as for Community spotlights I really try 6:54 hard to diversify the types of spotlights we do different types of businesses 7:00 um and uh for Aaron and then service master Total Restoration contractors 7:07 might be our first contractor um at least since I've been on the council so you know it's a small business um 7:14 located right here in Maran uh 230 West 2 Street U most people may not even know it's tucked down in there um it's kind 7:21 of like on a quiet street down there but uh there's not too many construction businesses that specialize in emerg 7:30 response and Emergency Restoration uh actually I will say I think service master is the only one I know of that's based in Marion um there 7:38 are others that are outside the county but um Aaron has made Marion her home and is a small business now service 7:46 master is a national chain name but it's a franchise but really it's a local business it's Total Restoration 7:55 contractors so um I know Aaron I've known Aaron for a long time and has a great reputation taking care of 8:03 customers uh and really you know it's maybe just um coincidence with these nasty storms that are coming through or 8:11 about to go through uh service master restoration uh actually specializes in those disaster responses so if you have 8:20 um you know the roof blow off your house or your house burns down or something that's very catastrophic uh that's a lot 8:29 of what they specialized water leaks um so yeah so we're just happy to have you here tonight um the fact that you have 8:37 chosen Marin stayed in Marin and can I tell them where you're moving to yeah so another exciting announcement is so you're all probably familiar where heart 8:46 shoes used to be and they retired so Aaron has actually purchased that building and is going to be used not moving the whole business there but 8:54 they're going to utilize both buildings so the current location on Second Street is just going to be more warehousing and then the location on um State Road 9 9:03 where heart shoes will become more of like their offices and and customer facing office so um it's exciting you 9:11 know it's just an expansion having two buildings now and um you know a little more visibility too out there on the on the bypass so uh thank you for coming 9:20 tonight do you want to share any words say anything I appreciate you having me tonight you can just stand just St okay 9:27 me um like Nick said there are storms coming uh if we're needed we don't ever want to be needed um but if we are needed we're 9:36 available 24 hours a day seven days a week was a good sales pitch that was good thanks uh I will say just in my 9:45 line of work outside of here um finding good contractors um is sometimes very difficult and contractors that will 9:54 communicate and stay on top of things and um I know Aaron and service master do a fantastic job um you can have the 10:02 best Carpenter contractor in the world but if they don't call you they don't communicate um then they're no good so um I just I applaud Aaron and Service 10:10 Master uh I know she really really believes in you know having a good reputation and working with customers to 10:18 make sure that they're taken care of because if you've never gone through a catastrophic event like a house fire or 10:26 uh your roof blows off or something catastrophic you have no no idea how much of a pain it is um to restore back 10:33 to what it was and having a fantastic contractor right here in Maran um we're really blessed to have her and her team 10:40 here um right and the tonight's Spotlight is on Brian merer he's the RightWay supervisor and I want to read 12:34 uh that's kind of an abbreviated um message from Mike grath but I want to read the 12:42 full the full message here so Mike graft who is our director 12:51 of planning engineering and traffic wrote uh dear President McKinley I would like to formally request the city council recognize Brian merer for an 12:58 employee Spotlight Brian merer has been part of the engineering department family for one year this coming April but in that short time Brian is excelled 13:07 in learning his role as the rideway supervisor having entered his position in April there was a rather large workload that was already stacked up in 13:15 our busy time of the year Brian jumped in and began learning on the Fly he never gave up and would work hard on things that he had very little time to 13:22 learn to help represent the engineering department Brian helped steer the engineering department into the world of AI I he learned how to use equipment 13:31 that allows our department to uh assess the streets for our asset management requirements and would work diligently uploading this data every day to be able 13:39 to have um it ready Brian has been able to work with the city council he has made it easier for citizens to work 13:46 through our 50-50 sidewalk program using budgeted funds as well as contacting council members to allow them to help 13:53 contribute with funds allocated to them for this program Brian go and come on up while I'm reading wherever you're at 14:01 uh Brian has built relationships with other Departments of City Hall as well as the Maring utilities and has been able to work alongside the crews on 14:08 issues with water and sewer Brian deals with citizens on a daily basis helping them with permitting for rideway work or 14:16 dumpsters as well as offering assistance when they have concerns for street lights sink holes patching roads or inquiries into projects the engineering 14:24 department is currently working on Brian is committed to serving on the traffic commission as well as the plan commission as a liaison for the engineering department and a little 14:33 known fact is Brian has recently taken on the role of chaplain for the Marine Fire Department and he's currently working with the fire department to be allowed to be on the fire sight 14:41 locations to give Comfort to the firefighters as well as family members that may need his support I have no doubt that Brian takes this role as 14:49 serious as he does his RightWay supervisor role and our firefighters are in good hands Brian is one of the most dedicated employees I have had the 14:57 privilege of working with and many times he has worked through lunches to assist the citizens in closing I would pray that everyone would be as lucky as I 15:06 have been to have the privilege to work with Brian merer thank you again for allowing me the opportunity to present Brian merer as our city employee 15:15 Spotlight so Brian we just thank you so much for all the work you've done I can just say for myself um you know I didn't 15:22 realized you started last April I would have thought you've been here 10 years the way you've been working I had no idea um because we started doing the 15:29 50-50 sidewalk last year and um you know there's a bunch of council members nine of us up here that you've got to kind of 15:37 ma manage Who's got what funds and you've done a fantastic job working with all of us and really seeing the vision 15:44 of getting uh people's sidewalks repaired replaced so that's just from I'm sure I'm speaking on the rest of the council members um keeping things 15:52 straight and um and really connecting our residents with all of us to make sure that they're getting some match to 16:00 that 5050 um and so we just really appreciate you and I know Mike obviously had excellent words to say so anything 16:07 you want to share tonight I I just want to thank you and thank Mike um he's a great leader uh so 16:14 I've got a I've got a great teacher um I think we all know the difference between a boss and a leader bosses come in in the morning and give everybody a task 16:22 and they kind of disappear in in the day and and expect things to get done and they and they look at the now we leaders 16:29 kind of Empower and Inspire and and coach and um Mike's Mike's just been a great leader for me uh in this position 16:38 and and a great teacher and uh it'll be hard pressed to replace that guy when he when he retires um not allowed to yeah 16:46 that's what I told him too but we'll see um so I want to thank him for for putting me up here because I really don't I'm kind of humbled by the whole situation um because I work with a lot 16:54 of great people in this building that all do a wonderful job and been doing it for a long time and so I hope that their supervisors 17:01 will uh step up and and nominate them soon um and then all of you know uh I'm 17:08 I'm not shy about sharing my my testimony and my and my faith really want to give glory to God because 17:16 um he he he puts me in all the places that he puts me and he gives me the the tools that I need uh I strongly believe 17:24 in Colossians 3:23 says uh do everything you do as if you were with all your heart as if you're doing it for the Lord 17:31 and not for man um and that's the way I go out all that I do and I've been very successful in everything that I've been in because of that and it's all because 17:40 of God and um and this this role in this city um I'm just I'm excited to be part of this team because of what's going on 17:48 around us um I see a lot of great things going on in this city uh I think we I think we take diet boner he's a a German 17:58 philosopher and and pastor and and he had a quote that said people's love for their idea of community will destroy 18:05 Community but people's love for each other will create Community um and I see a lot of that going on here um we're out 18:13 trying to make people happy and and doing the right things um so I appreciate all you guys for what you're doing appreciate Mike and the people I work 18:21 with we appreciate that it definitely deserves a round of applause it's people like we need more people 18:30 like you and I know we have a lot of people in and around the city that work for the reports none okay we're going to move into 22:22 unfinished business uh General ordinance 5-22 amending ordinance 3-2 2024 second 22:30 reading and public hearing an ordinance fixing the maximum 22:37 salary of appointed officers and employees an annual payment of flex dollar $250 to non-contractual full-time 22:45 employees of the city of Maran Indiana for the year of 2025 Marian Police Department is taking the steps necessary 22:52 to modify our current model for the civilian security Personnel in order to increase the safety of staff and citizens who enter City Hall from 23:01 employing all part-time positions to a model that funds two full-time positions and three part-time positions speaking Mary and police chief David 23:09 Gilbert well you changed yes I have go sorry about my voice if you want to introduce yourself for for everyone 23:17 at home I'm the deputy chief of uh in charge of the Patrol Division for the mar Police Department Chris Bute um I'm 23:23 standing in for the chief right now um council members council president thank you for allowing me to represent the police department regarding this 23:31 ordinance to modify and improve security measures at city hall