We're going to call to order the Maring Common Council meeting. Today is June 3rd, 2025 at 7 6:14 p.m. in the Marian City Council Chambers here in City Hall. And before we started tonight, going to change it up just a little bit. Uh, as those of you that are 6:23 watching at home or those in the audience might have observed uh the graphic tonight behind me or on your YouTube screen, um, if you're not sure 6:32 who that is, you might not have lived here very long. Uh, as everyone knows, that's Ed Breen. And Ed Breen recently 6:39 passed away. Um, I can't even encapsulate the words uh about Edbring and what he's done in our community and 6:48 the voice that he's had for so long. So, I have asked Councilman Klein to say a few words about Edbring. He probably knows him better than most of us up here. 6:58 Thank you, Mr. President. Yeah, I met Ed uh first day on my job at the newspaper in 7:06 1973. It was in the summer and since then known him a as a boss and a colleague 7:13 uh as a neighbor for several years as a friend since 1973 and as a mentor even not at the 7:23 newspaper. He was just one of these guys that cared about the community in talking to other folks who knew him. Um, 7:32 one of our other editors who's not here, who was very good in his own right, said 7:39 that Eddie taught him how to be how to make how this could be a community 7:46 newspaper. And he was in and of the community. He got the community talking both with his columns and his 7:55 reporting at the paper, then for years over at the radio station. He did it in 8:01 Fort Wayne as well. Um, this is the time of year when when we lived across the street from each other, we'd share 8:10 porches and we'd open the m Thai season. He would have a friend who would come in. He was a brother Patrick who 8:17 was I can't remember what order he was, but anyway, he would come in and I'd get a caller and yell at me from the porch, 8:25 Klein, get over here. We got to open the my Thai season. Um, on the other hand, he's the only person who ever, he said he's the only person who ever threw a coffee mug across a newsroom at someone. 8:36 It was me, and it still had coffee in it, and neither one of us could remember. But he was he taught he got 8:44 the community talking. He got the community listening. He he built a chunk of this 8:53 community that the community probably doesn't even recognize. 8:57 Um, people do things, say things, hear things, think things that at one time or another Eddie would have talked about. 9:05 And we go to we're going to be going to 1812 again. That wouldn't have happened without him. And uh, the little Colonel 9:13 Marty Lake. Um, I know there are other people here who knew him and worked with him. Before I get too choked 9:23 up, who could say things? This This is serendipitous. Audrey, his 9:29 daughter, posted this on Facebook, and it's something that Eddie 9:37 posted last year, last May. He says, and this is how he would start when he was going to say something genius, he would 9:44 he very often would start out as he does here. Not to get too deep here, but there is a beauty in the 9:55 living. Hang in there, folks. I'll get there. There's a beauty in the living and also in that which has run its 10:02 course and has settled into an orderly transition. Just a little something to ponder on a trip to the woodlands here 10:09 in Indiana. Thank you. Just another one of those Edreen moments, right? We all have had many of those Ed Breen moments and we're going 10:17 to miss those. So, I appreciate that, Councilman Klein. And uh Thank you for the time. Yeah, absolutely. Father, we thank you first and foremost for who you are. It is our privilege to honor you and uh we thank 10:49 you for the gift of your son Jesus and for the Holy Spirit to lead and guide us. I thank you for this council and I thank you for every decision that they 10:57 are going to make and for the business business that they're going to discuss tonight. And I pray that you would give them wisdom and clarity of mind and 11:04 speech. And I pray that Lord that we would all remember that it is an honor for us to serve in this capacity in this city. And I thank you for this 11:11 community. I pray for favor and blessing on every decision going forward. And I thank you, God, for everything that you do for us, even when we don't even 11:20 realize it. I thank you for the life of Ed who has uh gone on to be with you. 11:24 And I pray that God, you would uh help us honor him in this community by getting the community talking in a different way. Here and moving in tonight's community 12:18 spotlight, Nathaniel Beck, come on up all the way to the very front. I didn't tell him this part. Come all the way up 12:28 here. For those that haven't seen community spotlights, if Nathaniel's ever seen one, thanks for coming. Of course. Yeah. Nice to finally meet you. Yeah. 12:37 Um so we like to highlight various things in our community whether it's businesses 12:44 um and just groups and entities, students or any of our citizens really. 12:51 Um but tonight we are spotlighting Nathaniel Beck. And to be honest with you, Nathaniel, I had already asked him 12:59 to be community spotlight. And I had no idea that you were the valictorian when I asked you. I went to the graduation at Marian on Sunday. My niece graduated and 13:08 there you are the valadictorian. I said, "Go figure. This guy, I don't know what he has not accomplished at Marian High 13:15 School and we are just so proud of you, the council, the community. You know, there's a lot of great things in our 13:22 community. U but the people are what make it the best. And you are just graduating high school, but I know 13:30 you're going to do great things. and we're hoping and crossing our fingers you come back and do great things in our community as well. Uh I'm just going to read a little bit just summarize a few 13:39 things. I had Nathaniel send me some things about himself and it was more than one page. Um so I appreciate you doing that. I summarized it. Um so I'm 13:48 just going to read this. So Nathaniel Beck is a distinguished student athlete recognized for his exceptional academic and athletic achievements graduating as 13:56 validictorian with a 5.1 GPA. So, you what? Never had less than an A+. 