take you to start this thing up and drive off and he said well I'd have to connect the battery and I had to put this thing and put a little air on the tire and and so we were having these debates right about what that looked 28:36 like so I mean that's part of the attempt here is to to Really Define what an abandoned vehicle looks like is it 28:43 operable or not and what's operable because I also had arguments with people sometimes it's been erect and the mirror's off and the tail lights out I'm 28:50 like you know part of being an operable is can you can you legally and safely drive it down the street would you be pulled over by police officer if you if 28:59 you tried to attempt to drive that vehicle right the CL cracked windshield I mean you can't yeah it still it operates it drives and so it's trying to 29:06 get at that the other component that we're trying to get at um is is with code enforcement we're having 29:13 you know some questions about you know um people want to take their front yard and just kind of drive a vehicle up on 29:20 on that right and so it's not really a driveway it's not it's not Concrete in it's not gravel it's not a defined barrier boundary and so we're having 29:29 those debates a lot of times in Code Enforcement like hey well it's fine to like well it's really just your yard you're just parking in your front yard right or we have some backyard issues 29:38 too people just you got two or three vehicles in their backyard so um we're trying to clear that up and also try to 29:45 simplify the ordinance and so we think we've got a great effort here we we brought together uh and really kind of 29:53 went line by line we brought the chief of police in brought Robin and code enforcement and and Mike graph and we literally went line by line to try to 30:00 give us a good faith effort to address some some issues and I think it's been in committee at one point in time and and took that there so uh that's that's 30:08 kind of the intent uh of the ordinance and what it does and and it's kind of a demand from our our code enforcement and provide some clarity uh I think the the 30:17 last ordinance we looked at said you could only have street parking for 24 hours I don't think anybody probably intended to only have 30:24 24-hour parking some people in the city it's the only parking they have is on the street so that's that's pretty limiting so that's what you have there 30:32 happy to ask answer some question you guys may have thank you for that appreciate that any council members 30:38 questions councilman Cowgill uh I appreciate you Michael talking to me today I had questions on a this 30:47 ordinance and I got them answer before this meeting and I appreciate you getting with me on that yeah thank you I mean it's you know I I told the mayor 30:54 the day like I If you tell me the result that you want or how you you know kind of want it drafted I'm pretty good at getting you there but I I don't make the 31:02 calls you know as far as street parking non street parking front yard backyard um so I'm more of a scrier there but so 31:10 it clearly defined objectives help so I appreciate that great thank you any other council 31:18 members start on the very end and go around a council Runner um it just seems to me Michael that the last year to two years I've 31:27 really seen a lot of what you're trying toh take care of here um people parking uh I I know there's one 31:36 situation a block and a half from my house where a person is parking in his neighbor's yard um backyard parking um 31:45 you go by some houses and they have a car halfway sitting out in the street so I think this is something that really 31:53 needs a good look and I'm glad you you put this together and we we hopefully can uh can it it it it just really I 32:03 think hurts the omnience of a city when you see abandoned vehicles or vehicles that are just people just park them there to 32:12 park them there so thanks for doing this for us sure thank you vice president for I yeah thank you 32:21 Michael I'm just I'm just curious um why didn't we know about this the the council or the code enforcement uh I 32:30 mean that you said that you had the police department and traffic in on it but nobody from the council or code 32:37 enforcement committee was notified or I mean do you think we should have been in on those meetings or got this a little while ago or had a committee meeting 32:45 before you brought it before the council because we we've been through this this ordinance has literally been rewrote 32:52 five times we've had judge hunt has rewrote it under Al ball twice you've you've rewrote it once or 33:01 twice and redlined it but we always had committee meetings I'm just curious because I didn't know anything about this ordinance it wasn't brought to my 33:09 attention and I don't think the chairman of the code enforcement knew anything about it did you Andy we didn't no we didn't see anything beforehand so I mean 33:17 just to throw it on us right now I mean I'd like time to read it and go over it and discuss it or I mean because the 33:25 last time we had combined residential commercial and me and you had talked about that and we had to take that and throw it in the trash because legally 33:33 you can't have residential L commercial on the same ordinance and we were going to refer back to state