building if you have any questions I'll be glad to answer 23:39 them any council members with questions before we go to the public 23:47 hearing I think we're good thank you thank you so we will officially open it up for the public hearing if you would 23:55 like to speak on this please make your way up to the podium welcome if you could just state your 24:05 name address and you have three minutes hi um I'm Karen Cree I live at Ironwood Drive I don't have a problem with the 24:13 added security I just have a qu few concerns about the program in general uh one of it is not clear to me uh are 24:21 these individuals that you're thinking of hiring are they going to be in addition to the gentlemen who already are assigned this building is this going 24:30 to be an addition to them or will they be replacing them I wasn't sure how that was working if this is going to be an additional five to whoever is already 24:39 assigned to this building going forward the other thing I was kind of questioning well not questioning but 24:45 concerned with is police chief Gilbert indicated he wasn't sure if this was going to be work out the way they think 24:53 it will it may not be adequate or whatever what is going to be the measuring stick to determine whether or not this is what you want to continue 25:00 going forward into the new year is there going to be a somehow to evaluate it and who would make that final determination 25:09 that it's going to be picked up and carried over into the next budget hearing on the 2026 that it's just not 25:15 going to be a test program going forward um so I was kind of concerned on how you're going to evaluate whether or not 25:23 this is really the answer to your security dilemma the other thing I was kind of wondering about as well is right 25:31 now we seem according to the chronicle I brought it so I refreshed my memory on the numbers that we seem to 25:37 have extra money in the current budget that we're operating the city on in order to hire them going forward right 25:45 now and if you don't continue it going in 2026 for whatever reason how do you 25:52 fire them I mean once you bring in security is it easy just to say we're just going to go back to the old way 25:59 and how are we going to pay for it going forward I know that I don't know if we'll always have a surplus in the 26:05 budget so what is the what is the plan on how we're going to pay for it if it becomes a permanent part of the budget 26:14 or permanent part of the police department will the police department have to make a cut that is counter it so 26:22 the taxpayer doesn't get a increase in taxes to cover this are these people going to be able to do be utilized 26:29 someplace else in the city as well if they're so we get double information you know double security out of them other 26:37 places when this building's not being occupied and I was concerned with how we're going to pay for it is there going to be budget cuts I mean all the 26:45 Departments have to say we have to cut whatever the percentage is mathematically to cover the 26:51 $39,000 going forward in the 2026 budget I understand we can cover right now but I don't know what that window looks like 26:59 is that 6 months from now 9 months from now you know is it going to be guaranteed uh employment for x amount a 27:06 months before you finalize it to make it permanent I mean how do you advertise or Market it if you're struggling to get 27:13 people to apply thank you your time is up appreciate it all right public hearing is still 27:23 open if you'd like to speak make your way to the microphone 27:33 not seeing anyone last chance okay I don't see anyone else making their way to the microphone so we're going to close the public 27:42 hearing so I appreciate any of the questions and input and Chief Deputy Chief if one could one 27:49 of you come back up so I'm going to give you an opportunity 27:59 if with some of the questions or whatever was stated if you want to clarify some of that that's up to you so 28:06 with the um two full-time positions uh that will allow us to retain uh some of the individuals that we have now and 28:14 also make uh the security position more attractive um I'm in charge of um the 28:21 hiring of security um I take all the applications in uh do the interviews uh 28:28 set them up with polygraphs and determine whether they're hirable or not and we haven't had many applic applicants and I think this would make 28:37 it more attractive and more consistent as well um right now if we had two uh or even 28:44 one person go on sick leave or call off it'll it'll uh minimize Staffing we wouldn't be able to um staff the city 28:53 building with two officers which is needed one to uh man the front door door and the metal detector or the weapons 29:01 detection and then the other to do roving patrols just to check on each uh area of the city building all right great thank you and I 29:10 just wanted to add because I know we talked about this last meeting the first reading uh when the chief explained some 29:17 of this too um in reference to the how do we continue forward into next year uh you know I did address that with the 29:25 chief about continuing to pay that into next next year and as long as he was willing to commit to um adjusting his 29:32 budget so it fit within his budget numbers then we could continue that position um because we we want to pass another balanced budget so did get the 29:41 commitment from the chief and the police department that they would adjust their budget where needed to uh accommodate 29:49 for these positions right is that correct yes okay um yeah that's just all I wanted to add and kind of address some of the 29:57 questions um and then so for clarity for people at home or listening so we currently have 30:05 how many part-time so right now we have four that are part-time and then 30:12 one that kind of does part part-time um so if we made two of those 30:20 positions full-time um then we'd have to hire another one uh to fill the last spot 30:29 so we have four part-time one really part-time so five total right now five total yes and then we're going to go and 30:37 this is going to take us to well would take us to three but the one we have one we have an individual that's leaving uh 30:46 at the end of the summer so we'd have to fill her position so how many will we have any part-time left or is this all full as of right now no we would not so 30:54 this is going to all fulltime correct two two of the two of the positions will be full-time and then we'll still have three that 31:03 will be part-time gotcha and the three that are part-time are they going to have less hours or they going to have the same amount of 31:10 management report 32:55 requirement for the Maran RDC Tiff areas and speaking tonight it's going to 33:02 be Greg balsano from Baker Tilly welcome hello thank you for having me tonight 33:10 and adding me to the agenda my name is Greg balsano with Baker Tilly and we help the RDC with the annual reporting 33:17 requirement for the dgf April 15th Tiff management report um this is a report that was based on 2024 information so 33:26 all prior your reporting and is due to the council the RDC the mayor and the dgf Gateway site uh before honor before 33:34 April 15 and so today this is a presentation to you guys as the council um your this is this blue presentation 33:42 here in front of you um again as uh council president mentioned there is no vote necessary this is for informational purposes I'm happy to answer any 33:50 questions as I I kind of walk through this here um the tip management report where we're at with the reporting requirements is again this April 15th 33:59 report uh there are a few other requirements the RDC has to handle each year this is one of the first ones and again this is a uh presentation 34:07 completely on prior year information U if you go to slide three this is a a chart just of how kind of a 34:15 a simple chart of how Tiff operates and just want to give a a brief overview with Tiff you'll have two types of areas an economic development or Redevelopment 34:24 area and then the allocation area the econom iic development or Redevelopment area is the boundary where the Redevelopment commission and City can 34:32 spend money spend that Tiff money within in serving or benefiting on certain types of expenditures the allocation area is either that same boundary or a 34:40 smaller boundary where the Tiff money is actually generated with Tiff Tiff is a capture of the incremental assessed value that is 34:49 generated over time after a tiff area is created so when a when a tiff is created the net assist value of all of the parcels within that allocation area make 34:57 up what we call the base assessed value that base assess value is taken forward and is trended up or down each year the 35:05 value up and above that the incremental assess value so what those Parcels increase to that is the incremental assess value that's multiplied by the 35:13 tax rate to generate the money for the Redevelopment commission and City to use on various Economic Development purposes once those Tiff areas expire 35:22 the incremental assessed value will then flow back through to the overlapping tax units 35:31 what is the purpose of Tiff so Tiff is really to finance incentives or infrastructure needed to induce private investment uh to en encourage orderly 35:40 growth in targeted areas um to redevelop blighted areas one key item is a business or resident who sits within a 35:48 tiff area still pay property taxes on their new investment and without kind of doing some research you likely wouldn't not even know you are in a tiff area 35:57 because you pay property prop tax is just the same as everybody else Slide Five shows the the Redevelopment commission members who sat 36:05 on that RDC during 2024 um we had Darren ree was the president uh Nick McKinley vice president Deborah Kane secretary Trent 36:14 Daly was a member Kiren Montero was a member and Mr Richard Hart was a non- voting Schoolboard 36:23 member slides six and seven cover each allocation area and when those areas were created and when they are set to 36:31 expire in total the city of Maran and RDC has 16 different allocation areas and those make up five economic 36:40 development or Redevelopment areas and you can see on these sheets 36:48 that these are established at a variety of points in time I'll give one example the Emily Flynn Redevelopment area was established back in 2010 and we'll EXP 36:57 in 2036 expiration dates differ based upon when these Tiff areas were established where we sit at today when a tiff area 37:05 is established it expires 25 years from the date any debt is incurred from that that Tiff area at different points in time there was regulations on tiffs had 37:14 30-year lives 25e set lives and so it just really depends on when those areas were 37:22 created slide eight covers the finances of the Redevelopment Commission for 2024 in total for for Tiff was collected 37:32 of about $8.45 million that you'll see there um