14:02 Oh my goodness, that's great. Uh, Nathaniel is a n national merit commended student, AP Scholar with 14:09 distinction, and a 2025 Indiana association of school principles academic all-star. He was honored with 14:16 the IHSA Foundation's 2024 2025 Eugene C. Ko memorial scholarship and named a 14:23 rising star of Indiana. Um I think there was only just a handful of people in Indiana that got that right. 40 40 14:31 seniors in the entire state and we have one of them here in Marian. So that's amazing. Um a dedicated leader, Nathaniel served as senior class 14:39 officer, president of the National Honor Society, secretary of MU Alpha Theta and co-founder leader of the Fellowship of Christian Athletes. He has also 14:48 contributed to an 11th place team finish at the 2022 MU Alpha Theta National Convention. And athletics, Nathaniel 14:55 earned 16 varsity letters across four sports, soccer, cross country, wrestling, and track and field. Serving as team captain in each. He is a 15:03 four-time state qualifier, 11 times regional qualifier, two time semi-state qualifier, and this has been updated 15:11 since, but a one-time state qualifier now. Right. You're going to state. Yeah, it's on there. Is it okay? I said I thought I put it in there. He did have a You know what? Yeah. Yeah, you're right. 15:22 Oh my gosh, I just can't keep up. You have so many things. I did say that four times they quiver, but yes, uh the one I'm talking about is the one coming up 15:30 here. Uh let me finish all of these things here. Uh seven times uh all North Central Conference honore and a multiple 15:38 time recipient of team awards for performance and mental attitude. His leadership and dedication exemplify the balance of academic excellence and 15:46 athletic commitment. And yes, so his um 4x4, is it 4x4, right? 4x8. You're 4 by8. Oh geez, that's even worse. That 15:55 hurts thinking about it. Um his 4x8 team is going to state. U they've got first place at regionals. So, not only is he 16:03 balancing all of these sports, which is a lot of time and commitment, but he's excelling at those and also never getting anything less than an A+. In 16:11 fact, more than an A+ because of a 5.1 GPA. I can't overstate um how amazing that is. And of course, stay humble, but 16:20 we're really proud and you should be really proud of yourself. And I'm sure your parents uh and your family are very proud. Um but our whole community is 16:28 very proud of you. Um, I've been Facebook friends with Allan for a long time. So, I've kind of watched you grow up a little bit on Facebook. That's the advantage. But you're like, who's this 16:36 guy talking, right? Um, but no, it's been really neat just to watch you grow up from afar and um, just hear and see 16:44 all the accomplishments you've made. So, really proud of you. Would you like to say anything? Um, make any comments? 16:52 Thank you to my family. Um, they're the reason I'm here and I've done all these things. So, love you guys. 16:59 All right. And yeah, absolutely. And he he does they live in 17:07 uh district three. So um Councilwoman Divine, you want to say anything special being the District 3 representative? 17:14 Thank you. And I went back and talked to them as well, but uh super excited for you and we're looking forward to hearing the next things going on. I'm glad you're sticking within Indiana and you're a drive away to come back to all the basketball and football and all the sporting events because you got a younger brother here, right? That's a reader digress version of it, too. Okay. 20:07 Switching it up a little bit to city employee spotlight, which officially now I guess we could say it's former city employee 20:15 spotlight. Um, retired police sergeant Sean Seismore. So Sean, where you at in the audience? You got to come all the 20:23 way up. It's part of the gig. So as he's walking up, I will say he is also a city council president or 20:30 town council president and he uh gave up a little bit of that meeting tonight to come to ours. Uh the town council president in Van Beern, right? 20:40 Upland. You're fired. 20:43 Look, Upland. Upland. My bad. It's the same side. I'm from Marian. It's the same side of the county. Uh 20:52 Upland. My bad. I'm just checking. Um Upland. I know you're town council president. I got enough business going on here. I can't follow Upland. I'm not sure. 21:03 Anyways, um Sean recently retired from the Maran Police Department. Yesterday was technically um his last official day 21:11 as a city employee and um he's done a lot of things. I'm going to read something here in a minute that Chief Gilbert sent me, but um it was it was a 21:20 no-brainer, not only because you're retiring, but I know Shawn as well. A lot of us here know Shawn. Done a lot of things. Spent 20 years dedicated to this 21:28 city. Uh I first met Shawn through the uh Grant County Crimestoppers Board. He was our coordinator for some time and got to know him there and uh always had 21:36 a respect for him as a just a just the real deal straight shooter, hard worker and um uh we're just really glad that 21:45 you put 20 years for the city and we are honored to have you. So I'm going to read what Chief Gilbert wrote. Um the last paragraph's on the screen. I couldn't fit all of it. So I'm going to 21:53 read it right off my computer here. It says Shan Seismore has been a fantastic servant leader for Marian Police Department and the citizens of Marian 22:01 for two decades and that after serving our great country in the Marine Corps. 22:06 Shawn served in several important roles including patrol officer, detective, evidence technician, patrol sergeant and honor guard commander. No matter the 22:14 job, he was reliable, accountable, and effective, accepting and dominating every challenge and tough assignment. 