MINUTES OF EXECUTIVE SESSION

The Common Council for the City of Marion met in executive session on April 21,
2026, at 6:02 p.m., in the Council Chambers, City Hall, pursuant to I.C. § 5-14-1.5-
6.1(b)(4) to conduct interviews and negotiations with an industrial and/or
commercial prospect.

Members present: Brian Cowgill, David Cain, Gary Fordyce, Mike Cline, Andy
Whitton, Erika Devine, Jim Brunner (6:40), Jeffrey Reyes (6:50).

Members absent: Eric Marshall

Others present: Joe Murphy, Economic Development Director; Andy Mouser,
Baker Tilly; Chris Greisl, Barnes & Thornburg; Jake Bates, BW Development,
LLC; Martin A. Harker, City Council Attorney.

Pursuant to I.C. § 5-14-1.5-6.1(d), the Common Council for the City of Marion
certifies that no subject matter was discussed in the executive session other than

the subject matter specified in the public notice. The meeting was adjourned at
6:57 p.m.