throughout all of those Tiff allocation areas with expenses of just 37:39 over $4 million of those expenses a significant majority was spent on debt service payments so debt that was previously 37:47 issued for a variety of projects um of that four million about 3.7 million was spent on debt service payments whereas 37:55 the remainder was um various professional fees and pay as you go projects and 38:03 such slides nine and 10 go through those expenses in detail which bonds what 38:10 payments were made on which bonds um and again slide 10 kind of showing the total expenses of just over $4 million with 38:18 about 3.7 of that roughly coming for Debt Service payments on bonds that were previously issued again to do a variety of projects 38:29 slide 11 covers the fund balances of the Redevelopment commission um at the end of 2024 so the Tiff allocation fund had a 38:38 balance of $9.9 million just just over $9.9 million but I want to clarify that that that is not the true balance of the 38:46 area necessarily because when Tiff revenues come in in June and December the debt payments are usually do and typically do within that next month so 38:54 in January U debt payments went out to make those um to make those debt payments so that was the balance at the end of December 39:01 when the Tiff rers were received there were a portion of those debt payments then again that went were paid in 39:08 January the other funds that you see listed are various reserve and bond funds those exist with those Bond issuances a Debt Service Reserve fund or 39:17 DSR fund is a fund that is required to be maintained in case there was an Ever issue making a bond payment that fund is 39:24 there to help make that Bond payment if some reason re didn't come in where expected and those are required to be maintained through the life of the bond 39:33 issue but then it will be the redevelop commission's money to either pay those last Bond payments or to use again for the general Tiff 39:44 purposes slides 12 this covers all of the debt and the debt payments that were made in detail 39:51 um I do want to point out you you also show the total payment and interest outstanding principal and interest a few of the larger Bond issues are Developer 40:00 purchased obligations and so I want to point out specifically um the 2013 Cafe Valley bonds um the 2012 GM project and 40:10 the 2023 um Thompson American resources bonds those are paid from developer specific allocation areas and what that 40:18 means is that what goes to those bonds is only what is collected from that Tiff so if there was a situation where not 40:25 enough Tiff is collected to make those those Bond payments the city is not on the hook to come up with money from other Tiff funds or elsewhere to make 40:33 those Bond payments so while you see for example the cafe Valley uh 2013 about $16.5 million of outstanding principle 40:41 and interest again what is paid is just what is left over what is collected from that area so if there is not enough to 40:48 make those Bond payments there it's not a default of the city um and by any means it's not required to come up with additional money to make those payments 40:55 so those are again what what is called developer purchased obligations and you can see there's a variety of maturity dates of those bonds 41:04 bonds will start to expire really in 2031 and 2032 is when you'll start to see some bonds fall 41:14 off and that's really a summary of the presentation again that was all 2024 information um last year was the first requirement where this had to be 41:21 presented to the council so this is our second year presenting this this will be uploaded to the dgf Gateway point portal um where this will go to the dgf and and 41:30 the public can view pieces of it as well thank you so much um hopefully everyone understood all of that there's 41:37 a lot of complexities the Tiff areas and uh um but it's a it's a appropriation 3-22 city of Marin opioid settlement unrestricted 42:40 first hearing an ordinance appropriating $30,000 to the opioid settlement for the 42:48 use of combating the opioid epidemic this additional appropriation of $30,000 will afford US the opportunity to hire a 42:56 consultant that would equip the city of Marian with the knowledge and strategies strategies needed to effectively allocate settlement funds to use for 43:04 program support and Community capacity building speaking city controller Dana 43:15 G good evening welcome thank you I sent out a packet did everyone 43:23 receive their packet awesome does anyone have any any questions turn your mic 43:33 on about the packet or the additional appropriation any questions yeah I've got a question on 43:40 the additional appropriation um why do we need to have a uh 43:47 consultant because a consultant can go to attend meetings in our community do a community needs assessment to see what 43:54 the community needs are attend the meetings with the county um and see what we need to spend our money on so they can get a um there are they would be our 44:03 legs and feet in the community to see what what's needed in the community but why what why can't we do that who can do 44:10 that the city I know who the city Administration or part of the administration or part of the council people why do we need a $30,000 44:19 consultant well that that consultant can will have the skills to go into the community go to different agencies do a 44:27 assessments see what's needed attend meetings and be able to send a report back so that at the end of the year when I have to do a report I can report on 44:35 what what what the com you know the consultant did sure but is that and what we would do isn't that ult ultimately 44:42 going to be left up to um since it's unrestricted funds isn't that going to be left up to the council and the 44:49 administration ultimately I mean he's going to bring back recommendations but I mean a lot of these can go towards law 44:56 enforcement or I mean i' I've got the packet from the state also on what the restricted and unrestricted uses are well and this would be unrestricted and 45:05 that that person would create a committee and you're welcome to be on the committee I don't know who you know um but that person would Comm create a 45:12 committee and then in that committee they can make recommendations on what and where the money should be spent or who we donate the money to and then the 45:20 committee comes back or the consultant comes back to the council and so it'll be a whole process so have have did you 45:27 put out a you know a notice to hire Consultants or I mean how'd you come up with the 30,000 and where's the 30,000 45:35 coming from the unrestricted unrestricted funds it'll come from oh this just says an an ordinance appropriating 30,000 to the 45:44 opioid settlement that's what mine says okay so are you taking it out of the 45:52 unrestricted funds yes and putting it in you're using the unrestricted funds to hire a consultant yes okay this says 46:00 you're taking it out of the opioid settlement funds opioid unrestricted yeah mine says that you're appropriating 46:06 30,000 to the opio opioid settlement so if I could excuse me one 46:13 moment if I could add we do have the full appropriation and it on the full appropriation it does list the opioid 46:21 settlement unrestricted fund request I think it's just like vice president president for I it was the way it was on the 46:29 agenda could be a little confusing but the specific written ordinance appropriation does state it properly 46:36 just want some clarity on that sure but it says it's it's an additional appropriation 46:46 also is any of the orid settlement um is it actually budgeted or is it just sitting there and it needs to be 46:54 budgeted it's sitting there it needs to be budgeted we need to put it in our in our budget and so this will this uh uh 47:01 contractor this contracted person will see what's needed and then we know what to put in the budget we know what to come before the council and ask for if 47:09 if this consultant is uh going to find out that um we're GNA you know help radiant health or something like you know I don't know and then they'll come 47:18 before the council and say you know um we're asking the council to approve um 47:25 so much funds to help ABC agency so much of the restrict unrestricted 47:34 funds so do you have you already hired a consultant no how'd you come up with the 30,000 we used other um I talked with 47:41 the attorney and we used other um templates for our other contracted people and so we use those templates to 47:51 hire this contractor so we don't know we don't we don't even know if this is enough or right not enough enough or 47:57 right too much or right I mean I I mean we went through this with the co money 48:04 and arpa money we never hired a consultant so I mean we we didn't need to and it it was a lot more strenuous 48:12 and restricted than this so I I don't know why we need to hire a consultant if because I've got I've got everything from the state and also got your packet 48:21 which I appreciated very much but I mean it it's pretty cut and dried as far as what we can use it for and what we can't use it for but I don't know why we need 48:30 to hire an additional consultant and take it out of the unrestricted money to tell us what to spend the money 48:37 on when we've already got the money sitting in the account I think that we could form a committee and we decide that with with the administration and 48:46 and the council I mean we've got our attorney we've got City attorney to make sure that we do it in compliance with 48:53 you know the rules and restrictions of the opoid settlement but I I don't know why we need to hire a $30,000 consultant 49:00 to tell us we should spend the money on right and we've had the money sitting in there since what 2022 and we've not done anything with 49:08 the money that's the first that's been brought to us okay I first I've earned about you I didn't I knew we got it because I got the notice through through 49:17 the state when we got it but that's that's my concerns on on hiring a consultant to tell us how to spend the 49:24 money on unrestricted question uh just for 49:32 clarity uh the total funds restricted and unrestricted I the math shows 1.78 49:40 m550 120 does that sound right yes okay and just I'm sure people were probably wondering what are they talking about so 49:48 um there was a huge lawsuit um Indiana received over 980 million in a settlement with a lot of the big pharmaceutical companies 49:57 um in relation to um just opio addictions um you can Google it and find out all the information you want but 50:04 essentially there was a settlement 980 million it is divided up amongst communities Maran received 1.78 50:11 million um 336,000 that's considered unrestricted which means there's no 50:18 requirements we can use it as we see fit as general fund as general right and then the 842 th000 there are specific 50:26 requirement you have to use it for otherwise you're out of compliance and