22:20 Countless citizens have been helped by virtue of Shaun's commitment to service and duty. Every candidate seeking a job in law enforcement says during his or 22:28 her interview that the reason they want to be a police officer is to quote help people. Shawn said it too, but he actually meant it sincerely and prove 22:36 that sincerity literally hundreds of times by his actions, most of the time without fanfare or recognition. Shawn's personnel file is packed full of 22:45 commendations, far too many to itemize here. What is noteworthy about all of them is that is guaranteed that when presented, Shawn will always respond 22:53 with a variation of, "It was really nothing, Chief. I was just doing my job." And he meant it. As a partner, 23:01 Shawn's fidelity to his fellow officers and their safety was paramount. If you were on Shawn's squad and needed backup, you knew he would be there no matter the 23:10 danger or risk to himself. Further, this officer willingly stood up to career violent criminals who others feared in order that good people could feel and be 23:18 safer. Shawn accomplished many noteworthy things in his career, but his contribution to the creation, professionalism, and leadership of the 23:25 Maran Police Department Honor Guard stands out. Shawn was committed to honoring our fallen and retired partners and their families with distinguished 23:33 services when they passed. Importantly, this officer was recruited to serve as an integral part of a statewide team tasked with providing dignified funeral 23:42 services for police officers killed in the line of duty in Indiana and still contributes in this capacity. Shawn also 23:49 participated in dignified services at the National Police Memorial Ceremonies in Washington DC. In summary, Shawn 23:56 served with distinction and has been a fantastic partner. He will be missed dearly, but on behalf of the entire department, we wish him well as he 24:04 begins the next part of his journey away from Maran Police Department. And we know that no matter what vocation he chooses, Shawn will always bleed Marian 24:12 Police Department Blue and will always be our partner. Congratulations and thank you for your dedication, Sean. You served well. And that came from um Chief 24:20 of Police David Gilbert. Thank you, Chief, for that. 24:23 [Applause] 24:28 So, we just wanted to say thank you for your service and um we did actually have a flag raised over city hall all day today and we'd like to present you with 24:37 that flag. It's a 3x5 flag that we flung over city hall for you to take your last day or your first day as a civilian and 24:45 uh we appreciate your service. You like to say anything real quick? You have to now. I gave you the mic. 24:51 Yeah. Uh just, you know, I think Chief Gilbert, you know, 20 years ago, he gave me the opportunity to do the greatest 24:58 job in the world. Um through the last 20 years, we I've seen a lot of bad stuff, death, and destruction that the normal 25:07 person doesn't want to see. And we carry that with us day in and day out. 25:11 And my goal throughout my whole career was just to help people. Unfortunately, we have to take somebody's freedom or or 25:20 even worse. And I've met a lot of great people in this community potentially on the worst day of their life, but they have no idea how they touched my life. 25:29 And I remember that day as if it was yesterday. And again, I got the opportunity to get my first badge from Chief Gilbert, and I had the distinct 25:38 opportunity to get my last badge from him, and I appreciate that. Thank you. Thank you. Abstain. 28:51 Yes. 28:52 Calgill I McKinley yes all right consent agenda is 29:00 approved moving on to committee reports we have any committee reports I will start out real quick um I 29:11 am the vice president of the Marian redevelopment commission so the reason I was gone last meeting is some of us commissioners took a trip um to a 29:19 convention it's called the ICS convention in Las Vegas. It was a two and a half day trip very quick. Um where 29:26 a group of us went out there. We used to as a city go there 10 plus years ago or eight plus years ago. Um and for those 29:34 you don't know that convention actually is what helped garner some of the development down south in Marian that whole area where Meyers and some other 29:41 developments. Um it's a huge convention where there's retailers and developers um that come from all over the country and the world really. And so we took a trip out there. A lot of great meetings. 29:53 Um some cool stuff that might be coming our way to the city. And I think the trip was well worth it. Made a lot of great connections, talked to a lot of 30:02 developers and um uh we're just super excited. I know the mayor was there for a short moment, too, and and sat in a 30:10 couple of the meetings. But uh I share that just because, you know, a lot of people don't see the behind the scenes of what's going on every day. You might see a snippet on Facebook here and there 30:19 or you hear a rumor here and there, but I can tell you the gas pedal is down and it's down pretty hard right now. There's a lot of things when it comes to 30:27 developments and talking to developers, they don't want things out until the the ink is dry. Um, but I can say the mayor's doing a fantastic job. Um, and 30:36 there's a lot of stuff we'll say for the younger kids. A lot of things cooking on the fire right now, right, mayor? And, uh, we're I'm just really excited. I 30:44 came back just like super pumped about some of the things that we talked about and some of the meetings that we had. So, just want to give you a quick recap. 30:51 That was why I was gone. Uh but also it was kind of a committee report from the redevelopment commission. Any other committee reports? 31:04 All right. Um Oh, Councilwoman Divine, you have one. Okay. I just wait. Yep. I was waiting to see if anybody else had 31:10 one. Um the board of works met yesterday. Um and I missed some of the 31:17 beginning of the meeting about the bus switch outs from um transportation department, but I assume those were 31:24 approved. And then um the HVAC control system bid opening, which I'm sure they took under advisement, and we'll get 31:31 more information about that at the ne after the next meeting. Um they did agree to an easement that the city was 31:41 working on through the engineering department um and approved the bid recommendations for 31:48 um for the paving and for the um Buck Sports complex parking lot paving. And then they had a discussion about 31:56 additional safe structure unsafe structures and are working their way through a new process with those um as 32:03 well as uh kind of um approved a policy internally that they're going to use as 32:09 a way to um prioritize which unsafe structures are the most unsafe in that 32:17 they should be demolished as quickly as possible versus ones that maybe have some structural that have um interested land owners that are still working on 32:26 them and working their way through those so as to best use the city's demolition dollars and as well as trying to work 32:34 with the homeowners to get them back up to uh to code and to a habitable condition. So that was a interesting 32:42 conversation. Glad to see them working that way and trying to find the right ones to bring down for safety purposes and the other ones to get them repaired at the level that they should be. 32:53 So that was the border of works. We're happy to announce that after some very cold weather uh last week we had some warm weather and we 33:11 finally got the splash house open and now that the kids are all out of school, it's going to be open again because we're expecting really nice warm 33:20 temperatures this week. So, uh, get your youngsters out there and have them enjoy it. But the Splash House is now officially open. 33:28 Great. That's exciting. Such an asset to our community, too. 33:32 All right. Any other committee reports? All right. We'll move on to unfinished business. Starting with 33:39 general ordinance 10-2025, vacation of portion of public way, third reading. 