statute on 33:40 Commercial correct and rewrite the residential yeah I I think that was attempt uh at the time to try to 33:48 simplify and I think that was kind of coming out of the building department to try to you know I think from a code 33:55 enforcement standpoint it's you got think about job they go out and you know they see a vehicle and then that may 34:02 have had a spot zoning or a variance and then it's right it's a commercial residential and they kind of go back to the maps and so I think the intent there 34:10 was to try to make it easier so they just hey we're just targeting abandoned vehicles that are trashed out vehicles that are there and I think what we 34:18 encountered there is and what I alluded to it's a little more complex in that it's just not a great way to try to combine it uh into into one ordinance 34:27 you know to do that that and so that's when so the idea of just kind of scrapping and leaving commercial for another day to look at um and and that's 34:36 that's what we've done here we've kind of taken out the commercial language and just kept it focused on residential neighborhoods so as far as the process 34:44 hey you know the mayor wanted to get something going and you know and and so I you know I act and we we get it get it moving here but I you know I know you 34:52 know if he was here he would I know just left here you would say hey welcome input so I don't I don't think it's a thing to try to force on you I think 35:01 it's the idea that's been batted around for a little bit it's been with us for a while and I think it was just initia to try to get us get us going down range a 35:08 little bit on it and um you know code enforcement's asking for it and they want to see some progress on it and give 35:15 them some more tools there so um yeah I I I I I think because we did get the redline version last night there is a lot to go through that but too there I have some concerns 35:55 on the change of language that you can't park a boat or a recreational vehicle on a road 36:01 anywhere um in my neighborhood sometimes that's all you got there's no yard there's no well can't put put them in 36:09 yards right and there's no driveways I live in a very urban area and have concerns with some of the language on that so I just want to be able to Hash 36:16 that out and I mean as of right now my recreational camper is parked on the road 36:23 um so I just think there's some things we need to ha shout on that language and it's fully functional operational I do 36:31 move it um and sometimes it's parked in my driveway so that could be for the committee meeting um so I'm I'm in favor of sending this committee um just 36:40 because I think there's quite a bit to hash out and I didn't have a chance today to go through it all since I got it last night I appreciate you sing it 36:48 last night but one day wasn't enough for me to go through the red lines um but any other council members questions 36:59 if you'd like that in a form of a motion I'm willing to do that Mr President I don't think it's required um 37:09 because we haven't passed it yet so I'm just going to say well we'll send it committee um so the committee it would go to is 37:16 back to the code enforcement committee Andy wht's a chair of that and then the two other members are Gary fores senior 37:23 and Erica dine um so I would like to see that go to committee and just hash that out out 37:30 um I just think the collective in the room I think would be beneficial so just asking that you could have that committee meeting before the next 37:38 council meeting absolutely that would be great and um you know I'm I'm happy to attend you 37:47 know I I've been in out of that thing a couple times now so I think I know my way through it and can help you we'll make sure you're on the invite list yeah 37:56 yeah and I I do think it helps you know uh counil mcal go asked a question today and I think sometimes like the law and 38:04 and facts right like you read the law or the ordinance and you go oh yeah it makes sense and then you start asking questions about like well how does it apply in this case I think those are 38:12 healthy conversations um to have because it'll it'll it'll refine what your intent is as as you go through that 38:21 so well it's this the fine line of those people that don't abuse it and the people do abuse the rules and and find 38:28 loopholes and I appreciate all the work you guys done done to and as Vice President fores says has been changed so many times and I don't know if it'll 38:36 ever stop changing um but I think having a conversation a little deeper on what's been changed I think would be beneficial 38:43 what we even found is actually the last the codification we have right now is not the actual I think correct ordinance too there was one that was passed mayor 38:52 alot that uh never got codified so we we did catch that it was a markup somewhere and just never got sent over so 39:01 um well I mean just it just you know I think it's just one of those things sometimes that we' watch those so yeah happy to participate answer any 39:09 questions great and the hope is that maybe we can get through it in one meeting and bring it back but again if it takes more than one then we'll we'll go as long as we need to to get it 39:18 hashed out so I appreciate it so councilman Whitten will