and we have to follow the rules on that 50:34 so I just wanted Clarity for those watching those listening what's going on it's um it's unfortunate that we this lawsuit 50:43 had to happen um but I'm glad the settlement's there and my hope is that these funds can be used to um help 50:52 people either prevent addiction or get off addiction and if it saves even one life right um then it's worth it so just 50:59 wanted Clarity on that any other council 51:12 members okay I would entertain a motion 51:33 yeah Mr President I move that we um under vegetation from growing through the ground prevents alley dust and promotes cleaner environments additionally paved 58:38 alleys help local businesses increase property values and create more sustainable attractive Urban spaces for residents and visitors speaking council 58:47 president Nick McKinley thank you um I know this one is um going to be a little more 58:56 complicated in the last um essentially last year we had a discussion about this when we were allocating arpa money for 59:04 Alleyways um there were some presentations of how much how far the arpa money would go towards Rock um 59:14 completely repaving down to the the core the bottom or just resurfacing and so we were presented that as a 59:22 council um I mean it's my opinion that every Alleyway or almost every Alleyway should 59:30 be paved that's why we're here today why I'm presenting this um I just felt it was appropriate that this has a a vote 59:36 on the council as different District representatives and at large um I have heard plenty of negative feedback about 59:44 converting them to rock I know there's at least one other council member that has some had some negative feedback and I just felt it was appropriate to bring 59:53 it to the council to have this discussion uh hope everyone had an opportunity to read 59:59 the full ordinance and I am going to read that since people can't see at home 1:00:07 or may not have it in their hand right now because I want to make 1:00:14 sure we set a baseline here and I will say with this ordinance I am open to amendments I just 1:00:22 want this to be a discussion My Hope Is that we could pass it today that doesn't necessarily mean that that's you're 1:00:29 going to be your final vote but I my request is that we at least get it to a public hearing allow the public to have some input on this and give you an opportunity to go through it and if you 1:00:38 have any proposed amendments or changes we can sort through that but essentially the ordinance goes through some definitions defining the uh different 1:00:47 words used but essentially it says uh the city shall allocate funds for Alley Paving through General funds grants special assessments or any other Serv 1:00:56 the city May establish cost sharing programs with property owners who applicable the engineering and traffic department shall develop a phased 1:01:03 implementation plan prioritizing high traffic and deteriorated alleys some exemptions uh alleys deemed unsuitable 1:01:10 for Paving due to environmental or structural concerns may be exempt upon upon approval by the city engineer and a 1:01:17 resolution of the Maran common Council um 1:01:26 and then so requirements all existing unpaved valys with within the city limit shall be paved with rolled asphalt 1:01:33 within 10 years of the adoption of this ordinance I'm open to that I just put 10 in there if we want to do 15 I'm I'm open to all of it um newly constructed 1:01:42 alley shall be paved with rolled asphalt upon completion of development the city engineer shall oversee and approve all Paving projects to ensure compliance 1:01:50 with City specifications and Property Owners shall be notified in advance of any Paving projects affecting a and properties it's essentially everything 1:01:57 that's in this ordinance so um open for any discussion or input or 1:02:04 thoughts Mr President if I may I I I have had several constituents um call me 1:02:12 up upset that they had paved Alleyways ground out and put gravel put in there in District Five within the last month 1:02:20 or so um and they indicated they were putting together petition because they're very upset about it they're they're worried 1:02:28 about gravel and Longevity and dust in the summer and a lot of the stuff you mentioned in this ordinance so I am 1:02:35 definitely uh in favor of sending this to a public hearing and uh long term I think having them all 1:02:45 paved would be great but it's going to be very expensive to do the whole city so that would be my 1:02:52 concern Mr President if um Mr graph do you happen to have what this would cost 1:03:00 to pave every alley in the City by any 1:03:16 chance at the the various options remember uh I kind of handed the handed 1:03:23 this material out so uh probably not new but just more refresher for everybody so 1:04:05 I thought I made enough copies but I didn't you yeah I can you one you add an extra one I thought I 1:04:19 made did you have questions councilman calar you just wanted to read through it well yeah I just want to be respectful of your I appreciate that um so we have 1:04:26 I see here because I couldn't remember all this Mike I appreciate you getting this for us so we have 463 alleys at 1:04:34 $20,000 an alley it's going to be about 9.2 million almost 9.3 million that would PVE every alley in the city 1:04:42 then so if we did over 10 years what is that just under a million a year if you did 10 but again I'm open here's the 1:04:51 thing is that um my if you could just come to the mic actually we have some questions for you 1:04:58 Mike is our city engineer so I mean he's very pivotal in this had couple discussions with him but uh essentially so a lot of our 1:05:06 alleys that are paved when were those originally put in under mau's Administration and 1:05:13 unfortunately uh when we when they were done they were done by the street department at that at that point uh the 1:05:21 they bought a uh a p or they bought a grater a p and a roller uh trained a few guys on how to use the 1:05:28 equipment the unfortunate thing was is that they basically graded the stone that was there and just put an inch and a half of asphalt over top of stone 1:05:37 longevity wise that'll that's never going to last so that's what kind of has brought us to where uh we are today and 1:05:45 over the last years uh we really haven't allocated any funds other than patching um this this is probably the most that 1:05:53 we've ever done with alleys since I've been here um other than I mean obviously I was here with uh with Mai when he did 1:06:01 a substantial amount but he didn't do them all uh there's still probably I'm going to say maybe a 6040 uh that's 1:06:09 probably got 40% got done with asphalt there's still a lot of them out there with stone um and the the the 1:06:18 conversations that uh that we've had over the years is uh even the the ones that got done done by the mai 1:06:27 Administration again the base material was bad it was never never repaired so you may have some asphalt that looks 1:06:35 pretty good so we try to go out there case by case and and see which ones are the bases are failing you may have some soft spots in it so it kind of takes 1:06:44 some time to to look at all of them uh and as I uh talked to you last year my 1:06:51 intention uh was never to just like every one of the alleys are going to get stoned uh there are still some decent 1:06:59 alleys out there that that can be overlaid um the big concern with just overlaying is drainage um if you just 1:07:08 take what's there and you add another inch and a half of asphalt now you probably are putting water in the back 1:07:14 of somebody's garage um because they're not lower most the most of the properties are lower than the alleys and 1:07:21 then you you keep adding to that mix and you're just going to run water off a lot faster uh so trying to 1:07:29 maintain drainage is an issue it's always going to be an issue it doesn't matter whether I take it all the way down and put in a brand new base it's 1:07:37 there's just no place to drain alleys it just it's always goes into somebody's garage which is unfortunate but um it 1:07:44 was just that you know it was access points uh streets were narrow that was a way to get people off of narrow streets 1:07:51 and you know we've changed philosophies over the years and you don't have alleys anymore you just in subdivisions there's 1:07:58 no alleys everybody has driveways and so you know whether it's myself or the next 1:08:05 Administration and the next engineer and and these folks that are going to look at that this is always going to be a problem uh it's going to be a Perpetual 1:08:13 problem and uh even if you were to go back into the alleys that we've already 1:08:20 started we we've done quite a bit in gares and then we kind of moved our way down into Andes 1:08:26 area um if if we put this on paper in an ordinance fashion the only concern that 1:08:34 I've got is that we're we're we're kind of doing a mandate uh and now do I need to fall back in and where I've where I've got 1:08:42 Stone now we're digging all that up I don't know I I'm gonna leave that to you guys I I just don't know so so I'm go 1:08:51 ahead I just have one more thing I said so roughly I'm just using a 10 year that you had in there so that's 46 alleys a 1:08:59 year is that feasible time wise and everything else wise as far as with the the streets that we have to pave every 1:09:06 year as well and I I guess it's it depends on the contractors you know if um uh I mean I didn't get anybody that 1:09:15 wanted to even bid I I had one contractor that that bid this that to do the stone um most 1:09:23 contractors their machine are too big they don't you know trying to get down some of these alleys I mean we start looking at some of these alleys and and 1:09:32 the stone or the the asphalt's not the problem it's the overgrowth and you can't get a trash truck down these alleys so you know you got to really 1:09:41 look at it as a holistic you know approach to these you know that we're hoping that with some equipment that the 1:09:48 um code enforcement just bought that we can go in and shave back some of these alleys uh but you know yeah it's a small 1:09:56 amount you know and you know I've heard well we don't have to do them all in in one year absolutely I don't even know 1:10:02 that we'd get 46 done in a year that's I just don't know because it's if you've got guys that are out Paving and it's 1:10:10 the same group that's that's Paving a street that's and Paving alleys you're trying to split those Crews up so I you 1:10:17 know it's never a guarantee uh it would be put in the specifications that if that's what we chose to do that they'd 1:10:23 either have to hire guys to to to hit that amount uh but then you know ultimately as the world revolves it 1:10:32 revolves around the funds you know and how do you where where those funds I mean to do what we're doing now and I 1:10:39 and and and tell President McKinley reminded me that that the money came from arpa