33:46 An ordinance vacating a portion of the alley in the 1700 block of West Sixth Street. Vincent Msovvich petitions to vacate a portion of Geneva Avenue 33:55 alleyway in Marian, Indiana, citing various reasons. The petitioner, Vincent Mskovich, is the owner of the property at 1718 West 6th Street, Marian, 34:03 Indiana. MSV is seeking to vacate alleyway adjacent to lots number 4 through 29 and lot number 34 in 34:10 Parkersburg edition. The two property owners have not yet consented. The reason for the alley vacation is that the alleyway is unnecessary for access 34:19 to adjacent land owners, emergency vehicles, or utilities. The city will no longer maintain the area, transferring maintenance responsibilities to the 34:27 petitioner, and the alleyway does not contribute to neighborhood growth or public benefit. Speaking attorney Joseph Certain, welcome. 34:40 Thank you very much. Uh, I don't have a lot to say a lot I can add. This being the third meeting, third reading of this. Um, I think you have all heard it. 34:49 You probably are all aware that this is a dedicated alleyway uh on the west side of 34:55 town through what's now a forest uh that has never been improved. uh and it would 35:02 have no ill effect on or adverse consequences to any access from any of the emergency vehicles or the public 35:10 way. So I'd kindly ask that uh this you approve the uh this dedic 35:19 this reject approve this alleyway. 35:26 Thank you. Any council members with questions or statements, comments? Mr. 35:34 President, I have uh met a couple different times uh with with the neighbors uh especially Mr. Brown 35:43 expressed his displeasure with this uh vacation. It does affect him in a way. 35:56 Uh there's been ongoing violations in that alleyway. Uh it's taken up time 36:03 from our city administration, from Mike Graph, from Jerry Fosnite and so forth. 36:10 Um, I would like to see if this alley was vacated that there would be 100% 36:18 uh agreement between the neighbors uh for this to go through seeing that 36:25 there's not there's 50% of the people that are against it in reality 36:32 and I personally cannot move forward with this myself. So, 36:39 um I don't know if others have have looked at that property or not, but there is issues with that ongoing issues. There's been issues in the past. 36:49 Um and so I for one will not be voting for this. Thank you. Thank you, Councilman Kaine. Any other council members? 37:00 Council Klein. Yeah, thank you. Um, the lawyer in me says something that Mr. 37:09 Certain had said earlier that our issue isn't what the neighbors think, want, or have done or have seen, but it's excuse 37:17 me, but it's just the alley. But in the back of my head, I also have the thought, and I've been out 37:25 there. I've I've wandered around. I haven't talked to anybody like Councilman Kaine had, but I I drove out there and w got out and looked around a 37:34 little bit as much as and um you know what we heard at the public hearing and 37:42 beyond wasn't really far-fetched. And while the issue may not 37:49 be what kind of neighbor he is or what kind of business owner, whatever he may be, um the fact that sticks in my head that 37:58 there are still two folks there who don't agree with this and that troubles me. 38:06 Um because if this is vacated, what's to stop that from 38:15 becoming like the rest? And and still again another headache for Mike Graph 38:21 and his and um Jerry Fight and and those folks. I'm torn. 38:29 Um, yeah, as for an alley, that's the issue before us and I 38:37 understand that, but it's also a neighborhood and I just have a hard problem with that. And um so with this vacation, just so I understand better, 39:02 um this would hate to say the word benefit, but this would also vacate the alleys for the neighbors. Is that correct? 39:13 Pardon me. That is correct. However, we're talking here about four lots along 39:19 the side of the alley and one lot on the street on this south end of the street, Park Avenue. Uh otherwise, all the 39:28 property in and around the alley from Geneva Avenue all the way through is owned by the petitioner here, Mr. 39:36 Msovich. 39:38 uh vacation to the alley will not affect adversely anybody's access. As far as 39:44 the comments from Mr. Brown uh the last meeting, uh his comments generally 39:52 revolved around his concern with the children or and kids in the neighborhood 39:59 uh being disturbing to them. That has nothing whatsoever to do with the alley or the alley vacation. 40:07 that will not change. If he has problems with the children, there are ordinances that he can bring to bear to have that 40:16 remedied, but that didn't have to do have anything to do with the vacation of the alley. 40:23 Thank you for that. And I understand where uh Dave's coming from and and Mike's coming from, but Here's here's my point on the issue 40:39 is right now with the alleyway anybody can travel through that all those lots 40:48 towards the back of those houses. I mean right now it doesn't stop anybody from driving down through there if 40:55 possible with this vacation. It stops that there's nobody allowed to transfer through those back of those properties. 41:05 It actually deeds half of the alley to each property owner. So, not only would it stop people from traveling through 41:13 that alley, it would deed half of the alley to Mr. Brown. And I I don't see 41:20 where that would be a negative impact in my opinion. Um, most of the feud between the 43:28 two comes because of the children riding motorcycles and stuff through the woods and Mr. Brown didn't like it. Again, I 43:36 want to understand that I've worked for Mr. Brown. He owns that four lots there. 