right this the 1.1 so you know 1:10:47 which was a windfall I in in a in a sad State as you talked about the opio opioid money but in a sad State that's 1:10:54 where this money came from so in the future where does that money come from uh you know I've always had coners 1:11:02 conversations with councilman um Klein about wheel tax and I would I would constantly saying guys this is coming 1:11:10 the state is going to force our hand and the now it's come they're they're basically telling us if we don't do a 1:11:18 whe tax um locally the community Crossing dollars that we've been getting for the last several years will will dry 1:11:26 up so uh I don't know where the money's going to come from that's you know I don't the administration is going to have to look at what what they have the 1:11:34 ability to do uh and then you folks you know when we sit down to budget time are going to say we're going to allocate 1:11:41 this amount of money to do it so I mean it's if it's $200,000 and that's all we can afford then that's what we'll go out 1:11:48 there and use for that particular year so go ahead councilman BR we'll start left 1:11:57 to right um I take it that we have to 1:12:03 decide are you going to do this in each of the wards because you have six Wards 1:12:09 and so in you're going to have uh to decide which of the wards need the most 1:12:16 work correct secondly um are streets more important to you 1:12:24 than alleys because well I mean streets are always important actually if I if I had my choice between alleys and streets 1:12:32 I'd probably put alleys and side or sidewalks probably before I put alleys because I think that we have a a a very 1:12:39 poor walking system throughout the mar throughout the city of Maran I I mean there are people that I know I've Got Friends that that have alleys and they 1:12:48 got to get to their garage but I have I see more people that are trying to Traverse in uh uh either in handicapped 1:12:57 Scooters or Wheelchairs and you can't get down our sidewalk so I mean if I had if I had a choice that's where I would 1:13:04 put the money between sidewalks and streets and to be fair for each of the uh uh members of the council who have a 1:13:14 ward would it be fair that each of them get x amount of dollars for their for the six Wards well there are some wards 1:13:22 that don't have very many alleys in them okay I mean so you know try to do it proportionately wouldn't work because let's say you know I'm in Council wht's 1:13:31 area that majority of his has alleys but then I me in your old you know District there's no alleys it's all subdivision 1:13:39 so yeah trying to proportional eyesee it it's is rather difficult thank you sir yeah vice president 1:13:46 Force thank you so um Mike right now the wheel tax money is going for streets 1:13:56 correct that's to subsidize our grant to do the 3 one 1:14:03 million in streets yeah so yeah there so the max amount that we can get is $1.5 million from the state so I I use uh I 1:14:12 allocate the wheel tax is that's where it's always GE that's it's geared towards the community Crossing First Street then then local Road and Street 1:14:21 and either C CCI or CCD funds or some MBH funds but that number is I don't use it for anything other than the match Grant 1:14:29 right so I guess my point is that um we have to use the wheel tax to match the 1:14:36 grant for us to come up with the money to match the grant correct which is 1.5 million we've got to take out of Mo or 1:14:44 the highway Street Highway and we have to have that wheel tax to help with that to match that Grant and and so right now 1:14:54 proportionately you're getting from the wheel tax you're getting what the county allocates because it's they they started 1:15:00 the wheel tax so if we add another portion the city's portion of uh will tax that their portion is still not 1:15:09 going to go away you'll add on top of that so so you would have just throw a number out there if you get an additional 1:15:17 $600,000 then you'd have 1.1 million of wheel tax but if you still want to go after Community Crossing you're still 1:15:24 going take that 500,000 out of it so you'd end up with 5 or 600,000 sure so the only way I mean one of the 1:15:32 possibilities is if you cut back on the amount of streets that you paved on the grant you might be able to use some of 1:15:40 the wheel tax for sidewalks correct correct which I agree with you our sidewalks are horrendous we never did go 1:15:48 through with the the last appropriation we were going to do 700,000 sidewalks we couldn't do that we had to use it for 1:15:55 streets right so um in a great day we cut back on Street 1:16:02 Paving and fund sidewalks or alleys because we're not going to come up with an extra million uh for just alleys in 1:16:10 the next future that I see unless something drastically occurs the property taxes are going down already we 1:16:18 know that for a fact so um the my my other point on this on this issue is is 1:16:25 that I don't think that we can do a mandate and require that all the alleys 1:16:33 in the city has to pave all the alleys I just don't think that we can put that as a mandate 1:16:42 that's not financed I mean you know the state can do mandates and the federal government can do mandates I don't think we can 1:16:50 mandate into 10 into 10 years that you're talking about f future administrations have to allocate for 1:16:58 that if they do alleys it has to be paid I'm I'm not sure that you can do that we've been through this before um back 1:17:06 when Jess alall was in and we were told we could not do that to a future Administration is forced them on a 1:17:15 mandate financially and their budget to do something I I could be wrong that'd be in the attorney's um realm but anyhow 1:17:25 on the first appropriation that we uh approved for this through the arpa which was 1:17:32 1.12 million or something that contract was already been signed and I know that we have discussed 1:17:39 this and some some alleys you are going to pave they're thorough fars and you're going to use that money to pave some of them that need to be paved and I've also 1:17:47 talked about this with you and um Donnie Scott the contractor some of them can't be stoned because the incline the slope 1:17:55 is too great and they have to be asphalted so part of this money is going for asphalting some of the alleys correct 1:18:03 correct and I know nxs is a thorough far they use it all the time so and that's 1:18:09 it's not in terrible shape but and you said that some of the asphalt alleys that weren't in real bad shape you were 1:18:17 going to go ahead and pave those and keep them paved and then we have some alleys that are brick right so wouldn't 1:18:25 want to Asphalt over those until they until they just become deteriorated to the point that that you can't do anything with them but going back to the 1:18:33 last appropriation that we appropriated I do know for a fact uh that that is that appropriation is 1:18:41 incumbered for what we appropriated it for which we picked option number one on this we did not pick an option we just 1:18:50 appropriated the money which was option one one 1.12 five we appropriated the money we didn't pick an option that was 1:18:58 we left it up to city engineer so okay yeah and I mean and Nick Nick I I would 1:19:04 say is personally right it was my interpretation that that the mayor wished to use the $1.1 million and do as 1:19:14 many as we could with stone to get as many of the alleys but I during the conversation I 1:19:21 also stated uh that there are times where like you were talking about we will not be doing Stone we just you just 1:19:28 don't have any choice so that's why when we quoted it out we asked for those those options okay similar to what you 1:19:36 see there okay and because we came in uh with the the amount that we could do pretty much the 1:19:44 majority of them in stone that's that's the main option that we used even though we knew we would have to do asphalt 1:19:51 which in your in your ward uh there are several that we did stone that we know that we have to fall back on to do 1:19:58 asphalt sure and so anyhow on on the encumbered appropriation um when we did 1:20:05 that and you can correct me if I'm wrong we the the mayor and you put a stop to this work you told them to we just 1:20:13 paused hold on so we paused it we until we knew what what direction you folks wanted to go okay but don't you already have a signed 1:20:22 contract with a vendor on that I do okay and the money was already encumbered so on the encumbered appropriation is this is what I found 1:20:31 out that has to go to that contractor that vendor the money that we 1:20:37 appropriated for that work so okay I mean that's why I I just don't want to get ahead of things with 1:20:46 the with the appropriation we've already and it's encumbered into the Appropriations and it's assigned to that 1:20:52 vendor to do that work now it it's up it's up to Mike on what allies he does 1:20:58 what with that contractor and and again I I I'm trying to be I'm trying to work with everybody as 1:21:07 as well I can I know that Andy's gotten some concerns uh I mean it didn't get confrontational but it it it got a 1:21:15 little vocal between a contractor and a homeowner on what we were doing I ultimately I'm the buck stops at me I 1:21:22 make that decision uh so I don't ever let my contractor to be the guy that just says well I'm just doing it and you know the heck with it I we looked at the 1:21:32 alleys we chose the direction to go with with every alley that has been done at this point and again we're not it's 1:21:41 we're not doing everything in stone that's that that we're we're so but I also want to be mindful of the of the 1:21:49 folks uh that are concerned about um you know grass I mean obviously I you know I would love to be able to say that our 1:21:57 our street department would go and spray grass you know I I can't guarantee that I know that they have it grer and they can grade it we can we 1:22:06 can keep a better upkeep on Stone um but I mean it Stone's Dusty um you know you 1:22:14 get in you get a dry period and it's going to be Dusty then it gets wet uh one thing I can feel a little bit more 1:22:21 comfortable about when I do stone is if I had an air area that was holding water uh or or flooding a garage the 1:22:29 likelihood of it happening with stone is not as great because it's going to absorb the water um yeah is it is it NE 1:22:38 I mean would I want to drive a brand new vehicle down no but I'd rather probably drive a brand new vehicle down something 1:22:47 that doesn't have a 8 inch ptle too so so and I understand Andy's uh 1:22:53 constituent and I understand um um President Nick I understand your concerns with that and everything I just 1:23:02 don't know that we can do a mandate that any alley that's done um has to be asfa 1:23:10 for future administrations and stuff as far as budget budget wise I mean they they would 1:23:20 actually be required according to this all existing un paved alleys within the cendy limit shall be paved with 1:23:28 assault within 10 years of the adoption so you're forcing the other administrations to pave the alleys I I 1:23:36 don't think we can do that legally we we were faced with this before I said I don't think that we can 1:23:43 force new administrations a mandate to pave uh all the alleys yes you can the council has 1:23:52 the ability to set the standards it's up to the Administration to uh figure out how to both uh accommodate that within 1:23:59 the budget and to uh and to administer it so it's something that can be done the wisdom of it is a different story 1:24:06 but it is it is something that this council could in fact pass um but I'll leave it as to the council as to the 1:24:14 wisdom of that sure I understand that so real quick vice president pise so 1:24:21 section five subsection one I'll read it again Aly deemed unsuitable for Paving due to 1:24:28 environmental or structural concerns may be Exempted upon approval by the city engineering resolution of mar Count Council I don't have a section five on 1:24:36 that but it was in the packet that was emailed all of us so section five subsection one um I got section 1:24:44 four there not printed it yeah I got it but it's it's in there I I see that there was a lot of work put into this I 1:24:51 give Marty a lot of credit uh we look that a lot of what other cities are doing we pieced it together we tried to be fair I'm open to the 1:25:00 10e um you know the other discussion that hasn't been had is what's the expense with raking filling with the rock there's so many variables to this 1:25:09 sure I'm asking for a plan like that's what it says in here there should be a plan no different than we do our streets 1:25:16 in order to be uh eligible for the community Crossings Grant we have to submit a plan sure and I believe our 1:25:23 alley should have a plan as well because I do live in an area that's very Urban and I probably drive down my alley a 100 1:25:32 times more than I walk on my sidewalks and trust me I'm a sidewalk guy I want them all to be nice but these alleys 1:25:39 especially in the heavy traffic area and there's also a discussion I've had about trash trucks um there has been some 1:25:46 discussion with it was last year about the possibility of utilities contributing so the Alleyways that they 1:25:53 are driving trash trucks down maybe they could contribute know that discussion hasn't really been had um because those 1:26:00 trash trucks are doing a lot of wear and territory alley so if we put Rock in an alley and then we start driving how many 1:26:07 ton tra uh trash trucks down the alley and we get the four inches of rain that we're supposed to get this week what's that alley going to look like in a week 1:26:16 then we got to send out somebody that we have to pay a salary for find the truck and the Rock we don't know we too many unknowns of what this 1:26:25 Rock's going to look like let alone look at the screen behind me so before I ever present something I've done a lot of homework so uh Google Maps and street 1:26:33 views as my friend I literally went to about every Community within a 75 mile radius and Google mapped their streets 1:26:42 and the only one that I could find that pretty much all their Alleyways are rock is Muny Indiana every other community 1:26:49 paved and I mean I stopped after taking like seven screenshots I was like okay I've been through the city this is what 1:26:57 their alleys look like this is a rock these are urban areas and so Mike you made the point about overgrowth is our 1:27:05 big problem so if we think overgrowth is a problem going over paved wait till it's rock you're going to have in growth it's not only going to grow over but 1:27:13 it's going to grow in just like this and so that pavement actually helps keep some of that to the side and I agree we 1:27:20 should maintain those alleys and trim them back there are exemptions we we can do an exemption here if somebody's got a Brick Alley 1:27:28 there's a couple over in my neighborhood um there's just so many concerns I'm not saying it's it here's the thing this is not a one-sized fits-all right and and 1:27:36 that's what I'm that's why I'm asking these questions yeah I agree I would love to be able to pave all of them if if we had the extra funds and stuff I'm 1:27:45 just I'm just the questions that I'm asking is just that I I need to know so I can explain to my constituents and stuff so you know if if we get the funds 1:27:53 and we've only got $500,000 to do alleys who picks the alleys of where the I know you take the worst ones and you pay 15 1:28:03 alleys because we've only got x amount of dollars so who who gets them just the worst ones or the most needed ones and then the rest of the alleys don't get 1:28:11 done and doesn't don't get any maintenance so that that's some of the questions that that I have because we're going to be limited on funds I mean 1:28:20 unless we get a a windfall which I can't I'm not seeing right off the bat but and then and then another question I have it 1:28:27 it on uh section five paragraph two it says Property Owners May request variances based on financial 1:28:35 hardships so and you've got a cost sharing so are you saying a homeowner can help 1:28:44 pay to pave the alley so above that it it basically says it allows something like like that to be 1:28:53 implemented that's something we've seen in other cities I'm more than happy to amend that and rip that right out of there however if we put in there that 1:29:01 that's something that could happen adding section 52 just kind of elaborates on that they may request the variance based on 1:29:09 financial hardship if that were to be a program their alley done kind of like a 5050 if we were to go into a cost 1:29:16 sharing model yes it just this just allows that discussion it doesn't require it it's just if the option comes open we have it and we have some defined 1:29:25 rules so so if they have an alley that needs to be done and they're they're going to put gravel in it right now the 1:29:34 homeowners can get together and say hey we'll do 50% for the asphalt if you asold it and the city does 50% I'm just 1:29:42 trying to figure out how it works so I don't have that plan that's why in section four subsection three it says the engineering and traffic department 1:29:49 shall develop a phase implementation plan prioritizing high traffic and deterior alleys what I'm asking for this ordinance is to set the tone to put a 1:29:58 plan together and to figure that out I don't have all the answers I'm just asking to get those answers through this 1:30:05 type of an ordinance um there's just there's so many unknowns with the rock I get it talking about the wheel tax sure 1:30:13 I mean we're going to be forced I bet we're going to be forced to implement a wheel tax I hate to say that but it does actually offset what we've already been 1:30:22 putting into the matching fund for Community Crossing so let's just say we get 800,000 extra possibly in the wheel 1:30:31 tax well that's 800,000 a year that then could be used towards alleys and sidewalks and to really rebuild our infrastructure because let's just be 1:30:39 frank our infrastructure here other than streets we've been getting that grant money it's been deteriorating and so this is part of that process that extra 1:30:47 wheel tax that we are going to be forced to do by the state can be used to help fund this and whether we stretch it out to 20 or 10 but here's the thing you 1:30:56 know there's also the assumption that we've got to pay them every 10 years or every 20 no it just says they shall be paved within that x amount of time we 1:31:05 have Alleyways now that have been there since the ma Administration that don't need touched I I showed that yeah at the last meeting we at the last meeting we 1:31:13 had uh last year we I showed plenty of alleys that are in excellent shape so I 1:31:21 just don't want to go in this going oh my gosh we're going to spend all this money how we going to pay for this I'm asking let's figure this out let's come up with a plan because I don't want to 1:31:29 look like muns Indiana because if I have taxpayers that are saying I'm paying money into this wheel tax and my alley 1:31:38 looks like that what do I say yeah you know I know it's just not a priority sorry we'll get to raking that soon and we'll dump some 1:31:46 more rock I'm not ready for that I'm not ready for that and and it's not Mike's fault necessarily it's just money hasn't been appropriated in the past I would 1:31:55 say it it was just a lack of funding or a lack of helping him fund that and make it a priority I'm saying it's time to 1:32:03 make these alleys a priority in some neighborhoods it doesn't need to be because people don't use it but in my neighborhood and in people that live 1:32:10 around me and in District Four and District Five these more urban areas and even district one these are our main thorough fars I drive down my alley 1:32:18 every single day and I'm not I I mean if they put Rock in my alley I'll drive down on it but it's not going to last 1:32:26 and there can be a plan for these high traffic alleys that the traffic the the 1:32:32 trash trucks you use maybe those end up getting the option three where they remove all the way down and we do it 1:32:39 proper the first time because if they're done right the first time just like our streets then it's just an easy grind 1:32:46 down go on top of it again for those super high traffic areas and we can come up with a plan and that's all I'm asking 1:32:53 for is a plan um to to get our Alleyways straightened 1:33:03 out so that goes back to um we've we've done a lot of alleys in the stone already so and I know you've got some 1:33:11 constituents that are very unhappy and you said they're going to sign a petition what does a petition involve I'm not sure they're they're 1:33:18 just upset because they felt like they had paved alleys that were in decent condition and they got ground out and gravel was put in and they understand 1:33:26 they are very upset so they were wanting to get their alley paved that's what they want so they want 1:33:34 to they want to go back and take all that stuff up because you can't asphalt over that grindings in stone because 1:33:41 it's not a good enough subbase so they would have to go back and then then we're going to uh a different price per 1:33:49 square foot on that plus the removal of what we have if we decide to do something like that yeah they I think they just felt like they 1:33:58 went backwards because they don't want to deal with the dust and they had a paav alley and now they're they're back to where they were in the 70s or 1:34:06 whatever so they're upset sure sure and I agree 100% I'm just 1:34:16 wondering what the cost is going to be if you know something like that would occur you have to go back because after talking to you know the contractor and 1:34:24 stuff I asked him could you just go back in and asphalt over that because