43:42 There are 6 8 10 12 14. There's almost 40 lots in 43:49 there. Mr. Brown owns four lots and has a house on there. The other person 43:58 uh Mr. Weir has an end lot that is no 44:04 improvements and I wasn't aware that he had objected. I don't know. Did he formally 44:12 write an objection? Did he show up and object? I don't know. I know the only one who showed up was Mr. Brown. And 44:19 again, there's an underlying problem. My point is Mr. 44:26 Mskovich's efforts to vacate this isn't going to hurt anybody. In fact, Mr. 44:31 Brown is going to gain 132 feet wide by 8 and a quarter, half the the south half of the 44:38 alley. And it is correct. Once that alley is vacated, no one can go through there. There's not even utilities down 44:45 through there because it's impassible. Um, his efforts to do this 44:52 are indeed, I think, pure and it is to clean the place up, but he's restricted with doing something when he's got 45:00 through the middle of his property an alley, 16 and 1/2t alley. 45:05 Um, so I just want to reiterate to you that even though there are two land owners, one of them I'm not aware he's objected. 45:15 I don't know if he's filed an objection. 45:17 If he hasn't, then it's a moot point. 45:23 Secondly, there only five lots out of I don't know how many there are, 40. And that is kind of 45:31 disproportionate. Yeah. They one person lives there, Mr. Brown, and he's the only one. And again, there has been 45:40 serious serious issues between him and Mr. Mskovich. And my opinion and what what 46:33 I'm getting from this or my interpretation is there's a lot of hard feelings. Um a couple years ago I requested a variance to put a taller 46:41 fence in my yard and I had to go through all the the zoning and all that in my backyard. Fortunately nobody 46:48 objected but it it would have hurt nobody. Actually it helped me. Um, but it hurt 46:56 nobody. But I couldn't imagine if I had ticked off a neighbor a couple times or even if it was legit, even if I did 47:03 break local ordinances to object the fact that I wanted to put a 8ft fence up. So that's where I'm at. So I'm I'm speaking from 47:12 my own experience of going through not a alley vacation, but just a change a variance of a property. And is this an 47:20 objection to the idea or the objection to the owner of having that idea? And then my other thought is I'm sure this 47:28 probably wasn't pro bono. Was this a a paid effort? I don't know if you can tell me or not. 47:35 If it was paid, I'm just saying that it sounds like Mr. 47:43 Mskovich maybe fronted the bill for this that then allows everyone else to get some of this alleyway. are they they're going to end up absorbing this 47:52 alleyway. So, in my view, I almost see it as a favor. Like, I'm paying for this, but and I'm going to benefit from 48:00 it, but my neighbors are going to benefit from it, too. And I do understand, and I thought about this ahead of time with does the vacation of 48:08 this alleyway actually maybe help what some of the issues have been? I don't know. Um, but then I separate out if 48:17 there are issues with motorcycles or trash or whatever, then that needs to be enforced on its own leg. That needs to 48:25 be handled, tackled, taken care of separately from the idea of vacation of 48:31 of vacating an alleyway. And so, while I'm upset that we have neighbors that are upset with each other and they're 48:38 wanting to object, I'm just I have to pull my feelings out and go, what's the literal request here? And it's to vacate an alley that has been abandoned. 48:49 Essentially, it's urban. It's been abandoned in an urban environment that could potentially benefit all of the neighbors. 48:57 Um, so that's where my opinion is. So, I will be voting in favor of it. But I 49:03 will say my hope is that moving forward there can be some peace within that neighborhood. So it kind of ends up at the end of the year uh which always tails into not being able to use 1:03:12 that money. So henceforth we look at carrying it over. And the reason why we're this far into the season before 1:03:19 I'm at before I asked for it talking with Linda uh she was dealing with some things to to do close out all the books 1:03:28 and I didn't want to disrupt her trying to get these total numbers. So I just waited until she was done. So I'd be glad to entertain any of the questions 1:03:35 from any of the uh the the following appropriations uh and then you can take them one by one as you'd like. 1:03:44 This seems like a no-brainer. I mean, what if these wouldn't pass? What does that mean? Moving on to general ordinance 12-2025 reertifying council election districts. 1:09:20 Um, get this pulled up here. So, for those that aren't aware, uh, every 10 years we have a census in 1:09:29 America and part of, uh, Indiana law is that after those census, you are supposed to reertify or, um, redistrict your governmental entity. 1:09:43 Currently we have six districts represented by six council members and then three at large which cover the entire city. Um so usually this is would 1:09:53 have been done by now but co uh I hate to say that but co had its impact in 2020 and delayed a lot of the census 1:10:03 results and there was a lot of grace and mercy in in getting this uh done and approved. But there is a deadline. The 1:10:10 deadline is at the end of this month. um otherwise you risk lawsuits um and those are going to 1:10:19 get costly. So uh I have been working with gentleman by the name of David Shelton. He is the 1:10:26 um city clerk over in Knox County and um met him through some other channels and 1:10:34 he is really good at doing this and he does it for free and he offers services just as just goodwill to other 1:10:42 communities around the state and he offered to do it for us. It's not overly difficult. Um I have learned a lot in 1:10:50 this process and I think well I think next time I could probably do this now that uh he has shown us. So, first off, I want to give credit to David Shelton 1:10:57 uh and give the numbers. So, what happens is the census, we have the total population of the city that comes from the census. We have six districts and 1:11:07 the goal of reertifying or redistricting is to have as much equal representation. It's basically a math 1:11:16 equation, right? You take the total population divided by six districts and you want to have those populations as close as possible. there is a little 1:11:24 variance that's allowed. The average uh that they want to see is around 10% or 1:11:31 less. Um we are at 11.6 and you know his opinion and 1:11:38 others has been that's within the rule of of thumb for the 10% range. And and 1:11:45 so just to for so each council member can hear, District 1 has 4361 1:11:53 um residents. District 2 4891. District 3 4659. District 1:12:01 4763. District 5 4727. And District 6 has the most in 4,99. 