of some of your concerns and some of my constituents and he said no no that's 1:34:33 all got to come out I got to bring in subbase compact it roll it then bring in binder and asphalt and you know you're 1:34:41 talking you're back up to I don't know 14,000 1:34:48 or 20,000 an all so that that's just what I'm getting to it if if something like this is going to have to be dealt 1:34:56 with I mean Mike what I again that's why I'm on pause because I obviously I'm in that's that's 1:35:04 the area that I'm in right now and if that's the that that is the conversation that's being had I I really don't want 1:35:12 to do what I've been doing putting putting in stone and then have to fall back again I so I'm just I really right 1:35:21 now I'm just at a standstill sure because isn't that go going to involve a different contract with a vendor well he's already got again he bid it all 1:35:30 it's just the price will change on the activity that he has to do to which will affect the balance of the remainder of incumbered appropriation corre correct 1:35:39 okay councilman Kaine thank you Mr graph my question one of my 1:35:47 questions I have several I didn't know our alley uh refurbishing was on 1:35:56 pause that kind of disappoints me as we're not moving forward I understand why it it it is but uh I think we need 1:36:04 to move forward I like the idea of leaving it up to the 1:36:11 administration and the engineers office on what alleys are stoned and which alleys 1:36:19 are paved and I think the city has a lot of wish list our constituents have a lot 1:36:28 of wish lists I have personally a lot of wish lists for my own life but we all have to 1:36:38 live within our means and I think a mandate to pave every alley or almost 1:36:48 every alley in the city of Maran becomes unaffordable especially at as we move forward in the next several 1:36:55 years when we know our tax revenue is going to be a lot lighter coming in to 1:37:02 us um another question I have Mr graph if we pave these alleys and we 1:37:12 create a a pond or we have water running into uh garages you create all kinds of 1:37:22 issues I I think we're wow I think we're opening up a real can of worms that we're going to be getting a 1:37:30 lot of phone calls on especially your office and saying you've created a nightmare for me um water's coming in my 1:37:39 garage now it's 0 degrees out I can't get my garage door up because it's froze shut with three inches of 1:37:47 water and you cause that problem by pav in that 1:37:54 alley and it's your fault now how is the city going to correct that and what is 1:38:00 that going to cost us um so boy I just have a lot of reservations about moving 1:38:10 forward with with a with a mandate that requires every alley to be paved when I 1:38:17 think we have a good plan in place and the expertise that we have in the engineering's office 1:38:26 to make that decision on which alleys to pave and which alleys to Stone if you Stone an 1:38:34 alley and you do it properly that can last a long time um so I I guess that's my thoughts I may 1:38:44 have more later on but uh I I'm super super concerned about mandating and the 1:38:51 monies that is going to take away from other project within within the city to pay alleys it 1:39:01 certainly takes away from sidewalks and that's what a lot of us ran on when we 1:39:07 ran for political office is fixing sidewalks and so I think wow I think 1:39:14 we've done an excellent job this Administration has done an excellent job on Paving 1:39:21 streets last year three million next year $3 million um if we can and and we're putting money towards sidewalks wow I 1:39:30 think we've made great great strides I think we ought to stay with our original plan thank you 1:39:39 so President McKinley would you have an issue with sending this to committee and let get sitting down and and getting a 1:39:48 plan and and seeing that it's it's it's implemented and and instead of just mandating that every alley in the city 1:39:57 be paved I mean could we just sit down and like a committee meeting and budget meeting and have everybody give all 1:40:05 their input and get with Mike and see where we're going to be at financially and I mean I I I agree with with a lot 1:40:13 of stuff in here on some of the alleys I agree with I I agree with uh councilman Kane I agree with councilman Whitten but 1:40:23 I just don't see mandate and every single alley has to be paved in the city of Maran so I mean I don't have a 1:40:30 problem with you know going by the recommendations of the engineer or a constituent or or a council person in 1:40:39 his Ward and then hashing it out that way um I would love to take it to committee and and hash it out and get 1:40:47 everybody's View and opinion and instead of just trying to pass a mandate requiring 1:40:55 it well I appreciate that um I really like the Mandate word really sounds rough and tough um this is an ordinance 1:41:03 we are the legislative body of this city and we are representing our people I just passionately believe that 1:41:12 if we're representing a district or the entire city our people deserve some representation on how their alleys are 1:41:20 let alone their streets um um councilman Kane brought up the 1:41:27 flooding we've addressed that gives it out give out for engineering issues we can go 1:41:35 out the flip side of that is as an insurance agent I think about all this 1:41:41 rock okay rock goes it trust me when you put Rock in an alley it's going to end up in the road and you get somebody 1:41:48 driving a Harley or a bike or whatever and they slip on that rock are we then liable then I don't know there's you can go back and forth there's liability all 1:41:56 the time trust me the city gets sued all the time from these billboard attorneys no matter what you 1:42:03 do I see it we get it so we I feel that this was well worded 1:42:13 to give an opportunity to adjust and when it comes to exempting alleys I keep hearing 1:42:21 constantly we're mandating all the alleys uh section five exemptions and 1:42:29 variances I've addressed this unsuitable for Paving it just needs approval by the city engineer of course 1:42:37 he's the one that's going to bring it to us and a resolution because if the city Administration wants to tear up and 1:42:45 replace 10 alleys and put Rock in it in District Five I think councilman Whitten should 1:42:52 have a in that because it's not councilman Whitten having a saying it's his district he should be able to go hey and 1:43:01 go to his neighborhoods and go just so you know they're looking at putting Rock here what do you think and then he comes to the council 1:43:09 meeting and says I've talked to my constituents and they really don't want this and then it's all his job to 1:43:17 convince the rest of us to vote no or to vote Yes right and so that's where I think that represent representative process because this is a big deal to 1:43:26 some people if you don't live on an alley that you navigate every day you maybe don't understand but it is a big deal our alleys are deteriorating 1:43:33 because there was not a plan in place what is the plan moving forward with rock do we have one and I'm not putting it all on you Mike you're just doing 1:43:42 what you're given right we got all this chunk of money to replace them with rock okay do we know how much that's going to cost next year the following year the 1:43:49 following year we don't have a plan I just think a plan even if we were to go with rock we still need a plan we have 1:43:57 to have a system in place because this is the way this is how we've gotten to where we're at this is why half the alleys have potholes in them because there wasn't a plan or there wasn't 1:44:06 funding and there wasn't a mandate to say our alleys are a priority I'm saying our alleys are a 1:44:14 priority no different than our streets and no different than our sidewalks I know I'm I'm I'm sounding passionate but 1:44:21 I am because I don't want our alleys to look like Muny and that's the bottom line I I don't think this needs to go to 1:44:28 committee I think if this I mean you could go to three readings that's six weeks I think that's plenty of time to come back have a discussion I have given 1:44:38 outs for all of this that's needed it gives Mike the opportunity to come to us and with one resolution and list as many 1:44:45 allies as hey I've got this year you can come to us in in February I don't care hey these are the ones that I would like 1:44:53 to do a rock this year and list them all in one resolution and then we have an opportunity as council members to go to our districts and go you know what 1:45:02 everybody around here is not happy with that so that's where I'm at with it I think it belongs to the people to make that decision I get the money concerned 1:45:11 we're going to be forced to do this wheel tax that wheel tax is going to give us more opportunity to replace it and if we do it right and we have a 1:45:18 pothole fund because some of the problem is is we're not filling the potholes in the alleys we're putting Rock in them well and then by the time you get two 1:45:26 rains now that pothole is three times the size so even the plan would say we're going to appropriate x amount of 1:45:33 dollars to fill potholes who's filling the potholes right are we Outsourcing it can we do it in house and save money right now we're Outsourcing right 1:45:41 correct that seems kind of pricey we have equipment to do it in a house right I don't Street Department street department has equipment is it being 1:45:50 used no correct we have the equip so again this just goes back to alleys are priority this is saying these are a 1:45:58 priority if we take care of them right just like our roads and we fill the potholes the way they should be they're going to last us a lot 1:46:05 longer so I've just asked for some consideration like I said even if you have a yes today I'm not I don't assume 1:46:12 that you're just for it I'm asking this to go to a public reading and this is even one I would say let's go to the third reading and then that third 1:46:20 reading that' be the final vote after we've had time to talk to our constituents time to do the research time to go look at other cities call other council members in other cities 1:46:29 call other Mayors and say hey why aren't you guys doing Rock and you know what they're going to say our resident is goingon to be poed because are we moving 1:46:37 forward or we moving backwards we want nice things right Maring deserves nice things this is nice things our taxpayers 1:46:46 deserve nice things and they deserve Alleyways that are navigable and they're going to last and that I rest yes uh 1:46:54 just a quick Point um I was I was out of town when you guys worked on my alley so when I came home it was completely done 1:47:02 um and it was previously paved um and now it's Stone so honestly I was like okay a little 1:47:10 disappointed that it wasn't paved again however you you all did such a good job and it's so compact use a steamroller