1:12:10 And so you add all those up and you divide it by six and that's 1:12:18 4718.33. Then you take the most populous subtract the least populace and the difference is 548. Then you take that remaining number and divide it by the target population. 1:12:29 So, um, so you take 548 divided by 1:12:38 4718.33, uh, because that's the average of of all the six and that equals 11.6. 1:12:44 So, just wanted to give you guys the math and not just me say, "Yep, we're good." That's how they come uh to this formula. This formula comes to that 1:12:52 number. Um the current population deviation is appropriate to not redistrict at this time. There's no set 1:13:00 number in state code, but the rule of thumb is around 10%. And it's close enough to not warrant confusing voters by changing districts. So the 1:13:08 recommendation was to just reertify our council election districts. So any questions? Councilman Klein. I don't know if I have a question and I'm going 1:13:16 to vote for this on first reading because it needs to go to a public hearing. I'm glad you explained that because I had gone back and I'm not 1:13:24 volunteering to do any redistricting duty. Just get that on the record. 1:13:29 Um I'm glad you explained that that it's based on because I looked up uh 1:13:36 2019 that was most competitive and most voters of recent elections. And these 1:13:44 are the 2019 Ward voting totals just for whatever it's worth. In Ward one, there 1:13:51 were 546 votes cast. In Ward two, there was 1:13:58 1,324. Ward 3, 575. Ward 4, 1:14:03 581, Ward 5, 401, and Ward 6 456. Um, we may not have the population deviation that we have voting deviation. 1:14:16 Maybe that tells us we need to do a better job of getting voters out and giving them a reason to vote. But I'm I thank you for that explanation because I 1:14:25 had no idea how that was done. It was far too much math for me to cons and and thank you. I'm not going to 1:14:32 lie. You know, at first I was like, I don't even know where to start. And uh like I said, I all credit to David Shelton um explaining all this. I had 1:14:40 the email. I'm 1:17:13 like, "Nope. Had no idea." You know, you you take this position and there's you don't know what you don't know. So, I 1:17:20 agree with you 100%. The problem and I hate this. I feel like we have to rush it a little bit. I'm glad the numbers landed where they did. Speaking Council President Nick McKinn, that time of year again. Um, just as a 1:28:36 friendly reminder, the CF-1 forms are compliance forms for people that have received tax abatements in the city and 1:28:43 continue to receive abatement based on their abatement schedule. And every year they are required to resend that. 1:28:50 Um, as we were re received those forms, I was sending them over to Chuck Binkert, who is the executive director 1:28:59 of the Grant County Growth Council. He helped us last year and um he helped review those as well. Second set of 1:29:06 eyes. If there were any issues, he would reach out to that organization and have them um make those changes. So, um, this 1:29:15 year's, from what I understand, all came in with no issues. I will say Chuck wasn't able to be here. He's on 1:29:21 vacation. Um, but he did say that all the ones that were submitted um has his full 1:29:29 recommendation. He didn't find any issues and um that he requested that we approve the 1:29:38 ones that were submitted. So, uh, I don't remember last year, uh, Marty if we or if anyone else remembers 1:29:45 if we approved these all individually, one at a time or in one fell swoop. I'm not sure. Does anyone remember? 1:29:53 I think um I think we did them one at a time because there were 1:29:59 some that were sent back and if we had passed them all at one on Moss, we wouldn't 1:30:08 have caught anything. If if there's an issue that council member has with one of them and 1:32:23 we have a discussion, we can always move that to the next meeting, too. So, if if you see one, you're going, I'm not so sure, we can either move it to the next 1:32:31 meeting, could pull one or a couple out and send it to a committee. Um, but I know I remember Councilman Klein and I spoke last year about do we even need a 1:32:40 compliance committee, right? that discussion when we have Chuck um as an entity that has the time and ability to reach out to these organizations and he 1:32:48 did help us last year and I think the corrections that were made last year and the communication he had with those companies helped this year because they 1:32:55 actually submitted the forms properly because he did show them, hey, this is how you fill it out. Um Mr. President, 1:33:02 I I I I agree with you and I'm glad Chuck's here and I I trust Chuck and everything, but with it being our name 1:33:10 on it at the end, I think that if if if it doesn't go to committee, at least to the chairman, I feel like somebody from the council ought to look at this though 1:33:18 before we Yeah. Again, 1:33:25 Chuck Chuck's request and ask from me was just to make sure the forms were completed. It is on us. It says it right 1:33:32 on the form. It's us to make that full decision decision. I think where last year we changed things up is historically it was the committee that just approved it, not the full council. 