on 1:47:18 top of it it's hard as concrete to walk on and I don't know what it's going to look like a year from now now but as a citizen like I say I was personally 1:47:26 disappointed that you didn't repave it but it was in sad shape and uh I was thrilled that it had been improved so I 1:47:35 think the bottom line here is that we need to have some uh priority to maintain the alleys now whether it needs 1:47:43 to be paved or not I think is open to consideration and and I think the biggest thing we got to do is just make 1:47:51 a priority to maintain them because if my alley had been maintained over these years it wouldn't have gotten like it 1:47:57 was and I think as part of the main maintenance is just not the the ground but it is the overgrown stuff because 1:48:05 there are some volunteer trees and like an unimproved alley that I have that I'm going to go over with a chainsaw and cut them down because I know what's going to 1:48:14 happen if I don't and I would like to have seen that done as part of the process but I know you can't do everything so I feel like this is 1:48:21 something that we need to focus on um but I'm not sure I agree with them having to be paid and again if I had my choice mine 1:48:31 would have been paid but it wasn't so I was still thrilled that it was improved so that's the way I feel I have one last question on there was brought up about 1:48:40 the encumbered money so how much money do we have appropriated for rock and how much money 1:48:47 do we have in cont let's say contracts how much money left do we have to spend in cont contract for rocks versus Paving 1:48:55 so it's so when the when the bid was bid there's there was a stone item there's 1:49:02 an asphalt item so it's it's it's up to me if I say we're going to do that one 1:49:09 in asphal so when I when we originally did the 1.1 it's it is not it's not 1:49:16 black and white that says I've allocated $800,000 for stone and $300,000 for for because you just don't 1:49:25 know until you start I mean but by the time that I finished Gary's and start moving there the the conditions always 1:49:34 change uh but bottom line is I still have roughly $550,000 for the remainder of the season 1:49:44 um because that was my commitment to you folks that we knew we wouldn't get it all done last year when we appropriated 1:49:52 money we did do work throughout the winter when the conditions were favorable and that that I would do 1:49:59 everything in my power to um to do what was requested of the 1:50:05 administration uh so I'm at $500,000 but you're saying there's no contract that says you have to keep doing Rock no no 1:50:14 thank you that mean he he's he'll get his 500,000 whether you do rock or whether you do asphalt it's it's irrelevant to him so he's going to get 1:50:23 his money I I'm just trying to spread the dollars appreciate that I just want to Clarity thanks yeah councilman 1:50:29 King I agree with Mr for I um I think this needs to be put in committee what 1:50:37 what I would like to see is this held on first reading I'd like 1:50:45 to see this move to a committee that's made public by saying such everybody's 1:50:53 invited to a public meeting or a committee meeting but I'd like the the public to be able to speak at this 1:51:01 particular committee meeting prior to bringing it back to the Council on a first reading so we can 1:51:10 iron out all the particulars 1:51:15 on mandated non-mandated stone versus Paving make the committee meeting 1:51:23 totally public with with comments thank 1:51:29 you I think that'd be an excellent idea president councilwoman 1:51:36 Divine and I think what um councilman Kane said I have to agree to some degree 1:51:43 with that as well um as I'm listening to everything and hearing the back and forth it is an important ordinance and 1:51:51 if it's something that we going to do and it's going to have a timeline whatever that may be I feel like there's been other things we've done that we've 1:52:00 kicked to committee at this level because there was enough conversation that the language may not be 100% what we want and I really feel like that's we 1:52:09 need time yes you've been working on it quite a while but this is the first time it's been brought to us this week or Thursday we've had less than a week with 1:52:17 it to look at it and to think about it and I just feel like we need to have more time and we need to 1:52:24 have time for that public input and I'm not sure two weeks coming up to a public hearing is enough for me to decide if I like the language or if we're going to 1:52:33 adjust somewhere um so I agree I think it needs to go to committee and just have a little further discussion on it 1:52:40 so I'm not opposed to the committee um but I will say What's the difference between going to committee and go to a second reading 1:52:48 public hearing where we're going to let people speak publicly once that public hearing is done then we can go to 1:52:56 committee we can send it to a third reading you know we have a lot of options there and I'm I'm I'm not trying to be argumentative I'm just trying to be a procedural 1:53:05 like more more people pay attention and watch their eyes on a regular council meeting um and so it just you know I how 1:53:14 do we get the word out I mean we would need to advertise really heavily to get people out there to come to a committee meeting regulate it set times and the 1:53:24 rules and and so I'm not opposed to it I just I go well I mean a second reading public hearing kind of allows it so I 1:53:33 mean tell me otherwise I try Council McCain so yeah I think there's a lot to 1:53:39 this there's a lot to this ordinance and this is millions and millions of 1:53:47 dollars and this is important and I feel that having it put in committee with comments 1:53:55 from the public they may come up with some ideas that we haven't even thought of so 1:54:05 um that doesn't that doesn't deter from then having a second reading and public 1:54:13 hearing because I think it's important but I think it needs to go to committee first I'd like to see that and 1:54:22 hold this on first reading have a have a have a committee meeting bring it out a first reading take it to Second reading 1:54:29 and public hearing and have after we tweak it we can have we can have those comments again at the second reading in 1:54:38 public hearing well I would be happy to entertain that I'm I'm just happy that you guys are willing to consider to have 1:54:45 continue the discussion because like I said I'm open to suggestions I don't think this is perfect I don't want it to be it's not a cookie 1:54:53 so I appreciate you guys saying that go ahead what happens to the process of 1:55:00 what's happening to the alleys right now it's gonna be 1:55:06 stopped I'm sorry I'm in Andy's Ward and he's already told you that his constituents are asking for for Asphalt 1:55:16 in order for me to do that I'm probably at $500,000 if I do if if that that's 1:55:22 what I do it's all it's done in Andy's so there wouldn't be any falling back 1:55:29 into uh council person for is's area because I'm I would I would expend it all there so I want to say something to 1:55:37 that though how convenient for Andy yeah yeah well I uh I would like to have 1:55:46 a public hearing on this because uh my constituents are up in arms and I think I would feel the same way 1:55:54 councilman Marshall did if if I came home and it was pavement was gone and it was gravel I would appreciate that some improvement was done but at the same 1:56:03 time thinking about the dog days of August when it hasn't rained in six weeks and dust being everywhere all over 1:56:10 my patio furniture and my vehicles and everything I'd probably be upset so I understand both sides of it and I think we need to spend the time to come it out 1:56:18 and get it right I hate to startop progress but and and for my 1:56:26 department I'm just going to be very Frank it's it's a it's never a win situation it's just not you're you're 1:56:34 you're always going to have somebody that's GNA say I want Asel I don't want anything else uh but we've already made a 1:56:41 determination and I certainly uh I mean I can take a lot of abuse but I will not stand up here and get beat up for 1:56:51 decisions that I believe that I that I made uh talking about 460 alleys in the whole city and 1:59:14 millions of dollars yeah I'm in favor of that well I must say this is music to my ears I'm so glad you guys are 1:59:22 taking this seriously with me um so I I know we got a motion but one sec because I want to address this 1:59:31 important about the pause the assumption is the way you said is that we're just going systematically my question was well how much of that 1:59:38 left was going to be used for Paving and again there was no determined set amount it would if I got into an 1:59:46 area that I felt there was no reason uh brought up we paus it so 2:01:01 that so it's been paused for a little over a week my my opinion at this point is to take it off a pause go back to an 2:01:09 area that I've already done and like I said it won't take very long to do those areas uh so I'll kind of be back in that 2:01:16 we're all be moving down to that Ward at that point so you're talking about finishing the paved ones going correct 2:01:23 that that that's where I was going I would say now is a good time if you were going to do some Paving to do that and again the paving doesn't uh the the 2:01:31 plants don't open up amend an existing ordinance to allow for political signs to be placed in city right of way property without 2:03:01 obstructing vehicular traffic visibility the current ordinance does not allow signs to be placed in the RightWay property located in front of someone's 2:03:09 property speaking council president Nick McKinley I'm sorry guys three of Once this one I think is 2:03:16 going to be a little easier hopefully um essentially my motivation for this was uh there's so many people in the densely 2:03:24 urban area that I live that uh really don't have a front yard the only grass they have is between the sidewalk into the 2:03:31 rideway um or the rideway is a little deeper and so what I'm requesting is allowing people that are maintaining and 2:03:40 mowing the grassy area in their rideway to put a political sign no different than they can put a garage sale sign or 2:03:48 a realter sign as of right now you can not put one in a right away and it's we're not changing the rules you still 2:03:56 have you know 60 days to leave it out there and 15 to bring it down but I'm just asking to allow our residents to 2:04:03 put political signs in their right away that they maintain does it matter if it's paved or graveled in that just go 2:04:11 ahead I'm sorry oh you guys are killing me and I assume that it still has to have the 2:04:18 property owner right we can't just randomly put signs in the right away in front of other people's houses yeah I mean that's still I mean that's that's 2:04:27 not changing yeah I mean if someone put some in my right away then