1:33:41 Well, according to IC code, it has to come to the full governing body. Um, so I think that's where last year we changed things up. Chuck, you know, we 1:33:49 we deviated from our previous practices last year probably to fall in better compliance. But as far as how we move 1:33:56 forward, um, I'm okay either way. um you know may they had a deadline to submit it. We don't necessarily have a deadline 1:34:03 to approve it other than the you know there are certain filings at the county that they need to start filing for their their property taxes. And so the longer 1:34:13 these take this is no pressure. The longer these take the longer that could delay that process at the county for these organizations. But um I'm open to 1:34:22 anybody else's opinions on which direction like to see this go. I personally have read through all of 1:34:29 these and I remember them from last year and looked at their numbers and I don't have a problem approving them today, but that's just my one bill. 1:34:40 Yeah, as a compliance person, I looked at them as well and I didn't see any red 1:34:47 flags. Whether I'm misread or overlooked, that could be, but nothing said nothing smacked me upside the head. 1:35:02 I did as well. So, this isn't like going to a second reading public hearing. As soon as we 1:35:33 approve these are approved. So if if the decisions made today, we could vote for all of these, some of them, and then the 1:35:41 ones we approved today are done. And if we want to carve some out to look deeper next time at the next meeting, we do that as well. 1:35:49 since the deadline isn't that crucial for us. Not to knock anybody else's 1:35:57 um portion of the process. I did and because I 1:36:34 got I got that same email and there was like four residentials that they said were not qualified and the abatement 1:36:42 that we had approved was rejected. 1:36:46 So on residentials, there were I know four for a fact that they had rejected because they said they didn't qualify 1:36:53 for residential tax payments. So that's the only thing I want to make sure and clarify on going through those CF1 forms 1:37:01 is that the county kicked them out last time and sent us a email. Yeah, I did uh 1:37:10 I know they sent it to you because I got it. I I did uh speak to Michael Hots on that as well. 1:37:20 Um forwarded that information over and he disagreed with their 1:37:28 opinion. Um so the residential homeowners can debate it. Well, I mean here's I mean and Marty, you know, stop 1:37:37 and correct us if we're wrong or you have an opinion on this. Our vote is still a vote. It's still a vote. If we approve it, we approve it on our end. 1:37:46 Now, what the county does? I I I don't know where that needs to be sorted out on the legal side. So, I'm just trying to be very careful because he's not a council 1:39:21 member or at the very least I would have expected him to say I've looked these over and there are three of them that I think you guys should focus on or 1:39:29 something some kind of advice in that capacity otherwise I don't know what his role is. That's that's you know I 1:39:37 understood this that We were looking at his he he was giving us an expert 1:39:44 opinion on these forms, what's in them, what did and that he's not passing on them, but he's 1:39:51 giving us a do pass or pass these take a look at those that 1:39:58 that he was he was our expert witness. I guess he was our get an expert opinion. 1:40:04 Him saying otherwise I would assume that everything is appropriate. Yeah, I'm comfortable voting for them, but if not everybody has looked at them, that's 1:40:13 putting them in an awkward position to vote for something they haven't studied. 1:40:17 Okay. So, let me let me clarify something here. I just want to I'm just trying to be careful my words because I don't want it to come across as, 1:40:26 well, Chuck said yes, let's just blindly vote for it. That's what I'm trying to be avoiding. What I'm saying is that it 1:40:33 still ultimately is on us to ensure that he did, and I didn't send this out. I didn't feel like I need to. He did send 1:40:41 the list of all of the ones that you got a list on and made a column. And yes, they all had signatures. That was an issue. And yes, they're all in 1:40:50 compliance. Your interpretation of compliance is different. But his professional recommendation was that these are in compliance with what the 1:40:59 original ask was and what we have asked him to do to get that tax abatement. With him not being here, I 1:41:07 just don't want to extend out that opinion any further than it is our duty at the end of the day as a governing 1:41:13 body to say yes, we agree this matches what they agreed to do in the original tax abatement. So yes, he did say 1:41:20 compliance. Um, his opinion is that these in his opinion 1:41:28 are passed the test. Whereas before he was involved, we had them that didn't even put any information down at all. So he would have filtered that and said, 1:41:37 "Look, no, we we need to get this." Some people didn't know how to I mean, last year we ran into it. Some people didn't know what numbers to put where. And so 1:41:44 then we're reading them and going, you know, are they even in compliance? 1:41:48 Because they they didn't know what numbers to put in what column. So, his benefit in this is he's actually helped educate some of them that fill out these 1:41:56 CF1 forms and go, this is how you need to do it. These are the numbers you need to put here. Um, which honestly has made 1:42:04 the process so much smoother. The goal last year was to streamline this process for us. This year, in my opinion, it's been streamlined. He did an excellent 1:42:12 job. every time I'd send him one, he went right to work on it and did his due diligence, send back his opinions, which 1:42:20 we forwarded on to everyone. Um, and and that's where we're at. Just trying to streamline this and not make this overly cumbersome. 1:42:30 I have one more question, Mr. President. The other question that I have was uh previously 1:42:39 JG Bowers had a tax abatement on his property out on 16th Street. I believe 1:42:47 they call that 16th Street. JG Bowers construction company. Well, Peerless 1:42:53 Machine on Third Street and JG Bowers switched properties or ownership of properties, 1:43:02 let me say. Peerless Machine moved to JG Bowers property. JG Bowers moved to Peerless Machine property. The tax 1:43:09 abatement stays with the property. So, did Peerless Machine take 1:43:16 over the tax abatement or did JG Bowers try to transfer it? I brought this up to Chuck. He said that he would look into it. This has been about four months ago 1:43:25 when I heard they were moving and he hadn't got back to me. 1:43:29 So, I do know for a fact that the taxment stays with the property. So I was just wondering if that was the case and since they 1:43:38 switched properties did peerless machine inherit that tax abatement on that property until it expires or did JG 1:43:47 Bowers try to transfer it to a different location because they can't do that. Great question. I think we'd have 1:43:55 to look at the original resolution on that one. It was resolution 6-2020. Um, so it would require a second look at that resolution. 1:44:05 I ain't familiar with the property switch, but um I couldn't answer that question. 1:44:12 Yeah. And he was going to get back to me and didn't and you brought it to his attention because when they switch properties, I asked him, I said, "I know the tax bait stays with that property." 1:44:20 He said, "Yes, with that owner, that property, he can sell the property, but taxment stays with the property." on on 1:44:27 JG Bower's form for this uh for the personal property. Anyway, um the location of property is 1820 West Second. 1:44:38 So, he's that's the former peerless. He's transferred it. He's trying. Yeah, you can't transfer. 1:44:45 That's on the personal property, though. 1:44:48 That is on the personal property abatement. He may be able to transfer that. I'm not sure. I don't know. 1:44:52 there's there's gonna be a distinction between real and personal property potentially. I'm unsure of the issue, Mr. Ford Ice. I looked at at the 1:45:00 applications and was aware of the switch and uh had the same questions that you did. So, I'm looking forward to trying to find some answers, but the personal 1:45:08 property was installed at the Correct. I agree. Yeah. So, that's the only thing that I want to make sure that 1:45:16 Yeah. If he if he's changed addresses on that and taken that abatement with you, I don't think he can take that abatement unless he reapplies for a new abatement 1:45:25 is what I'm saying on the address on the commercial property, which that one we don't have that one. Uh so I appreciate all of your opinions and and sorting this out. 1:48:03 Moving on to the Grant County Visitors Bureau. So I just love getting surprises. Um, you know, I got surprised 1:48:11 with the redistricting month and a half ago and then about uh I don't know, two, three weeks ago, surprised with that the 1:48:18 Maring Common Council actually gets an appointment to the Grant County Visitors Bureau and I found that out directly from the director of the visitors 1:48:26 bureau. I was in a meeting and somehow that came up and I was like, "Oh, didn't know we had an appointment." And we have not had an appointment and I guess it's 1:48:34 been years since we had a representative on that visitors bureau. um not only the city council but I found out the county 1:48:42 council I think as well. So I did call um President Greg Kits and informed him and he was happy to hear that. So with 1:48:50 that being said, we do get one appointment. It is uh based on their bylaws on the visitors bureau. It is a two-year appointment. Um there's no set 1:49:00 time we have to start it. Um what I would like to do and I've been working with deputy clerk um Aisha is to submit 1:49:10 or to put out an advertisement to advertise for resumes. 1:49:16 I put that in the executive summary. Um sorry I'll just go ahead and read the executive summary. It's just it was discovered we get one board appointee. 1:49:24 Um basically it says the city council is now accepting resumes to be considered for the appointed position to your appointment. that will run July 1st, 1:49:32 2025 to June 30th, 2027. Um, again, this isn't an ordinance. This is just me writing the executive summary. If you guys agree, 1:49:40 disagree, and want to have a different time frame, we're open to that. And then I just put in there a deadline to submit resumes is June 24th. Um, that allows us 1:49:49 to sub uh receive resumes uh before the deadline for the 1:49:56 agenda. So that way we can get those resumes out to all the council members uh and we can make a vote or decision on 1:50:04 the July 1st council meeting and whoever gets voted that day would immediately begin and uh I have some other 1:50:11 information as well. Happy to share on what that commitment looks like. I will be also sharing it on the my councilman Facebook page. I'm going to have the ask 1:50:20 the city to also share that on the city website and through those social media channels as well. Um I'll just say the position overview. 1:50:49 As a commissioner, you're actually a commissioner for the Grant County Convention and Visitors Bureau. play a key role in promoting tourism and supporting the growth of local 1:50:57 attractions. Commissioners meet publicly four times per year and are also expected to participate in one of the 1:51:04 following committees: marketing, attraction, development, I'm sorry, attraction development or finance, each of which meets three times annually. 1:51:14 This is a two-year volunteer commitment aimed at enhancing the visibility and economic impact of Grant County as a destination. So, this information was 1:51:23 texted me by Haley Anderson, who's the director, that we would also include some of this in that advertisement as well, so people know what they're 1:51:30 signing up for. Anybody that would submit a resume, um, I would reach out to and again reiterate what that 1:51:38 commitment looks like and make sure they know what they're putting their name in the hat for. And then as a council, then we can then make the decision as a whole 1:51:46 and and decide who we want to represent the council. Uh it's not limited to uh I mean obviously you have to be over 18, 1:51:53 live in the city limits. Um and it's other than that it's not limited to anybody else. He could even be a council member if you really wanted to put your name in the hat. I nominate Mayor Morel. 1:52:03 Yeah. Now he gets his own appointees. So um well then he should serve on that board. So anyways, resumes can be turned 1:52:10 into the city clerk's office uh or emailed to council president city of.in.gov of as those resumes are 1:52:19 received, they'll be immediately dispersed to council members. So, you have time to reach out and and and communicate with anybody that might put 1:52:26 the resume in. Councilman Brunner, is that a paid position? It is not volunteer. Okay. Um, but a very, very important position, especially as we develop this city and this county. 1:52:40 Um, but we want somebody to represent the council and be maybe our eyes and ears and and and contribute to that 1:52:48 visitors bureau.
